Conservation Conditions of Approval,NACC#263
Pursuant to section 4.4.2(B) of the North Andover Wetlands Protection Regulations,Martin Allen,
applicant/homeowner,filed for a Small Project Permit for worts proposed at 155 Boston Street, j
North Andover. Work involves in-bind (same footprint) deck replacement at 8'.5"x 15'with stairs
within 100-Foot Buffer Zone to Bordering Vegetated.Wetland (BV ). The deck is 76 feet from the
BVW at its closest point. i
During the October 14,2020 public meeting,the North Andover Conservation Comnriission voted
unanimously to approve this as a Small Project Category"B".Tle project is approved only as it
relates to the Conservation Comn-nission and any and(if applicable) all other approvals should be
obtained by the applicant/home owner.The applicant is responsible for determining property
boundaries.All worts shall conform to the fallowing.

,General Requirements-Wetland Protection Regulations:
d S ion 1.4-The applicant has read and.understands the applicable Small Project Procedures.
The applicant maintains that the project falls within the small project category below and activities and/or
structures are located outside the 25-foot NDZ,50-foot NBZ and 75-foot NBZ Ephemeral Pool.
A. Open slotted decks,without roofs,equal to or less than 300 square feet surface area,inclusive of
stairs and ramps,which are to be attached to an existing home,where soil disruption during
construction is limited to less than 50 square feet,and where no permanent soil alterations are
lanned under the footprint of the deck
B.In kind replacement of lawfully existing decks,regardless of size. l

C.Sheds or other outbuildings of less than 100 square feet,which are to be placed on footings,not
permanent foundations.
El D.Sewer system connections as required by the Town of North Andover.
❑ F.Unpaved pedestrian walkways (less than four(4)feet wide)for private use or for public access on
conservation property.
❑ R Patios less than 300 square feet,not requiring excavation or grading.

❑ G.Pruning of existing vegetation,planting of new native vegetation and gardening.

Two (2) copies (and an electronic copy when possible) of a I" =20' scale (or other as deemed appropriate by the
Conservation Commission or agent thereof) drawing showing existing and proposed conditions and the
delineated wetland resource areas (see plan requirements below for additional detail)..
El A pre-construction/pre-approval meeting was held on site between,the applicant and a representative of the
Conservation Commission. Date of Meeting:
❑ The delineated resource area boundaries have been confirmed by the Conservation Department as accurate.
Plait Requirements (Section 4,4.3 BJ.-
Certified and/or professionally prepared plans are not required. However,the North Andover Conservation
Commission or its designated agent shall have the final authority to determine whether the submitted
plans/drawings are adequate and include all pertinent information for review.
At a minimum,all plans submitted shall clearly and accurately show the present conditions and proposed work
and depict the location of all wetland resource areas within 100' of the proposed work. All plans must be signed
and dated by the person who prepared them.
The Commission I may also require the following information on the proposed plans in addition to the
aforeznentionelcjfitena where...applicable:
F1 Location of any subsurface sewage disposal systems.
El Locations of any drainage structures.
El Locations of any easements,including but not limited to, drainage and utility easements.
El Locations of any open space boundaries if(e.g.if the lot is affected by the 50' open space boundary as required
in a Planned Residential Development(PRD)),
El Location and nature of all proposed alterations to the Buffer Zone Resource Area.

COMPLETE APPLICATION-The application meets he submittal requirements. Therefore, the Conservation
Department has prepared a written list of conditions necessary to protect an-iy adjacent wetlands for approval by
the Conservation Commission.
This condition list shall be filed with the North Andover Conservation Department as NACC#
❑ INCOMPLETE APPLICATION-The following sections of the Wetland Protection Bylaw&/or Regulations
have not been complied with and as a result this Department is rejecting this incomplete application w/in two
(2) business days from the date of receipt (Section 178.4 North Andover Wetland Protection Bylaw), You may
pick up this application and supporting plans at the Conservation Office and re-file with the required
supporting documents and information.
NOT A SMALL PROJECT-The North Andover Conservation Commission has determined that the proposed
project as submitted does not meet the small project criteria and hereby denies the application. As such,a
Request for Determination of Applicability(RDA) or a Notice of Intent(NOT)must be filed.

To whom it concerns,
We are applying to the No Andover Conservation Dept to permission to remove the old
deck at the N/E gable end of our home at the above address. This deck will be replaced
with a similar, stronger deck allowing access and egress to the main door of the
property.
The old deck is still in position at this time. We anticipate not having to replace the
footings, however, that can only be determined when the old deck has been dismantled
and removed.
Depending on the upcoming weather the availability of my contractor, we anticipate
starting the projects as soon as all required permits have been secured.
