Special Meeting & Bear~
The Board of Appeals held a specialmoeting o~ Monday evening, January 20, 1964
at 7:30 P.M. in the Tc~n Building. The members present and voting were= Daniel T.
O'Leary, Chairman; William ~orton, Secretary; Arthur l~,a ~_~d John J. Shields;
and Assoc. ~ Rober~ J. Burke who sat in place of Henry Lund.
HEARING: Frederick Phelan:
This is the hearing that was ~etponed from Jan~-~y 13,1964. Secretary Morton read
the legal notice in the appeal of Frederick W. Fhelan who requeeted a variation of
Sec. 6, Para. 6.31 of the Zoning By-Laws so as to permit the division of a parcel of
land into two lots, as per attached plan, on the premises located at the south side
of Prospect Street, 400 feet distant from the corner of Furher Avenue, kno~ as
#48 Prospect Street.
Atty. Donald F. Smith rep~e~ sented the petitioner. Mr. Phelan and his sea-in-law ~ere
present. Three other people were present.
Atty. Smith presented the plans to the Board and expl-~-ad that Mr. Phelan purchased
lots 152 & 153 and the house on it on Prospect St. In 1954, Mr. Phelan purchased
through tax sale, lots 150 & 151. He is now asking to combine lots 150 & 151 into
one lot and lots 152 & 153 into another lot. Both lots are ap/n~mx, the sa~e sise.
Ail lots in that area are 45-f~. lots and have homes on them. These 9C-ft. lots
would not derogate fx~za the area. Another ho~e would be ~,~lt on lots 150 & 151.
It would be a hardship to the petitioner, if this variance were not granted. He
wishes to ~,,~ld a ho~e for his son-in-law.
Mr. Tim. Murph~ was recorded in favor.
Mr. Wallace Nickersen Just questioned the number of feet frontage. Mr. Luang wanted
to know where the house wou2d be Built. Mr. Nickerson spoke about ho~es in that area
and on Moody St. being buAlt on 100 ft. or more lots. They l~,*lt secure with the
protection of the By-laws. If they continue with this type of t~-~, everyone else
could do At. He has no objection to a reduction of 10 feet.
Mr. Shields asked if lots 150 & 151 have gone through Land Court.
Atty. SmA%h said they are in that procedure now.
Mr. Phalan said the house is to be built 1~ feet from the side limes.
Mr. Morton made a motion to take the petition under advisement. Mr. Dru~ond
seconded the motion and the vote ~s unanimous. The petitioner is to have a block
for signatures put on the plans and also show the acreage.
DECISION:
Frederick W. Phelan:
Mr. Morton made a motion to GRANT the variance. Mr. Shields seconded the motion and
the v~te was u~=~ous. The four reasons for granting apply.
The Board ~embere signed plans and decisicas f~ the week' s previous hearings.
The Board discussed whether plans fore. Special Pers~ts should have a block for
signatures and it wes decided that ~t ~s not neg~s~y~ ~
The. Board of Appeals held their regular meeting on F~m~lay evening, Feb. 10, 1964
at 7:30 P.M. in the Town B,,~lding. The following members were present and voting.*

Shields.
The members present aigmed the Phelan plans and deoision. The other members
be contacted in order to sign the plans.
The Board discussed whether or not to Join the Mass. Federation of I~---~ug Boards
again this year. The dues for the year are $15.00. They deoided not to Join this
year since this Board did not get much benefit fr~m the Federation.
