Re: Variance Application for 20 Foxhill Road
Dear Chairperson Koch and Zoning Board of Appeals Members,
I represent Michael Scully in connection with.the enclosed variance application. I write this letter
to set forth the reasons why the Zoning Board of Appeals ("Board") should grant Mr. Scully's
requested variance.
Mr. Scully and his wife, Erin(collectively, the "Scullys"), have owned and lived in their single-
family home ("Scully Home") at 20 Foxhill Road ("Scully Property") for ten years. However, the
Scullys have now reached the difficult realization that their future needs will not be met by the
current layout of the Scully Home. Mr. Scully therefore seeks to make a relatively small but
necessary expansion to the Scully Home.
Mr. Scully submits the attached variance application because his proposed expansion to the
Scully Home Would place the home in minor noncompliance with the side-yard setback
requirement of the Town of North Andover ("Town") Zoning Bylaw ("Bylaw"). Specifically, §
195-7.3 of the Bylaw, in part, requires the Scully Home, situated solely in the Residence 2
District, to maintain two 3)0-foot side yard setbacks. However, Mr. Scully's proposed expansion
to the Scully Home would reduce one of its side yard setbacks from 31.6 1.6 feet to 16.8 feet.

I. The Scully Home Would Continue its Zoning Compliant Use
The Scully Home is currently used as a single-family home, which is the primary use permitted in
single-family
the Residence 2 District under § 195-4.2 of the Bylaw. Mr. Scully's proposed extension would
not in any way alter said use of the Scully Home solely as a single-family home.
H. Owing to Special Circumstances on the Scully Property Relating to its Shape, the
Scullys Would Experience Substantial Hardship Without the Requested
Variance
While the Scullys' future needs require the Scully Home be expanded, the Scully Property is
unusually narrow, comprising lot area and road frontage less than the current dimensional
requirements of the Residence 2 District. The narrowness of the Scully Property directly prevents
the Scullys from expanding their long-held home to meet their needs while remaining compliant
with the side yard setback provision under § 195-7.3) of the Bylaw. As such, the narrowness of the
Scully Property creates a substantial hardship which supports the Board's approval of the
requested variance. See Gale v. Movalli, 18 LCR 330,)0, 333 (Mass. Land Ct. 2010).
III. Mr. Scully's Proposed Project Accords with Both the Public Good and the Bylaw
The expansion of the Scully Home by a length of less than five yards cannot reasonably be
argued to present a genuine risk of detriment to the public good. Indeed,
Mr. Scully has spoken to
his direct abutters and expects to receive abutter support for his variance application. As such,
Mr. Scully's proposed expansion of the Scully Home would not be at all detrimental to the public
good, and therefore would certainly not be substantially detrimental to the same.

Likewise, Mr. Scully's proposed prQject would not nullify or substantially derogate from the
intent or purpose of§ 195-7.3 of the Bylaw. First, the proposed expansion of the Scully Home
would not cause the home to become noncompliant with the § 195-7.3 front and rear yard setback
requirements. Additionally, the proposed expansion of the Scully Home would not cause the
Home to become noncompliant as to one of its two side yard setbacks. Indeed, only one of the
four setback requirements imposed by § 195-7.3 would be made non-compliant, by less than a
length of five yards, with the proposed expansion of the Scully Home,
Side yard setbacks generally exist to protect safety, privacy, and aesthetics. See McDonnell v.
Zoning Bd. of Appeals, 15 LCR 248, 251 (Mass. [-and Ct. 2007). Where Mr. Scully proposes a
minor expansion to the Scully Horne, and where Mr. Scully expects to receive abutter support for
such request, it cannot be argued there are any reasonable concerns regarding decreased safety,

privacy, or aesthetics. As such. § 195-7.3's purpose and intent_Would still be achieved if the

Board approved Mr. Scully's requested variance from strict application of the same. Also, ample
access to the rear yard of the Scully Property is preserved and the proposed addition is designed
to retain privacy along the affected lot line and not negatively impact the adjacent property
owner.
