Chairman makes preliminary announcement that this is a meeting of public record, is being broadcast
and recorded, and that anyone watching may email ZBA administrator with any questions, comments,
or opinions.
Chairman reads the Supplemental Legal Notice into the record.
2. Acceptance of Minutes
Motion made by Ronn R. Faigen to approve the July 14, 2020 meeting minutes. Seconded by
Alexandria A. Jacobs. The vote to approve is unanimous 5-0.
3. New Public Hearing of 20 Fox Hill Road
The petition of Michael Scully for property at 20 Fox Hill Road (Map 39C, Parcel 49), North
Andover, MA 01845 in the R-2 Zoning District. The Applicant is requesting a Variance pursuant to
Town of North Andover Zoning Bylaws, Section 195-7.3(B) Yards (setbacks), Table 2 (Dimensional
Requirements) for construction of an addition onto the existing home.

. Applicant has spoken to
neighbors who have submitted letters of support.
Board members feel the abutters feedback is important and do not have issues with project.
Motion made by Alexandria A. Jacobs to close public comment. Seconded by Ronn R. Faigen. The
vote to close is unanimous 5-0.
The Board Deliberates.
Motion made by Alexandria A. Jacobs to approve the variance. Seconded by Steven R. Seide. The
vote to approve is unanimous 5-0.
The following plans and exhibits were referenced:
(1) Plot Plan prepared by John D. Sullivan III, P.E. dated February 18, 2020 containing one (1) page;
(2) Floor Plans (existing and proposed) and Framing Plans dated April 26, 2020 and May 2, 2020
containing nine (9) pages;
(3) Elevation Plans dated February 7, 2020 and April 26, 2020 containing six (6) pages;
(4) Letter from Donald F. Borenstein, Esq. dated July 13, 2020 containing three (3) pages;
(5) Printed PowerPoint deck, undated, containing ten (10) pages; and
(6) Various Letters from Abutters in Support of Application.
4. New Public Hearing of 14 Beech Avenue
The petition of Kenneth G. Collins for property at 14 Beech Avenue (Map 033.0, Parcel 044), North
Andover, MA 01845 in the R-4 Zoning District. The Applicant is requesting a Variance from Section
195-7.3(C) Yards (setbacks), Table 2 (Dimensional Requirements) of the Town of North Andover
Zoning Bylaws, for rear setback in the R-4 Zoning District to construct a 10' x 12' deck. The rear
setback proposed is 22 feet; the rear setback required is 30 feet; the relief variance requested is 8 feet.
Alexandria A. Jacobs reads the Legal Notice into the record.
Kenneth G. Collins is seeking relief of 8 ft. due to the rear setback not being able to be complied with

Motion made by Alexandria A. Jacobs to close public comment. Seconded by Ronn R. Faigen. The
vote to approve is unanimous 5-0.

Motion made by Alexandria A. Jacobs to approve the variance with the condition that a corrected plot
submitted by
August 18, 2020. Seconded by Michael T. Lis. The vote to grant the variance is unanimous 5-0.
5. Discussion and Vote regarding New Variance Application Form
Motion made by Alexandria A. Jacobs. Seconded by Ronn R. Faigen. The vote to approve is
unanimous 5-0.
6. Adjournment, meeting adjourned at 8:29pm Motion made by Michael T. Lis to adjourn the
meeting. Seconded by Alexandria A. Jacobs. The vote to adjourn is unanimous 5-0.
