Pursuant to section 4.4.2 (B) of the North Andover Wetlands Protection Regulations,Michael
Luzzo,applicant/homeowner, filed for a Small Project Permit for work proposed at 5 Stonewedge
Circle, North Andover. "'fork involves in-kind replacement of existing deck and stairs, totaling 260
square feet. Existing footings will be maintained,no soil disturbance proposed. Construction debris
to be removed from site daily,rate materials stored in driveway. The deck is located within 100-
Foot Buffer Zone to Bordering Vegetated Wetland (BVW). The site was subject to an OOC, 42-
990, for the construction of the subdivision roadway and associated lots. The 2003 as-built plan
shows the same footprint and location of deck and stairs outside the 50' NBZ. Therefore this is a
lawfully existing deck.The 2016 wetland delineation on the Small Project Permit plan shows a slight
shift from the 2003 as-built plan thus shifting the 50"NBZ. The applicant requested permission to
replace 2-3 totted post and rail fence posts. The Commission conditioned this work below.
During the November 18,2020 public meeting, the North Andover Conservation Commission
voted unanimously to approve this as a Small Project Category"B" (in-kind deck replacement) and
Category "L" (tap to 3 fence post replacement). The project is approved only as it relates to the
Conservation Comi-nission and any and (if applicable) all other approvals should be obtained by the
applicant/home owner. 1'he applicant is responsible for determining property boundaries. All work
shall conform to the following:

The following conditions are hereby mandated:

1. Prior to the start of construction the applicant shall ensure that the site contractor has reviewed j
the small project pertnit and is aware of the wetland resource area and the limits of the proposed
work.

2. The Conset-nation Con-unission voted to allow the in-bind replacement of not more than 3 fence
posts outside the 25-Foot No Disturb Zone.
3. A post construction site inspection shall be scheduled with the Conservation Department to
Verify compliance with this approval.
4. 'Il-iis permit shall expire one year from the date of issuance.

planned under the footprint of the deck

El C.Sheds or other outbuildings of less than 1.00 square feet,which are to be placed on footings,not
permanent foundations.

conservation property.

identified and clearly marked in the field.

Conservation Commission or agent thereof)drawing showing existing and proposed conditions and the
delineated wetland resource areas(see plan requirements below for additional detail).

and depict the location of all wetland resource areas within 100'of the proposed work. All plans must be signed
.and dated by the person who prepared them.
The Commission rnay also require the following information on the proposed plans in addition to the
aforementioned criteria where applicable:
F1 Location of any subsurface sewage disposal systems.
El Locations of any drainage structures.
El Locations of any easements,including but not limited to,drainage and utility easements.
Locations of any open space boundaries if(e.g,if the lot is affected by the 50'open space boundary as required
in a Planned Residential Development(PRD)).
Location and nature of all proposed alterations to the Buffer Zone Resource Area.

Subject: Scope of Work for In-Kind Replacement of Decking, Railing, and Stairs
This memo details our request to improve the residential property at 5 Stonewedge Circle
in North Andover. This property abuts a designated wetland. No proposed activities are
within the established 2,5 foot wetlands buffer area. We are requesting authorization to
replace the existing deck in the rear of the home.
The proposed activities would entail the removal, of the existing decking, railing and stairs.
The existing post and footings will be reused. No digging or disturbance of the topsoil will
be performed under this scope of work. Construction debris will be removed from the site
daily. Raw materials will be stored on the asphalt driveway prior to installation. No work
will be performed during wet conditions. The total project time is expected to be 4-5 days.
