Watershed Special Permit-Waiver

HISTORY AND BACKGROUND
On August 24,2020,the applicant requested a Waiver of the Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw section 195-4.24 Waiver of Special
Permit,so as to allow the clearing of vegetation within the Non-Disturbance Zone in order to create
space for a shed and swing set to the rear of the house. The area proposed (approximately 1,400
SF) is located beyond the limit of clearing tree line shown on the approved Definitive Subdivsion
Plan. There would be no change to topography and the applicant has indicated he would work
around existing trees, where feasible.
DECISION
After a Planning Board meeting on the above date, and upon a motion by J. Simons and 2"d by A.
Preston, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote was
4-0, unanimous in favor of the waiver.
FINDING OF FACT
The Planning Board has made its decision based on the following findings:
■ The project will not create any new impervious area.
• There is an existing wooded between the proposed area to be cleared and a trail to the
rear of the parcel.
■ The Planning Director will conduct a site visit prior to clearing to ensure the location is as
described on the sketch submitted to the Plamiing Board.
CONDITIONS
+ The Applicant will schedule two inspections with the Town Planner during the
construction process.
The Planning Director shall approve any changes made to the criteria listed in the Findings
of Facts, on which this decision is based. Any changes deemed substantial by the Planning
Director may require an application for a Watershed Special Permit prior to re-
construction.
