HISTORY AND BACKGROUND On November 11 2020, the applicant requested a waiver of the Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw Article 4 Section 195-4.24. Waiver of Special Permit, so as to allow the conversion of a portion of the existing deck to patio, expansion of the existing deck, relocation of an existing fence, and the construction of a koi pond with associated fieldstone walls. The majority of the proposed work is located within the325-FT Non-Discharge zone and is allowed under the Bylaw;however,a portion of the proposed work is also located within the 100-FT Non-Disturbance zone. Work proposed within the 100-FT Non- Disturbance zone includes the construction of approximately 30 LF of fieldstone wall associated with the proposed koi pond,relocation of an existing fence,construction of a stone paver walkway, and planting beds. All of the proposed work is occurring within currently maintained laws areas. Documents and plans are attached indicating the extent of the proposed work, potential construction materials,and erosion control measures to be implemented during construction. DECISION After a Planning Board meeting on the above date, and upon a motion by Peter Boynton and.2nd Aaron Preston,a vote was taken with regard to a waiver of the Watershed Special Permit.The vote was 5-0, unanimous in favor of the waiver. FINDING OF FACT The Planning Board has made its decision based on the following findings: • The Plans depict proper erosion control barriers. • The applicant will file a Notice of Intent with the Conservation Commission. • The deed to the property restricts the use of pesticides,fertilizers,and chemical in lawn care or maintenance.
