So i ets to allow the construction of 1,407 sq. ft. blue stone patio, the extension of a gas line from an
existing dwelling unit to fire,pit area and cooking area,the extension of a gravel driveway by 955 sq. fl.in
the Non-Disturbance Zone and 1372 sq. ft. in the Non-Discharge Zone and the installation of two
drywells for roof runoff, Within the Non,Disturbaftce and Non-Discharge Zone of the Watershed
Proteotion District.
After a Public Flouing given on the above date, and vpon a motion by R. Rowen and 2*4 by D.Kellogg to
APPILOV9 the Sp"I'al Permit for the Watershed Protection District as ainended and based upon the

The Public Hearing on the above referenced a plloation was opened on September 3,2013 and closed by
the North Andover Plarentng Board on September 3,2013,
On September 3, 2013, upon a motion rude by X and seconded by X to GRANT a Watershed Special
Permit to allow the construct ion of 1,407 sq.f ,blue stone patio,the extension ofgas ltne from all 0Xj$tjVg
dwelling unit to fire pit area and cooking area, the extension of a gravel driveway by 855 s . ft, in the
Non-Disturbance Zone and I 2 s . ft.. in the Non- lsobarge Zone and the installation of two drywells
for rood' runoff, within the Mon-Disturbance and Non-Disoharge Zone of the watershed Protection
District, Thig Special Pennit.was 'quested by Kovin McLellan, 158 Dale Street, North Andover, MA
01845 on+July 18, 2013. The applicant submitted a complete application, which was noticed and
reviewed in accordance with Section 10.52 of the Town of No h Andover Zoning Bylaw and MUL
Chapter 40A, Section 9. The motion to approve was Subjeot to the FINDINGS OF FACTS and SPECIAL
N MONS set forthin this decision.
The Flauxiing Board vote was unauhnous. A special permit issued by the special permit granting
authority requires a vote of at least four members of a five-member board.
The applicant is hereby notified that should the ap li a t disagree with this decision, the applicant has the
right, under MGL Chapter A, Section 17, to appeal this decision within twenty days after the date this
deolsion has been filed with the Town Clerk.
In accordance with 4.136 the Planning Board makes the finding that the intent of the Bylaw, a well as its

plan is provided,showing the location of the new patio and expanded driveway. This bead shall
