32 and Site Plan Review Special Permit under Chapter 195 Article 4 Part 5, Section 195-8, and Section 195-10.7 of
33 the Town of North Andover Zoning Bylaw to authorize the phased redevelopment and reconstruction of certain
34 existing developed areas of the Property, including relocation of the South Entrance,removal and reconstruction
35 of buildings, access ways and landscape areas, improvements and installation of new drainage improvements and
36 associated landscaping. The majority of the proposed work is within the General Zone with a small portion of
37 reconstruction of walks,parking and landscaping on the outer edge of the Non-Disturbance and Non-Discharge
38 Zones. The project is located in the Residential 1 (R-l)Zone.
39 J. Enright: Stormwater and Department review is complete; two draft decisions have been prepared. (K. Cormier
40 will be a voting member for this application in place of K. Bargnesi who has recused herself). A Common
41 Driveway Special permit is required and has been applied for. The hearing will open October 6,2020, The
42 decisions before you condition the Common Driveway Special Permit be approved and recorded prior to any site
43 work or building permit commencement. Since the Iast meeting, P. Boynton requested information related to the
44 hydrant map presented. There is a hydrant near the shoreline and a pipe that extends into the Lake which was not
45 referenced on the map.

67 Permit under Article 8 Part 3 and Article 10§ 195-10.7 of the North Andover Zoning Bylaw, The Applicant
68 proposes construction of a 15,100 SF single-story metal building with associated parking, landscaping, utilities
69 and stornnwater management design. The primary use is a proposed office to serve the Applicant's construction
70 company and the accessory uses are indoor storage for equipment and vehicles as well as an outdoor gravel
71 laydown area also to serve the construction company. The property is located in the Industrial-1 Zoning District.
72 J. Enright: Stormwater and Department review is complete; a draft decision has been prepared. An updated
73 grading plan has been submitted which includes a 6' stockade fence to the rear of the property.No rooftop
74 mechanical equipment is anticipated.No public comment has been submitted on this project.
75 J. Simons: Does the grading plan address all possibilities based on the slope of the property?
76 J.J. Enright: Erosion escaped the lot to a wetland in the early nineties;the lot has remained undeveloped since that
77 time. A detention basin was constructed on property. Peer review approved the plan;the draft decision conditions
78 that if the Planner feels the installed erosion control is not sufficient more will be added at the Planner's discretion.
79 There is a 50' ft. tree buffer to the rear of the property.

90 335 Willow Street,Muffin 3X,LLC c/o Michael Ogan: Application for a Site Plan Review Special Permit
91 under Article 8 Part 3 and Article 10 § 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes
92 construction of two building additions totaling 8,708 SF with associated parking, landscaping, utilities and
93 stormwater management design. The primary use proposed is manufacturing and warehouse. The property is
94 located in the Industrial-1 Zoning District.
95 J. Enright: This hearing was opened with no evidence heard at the prior meeting. Bake `n Joy(351 Willow St.) is
96 expanding operations to 335 Willow Street. On February 17, 2015 351 Willow St. was granted approval for a Site
97 Plan Review Special .Permit to allow for the construction of an 11,168 sf addition, new parking area, new
98 stornwater management system, partial removal of an existing berm to the rear of the building and a 35%
99 reduction in required parking. This permit is still under construction and is not yet closed out. We have received
100 comment from the NAPD regarding existing on-street parking. In addition, a commercial abutter submitted
101 comments related to a safety concern given the existing on-street parking and tractor trailer access/egress.
102 Department review includes DPW, Police and Fire. An NOI has been submitted to Conservation. Horsley Witten
103 submitted their first round of review comments; additional information was received this evening; however,that
104 information has not yet been reviewed and is not included in the Board's packet.

