30 1679 Osgood Street, Chad Lawlor: Request for release of a$2,000 performance bond associated with a Site
31 Plan Review Special Permit granted November 7,2017.
32 J. Enright: This project allowed for a contractor's yard and outside storage of landscape products and landscape
33 contractor equipment. Applicant to submit his as-built plan by next week. An engineer certification letter has been
34 submitted. Two site visits were conducted; involving a weekday and weekend. The site plan depicts 9 parking
35 spaces to the rear of the lot that are not actually delineated; however,the area was wide open during both site
36 visits. The surface is mostly crushed gravel. The buffer trees are installed, signage for 7 tenant parking is
37 installed,and pavement in the two specified areas has been installed.No abutters have contacted the office since
38 the approval.
39 MOTION: J. Simons made a motion to release the bond in the frill amount of$2,000 for 1679 Osgood Street,
40 Chad Lawlor, upon receipt of the as-built plan from the engineer. A. Preston seconded. The vote was 4-0,
41 unanimous in favor. Roll call vote: I Simons voted yes. A. Preston voted yes. E. Goldberg voted yes. P. Boynton

50 proposes construction of two building additions totaling 8,708 SF with associated parking, landscaping, utilities
51 and stormwater management design. The primary use proposed is manufacturing and warehouse. The property is
52 located in the Industrial-1 Zoning District.

55 DISCUSSION ITEMS
56 135 Carter Field Road,Jim_Raso: Request for Waiver of a Watershed Special Permit, so as to allow
57 approximately 1, g g y g 400 SF of vegetation clearing beyond the limit of clearing as shown on the Definitive Subdivision
58 Plan and within the Non-Discharge Zone of the Watershed Protection District. Applicant wishes to create suitable
59 space for a shed and swing set.
60 J. Enright: Subdivision originally required a Watershed Special Permit and a Planned Residential Development
61 Special Permit. Applicant seeks a waiver of a Watershed Special Permit in order to clear approx. 1,400 sf of
62 vegetation within the Non-Discharge buffer zone to create an area for a shed and swing set to the rear of the house.
63 The proposed area to be cleared is located beyond the limit of clearing tree-line shown on the approved
64 subdivision plan.There is no change to topography proposed and Applicant agrees to work around existing trees
65 where feasible. Excerpts from the two original permits are included in your packet. Referenced existing conditions
66 site photos; much of the area was cleared by previous owners and some of the vegetation is starting to grow back.
67 E. Goldberg: Visited site to determine required removal of two small trees and low vegetation; neighboring pool
68 approved in 2003,clearly into the watershed buffer zones;tree line appeared to be well maintained throughout the
69 neighborhood.
70 J. Enright: Noted adjacent Essex River Greenbelt walking trail bordering the subdivision; significant amount of
71 woods exists between where homeowner requests clearing and trail.
72 Jessica Raso,Homeowner: Has 2 year old twins and a 4 year old child. Seeks to clear brush area for shed and
73 swing set. Explained that, although there is some lawn area to the left of the proposed area,the lawn area is very
74 close to the neighbor's pool and has safety concerns. 'The pool gate is sometimes left open and prefers to locate
75 the swing set away from the pool area.
76 MOTION: J. Simons made a motion to approve the request for Waiver of a Watershed Special Permit for 135
77 Carter Field Road, Jim Rasa,North Andover, MA in order to clear approximately 1,400 sf of vegetation.
78 Additional cutting would require the Applicant to come before Planning. A. Preston seconded. The vote was 4-0,

89 associated landscaping. The majority of the proposed work is within the General Zone with a small portion of
90 reconstruction of walks, parking and landscaping on the outer edge of the Non-Disturbance and Non-Discharge
91 Zones. The project is located in the Residential I (R-1)Zone.
92 J. Enright: Recent site visit provided full overview of the project. Department review has been satisfied.NAFD
93 has approved a revised swept path analysis and access points. Stormwater review is satisfied.
94 Andrew Leonard A. T Leonard&Associates: Provided stormwater update; five summary points include: history
95 of stormwater on campus including previously approved infrastructure, series of technical calculations updated in
96 the stormwater report, recommendations and updates for the O&M plan and map, supplemental information
97 pertaining to specific Watershed Special Permit requirements(fertilizer plan, no degradation to watershed, no
98 toxic materials, etc.), and edits to erosion control plan during construction.

104 Application for Site Plan Review Special Permit under Article 8 Part 3 and Article 10 § 195-10.7 of the North
105 Andover Zoning Bylaw. The Applicant proposes construction of a 15,100 SF single-story metal building with
106 associated parking, landscaping, utilities and stormwater management design. The primary use is a proposed
107 office to serve the Applicant's construction company and the accessory uses are indoor storage for equipment and
108 vehicles as well as an outdoor gravel laydown area also to serve the construction company. The property is
109 located in the Industrial-1 Zoning District.
110 J. Enright: Referenced previous decision on a similar project located at 1679 Osgood Street with an abutting
III residential district. Building Commissioner deemed rental of contractor bays is not allowed as"accessory use"and
112 has spoken to property owner. First round of comments from stormwater peer review were received and the
113 applicant has provided a response; department reviews are satisfied. Aerial view shows proposed building approx.
114 190 ft. from nearest house; adjacent building is approx. 230 ft. from the nearest residence. Recommends
115 conditioning a pre- construction site meeting to review erosion control and if necessary, Planner can require
116 additional controls, if warranted. Revised architectural plans were submitted,eliminating tenant spaces; no abutter
117 comments were received.
118 Charlie Weir,Meridian Associates: Reviewed supplemental information regarding drainage.
119 Bill Linskey,DWT Holdings: Agreed to conditioning hours of operation providing they are flexible, noise,
120 lighting, no current snow plowing is planned.
121 C. Weir: There are no retaining walls; cuts and fill only, rip rap slope in areas matching site as much as possible.
122 Grade will be similar to residences on dimensional plan. Eight parking spaces are in front of building; 50 ft. wide
123 natural vegetation buffer to remain in place; single light fixture located on neighborhood side of building to be full
124 cut-off fixture. Agreed to include stockade fence along property line as a sound and visual barrier.
125 J. Enright: Stormwater will be signed off on prior to the next meeting and a draft decision will be prepared.