106 John Morin, Morin Cameron Group,Applicant: The proposed project includes the construction of two additions
107 (north/south sides of existing building)totaling approx. 8,700 sf. Addressed parking comments regarding 351
108 Willow St. The as-built is in progress and will be submitted shortly. Bake `n Joy(351 Willow St.)purchased part
109 of the cul-de-sac. Employees tend to park in the street; there are spaces available within the parking lot.
110 Employees have been instructed to utilize those parking spaces. The use at(335 Willow St.)meets the parking
III requirements for manufacturing and warehouse.No additional pavement needs to be added, one section of the lot
112 is to be restriped in order to get the amount of spaces required under the zoning bylaw. We are reducing
113 impervious surface by removing 350 sf of pavement(within the 100 ft. buffer zone to the wetland)replacing with
114 landscaping. A third of the proposed addition is within the existing parking lot but does not interfere with the
115 required parking. Proposed increase in impervious surface is roof, propose an underground infiltration system and
116 plan to fix the rip rap spillway on the southerly side of the parking lot. This building was built in I985, an addition
117 was added in 1991.A Certificate of Compliance was issued.
118 Michael Ogan, President& CEO, Bake `n Joy: A portion of manufacturing is moving from 351 Willow to a larger
119 space in this building.Number of employees remains the same.New building to accommodate freezer space, dry
120 warehouse, small office area with cafeteria, offices, locker rooms and conference roam. Refrigerated trucks will
121 move product and materials in and out of the building; there is some rooftop mechanical equipment proposed for
122 the addition however there will be equipment on the ground as well.
123 J. Morin: Explained rooftop equipment location as being away from residences.
124 Michael Ogan: Described long term relationship family business has had over the years with local abutters in
125 North Andover&Andover.No distribution out of 351 or 335 Willow St. facilities; Ayer, MA&NH only. This is
126 our third facility oil Willow Street in North Andover,MA.
127 J. Morin:No additional light poles are being considered. light emissions are being reduce from existing level. We
128 have presented to Conservation; at that time they had no major comments or concerns.
129 J. Enright: Emphasized Town's positive relationship with Bake `n Joy over the years; historically, an abutter from
130 Kathleen Drive(Andover) has had prior concerns. Recently, there was a noise complaint made to our Health

137 Notice of Decision Sub-district A Definitive Master Plan Special Permit dated February 25, 2020, Applicant
138 proposes a reduction in onsite parking spaces (remaining compliant with zoning bylaw requirements), reduction in
139 pavement, and a reduction in lineal feet of wall.
140 David Gillespie,Avalonl3ay Communities& Phil Henry, PE Civil Design Group: Currently permitted 170 units
141 (reduced from 200)and are requesting to reduce 49 parking spaces, creating opportunities for landscape.
142 Reviewed site layout. Proposed vegetated slope(along southerly end near Sutton Pond)replaces a 7-8 ft. retaining
143 wall. Adjusted main access drive switching the sidewalk from the Building A side to the cast side of the main
144 entrance, allows for creation of more vegetation along the building. Radial access introduced in front of Building
145 A that ties into the main access drive for better site circulation.NAFD has deemed this satisfactory; Horsley
146 Witten responded positively. Clarified that proposed impervious is now less than the approved impervious with
147 the reduction in parking spaces. It's a reduction of the approved plan, and an increase over the existing condition.
148 J. Enright: Confirmed with the Building Commissioner who stated the parking still complies with zoning.NAFD
149 confirmed the swept path analysis is still sufficient for fire apparatus. Conservation considers this a minor
150 modification-not requiring notification. Clarified 296 parking spaces are proposed(of which 103 spaces are shared
151 spaces).

160 Considered major renovation of existing site and pursuit of a Master Plan. Site requires great deal of attention; life
161 safety issues, ADA compliance, energy conservation codes, rewiring necessary for entire site,asbestos abatement,
162 etc. Renovation not feasible, significantly disruptive and cost prohibitive. Renovation would not allow us to
163 accommodate Merrimack College. Currently,there are 588 multifamily housing units and over 55 structures on
164 site. Intend to include mixed-use, high end retail spaces, 102 room boutique hotel,open dining space, office spaces
165 and range of residential spaces. Goal is to preserve primary green space. Reviewed elements of new 2 acre"town
166 green space"organizing site entry, maintain wooded buffer around property(100-130 ft. buffer from property line
167 to structure)and preserve wetlands around perimeter. Vision for town green space-pedestrian oriented,
168 surrounded by buildings on three sides,variety of uses and populations; activated into Iate evening. Mature trees to
169 be maintained. Existing wetlands to be modified and preserved; improvements to existing drainage will be made.
170 Recreational walking path considered around site. Focus on uses toward Rte.114 and Merrimack College.
171 Merrimack students to be provided new"student village"controlled by Merrimack College. Provide for 385
172 multifamily, mixed income housing units with an affordable component. 608 market rate multi-family units(to
173 replace the current 588 units). Reducing arnount of larger multi- family units; proposed units are studio and one-

179 traffic. (Currently 1,100 cars on site) Two new signalized intersections on Rte. 114. Briefly reviewed building
180 architectural styles and elements. Outlined benefits project will offer. Considering a friendly Chapter 40B process
181 or Chapter 40R that would help the town exceed its 40B threshold. Substantial tax increase to the town. Parking
182 would be in form of structured parking garages attached to plan elements.
183 Project Attorripy, Peter Tam: Informed the Board this is a large, impactful project that will improve and change
184 this site dramatically for the better. Time&collaboration will be needed to review: parking, height, densities,
185 floor/area ratios(FAR), peer review for storm-water management and traffic. Large phased Master Plan
186 redevelopment requires a zoning change, likely a map change and require a development agreement including
187 other protections outside of zoning: phasing, construction sequence, timing related to addressing the Town's
188 shortfall on the town's subsidized housing inventory through a multifamily component which is to be nearly all
189 rental and 25%affordable.Nearly 400 units will count toward the town's inventory helping to exceed the
190 affordable requirement well beyond the 2020 census. Requests individual sessions with the Planning Board to
191 address various components of the project prior to a recommendation at Town Meeting.
192 E. Goldberg: Encouraged Board members to be heard. Board requests facts: proposed numbers of units, FAR
193 numbers related to proposal, building heights, existing density v. proposed, square footages and footprints, impact
194 on schools, neighbors & buffering, fiscal impact,tax information, effect on property values.
195 J.J. Enright: Suggested ample public engagement. Significant re-zoning effort is required. Suggested establishing a
196 working group with 2 Planning Board member to start to discuss what type of zoning would be appropriate.
197 E.Goldberg: Polled the Planning Board for working group members; J. Simons and A. Preston expressed interest.
198 J.Enright: An abutter comment was just received from Joe Robinson, 71 Quail Run,questioning the Significant
199 range of tax increase the Town can expect to see; base and increase. This information will be brought before the
200 Board when the petitioners appear again and it will be included in the required fiscal impact analysis.

233 J. Enright: Applicants for Lots A &B have submitted an application for a modification to their recently approved
234 Special Permits. They are continuing to work with MassDOT; an access permit is not expected for several more
235 months. MassDOT has provided preliminary information as to what they require;mitigation letter is included in
236 your packets. This information resulted in the need to modify their special permits. Modifications include changes
237 to stormwater design and traffic circulation. We are awaiting responses from Horsley Witten (stormwater review)
238 and TEC (traffic review). A modification application has been filed with the Conservation Commission,
239 Stormwater, Traffic and Fire Department reviews are ongoing.
240 J. Sniolak: For efficiency,we are consolidating discussion of both hearings into a single discussion. Requesting
241 modifications to the Site Plan Review Special Permit for Lots A& B(approved 5/20/20)The modifications are
242 driven by MassDOT's mitigation letter. Reviewed PowerPoint presentation provided to Board. As a result of the
243 proposed modifications,the ANR lots(approved in June)are being slightly adjusted shifting 9,700 sf from Lot B
244 to Lot A.
