HomeMy WebLinkAbout1964-03-09Monday- March 9, 196~ Regular M~eting & Hearing The Board of Appeals held theAr regular meeting on Monday evening, March 9, 1964 at 7:30 P.~. in the Town Building. Tho following ~embers were present and votings Daniel T. O'Leary, Chairman; William Morton, Secretary; Art~mr Dmm~_ond, Henry E. Lund and Associate Member Alfred Boegltn, who sat in place of Joha J.' Shields. BEAP~NG: 7:30 P.M. Barry R. Dow, III: Secretary Morton read the legal notice in tho appeal of Barry R. Dow, III, ~t al, who requested a variation of Sec. 7, Para. 7.3 of the Zoning By-Law so as to per, it tho erection of an office and warehouse for electrical contractor, on tho prem~ees, located at the south side of School Street, approx. 400 feet distant from tho corner of Main St. and known as ~26-28 ~chool Street. Mr. Dow, Stewart Wilson and Vincent Landers were present. There were no abutters present. Mr. Wilson presented the plans to the Board and said it appears that new plans have to be submitted as was discussed before the meeting. Mr. Morton explained that there have to be 35 feet in tho back of tho Mr. Wilson asked what is tho closest they can come to the other lines without any objection. Mr. O'Leary.said to leave the front as it is. Mr. Lund said they can do s~methingon the front and side lines but can offer no relief on the back line. Mr. Wilson asked if they can go to 10 feet on each side. Mr. Landers, who is the electrician th~s hoaring is being held for, asked if it was all right if the Board gave them 5 feet and thoy dacided to change it to 15 feet. Mr. Lurid said a 25 ft. side line is required in a business zone, which can be varied, but the hack is always mandatory. ~r. Landers said Finneran' s is on the lot ~ne and the house is 7 feet hack. Mr. Wilson asked how close they could cone to tho apar~aent house. Mr. Lund said he doesntt think they should cce~ any closerthanthol5feet. On Robert's Hardware, the Fire Chief ruled the distance ~ all right as long as it wes fireproof construction. Mr. O'Leawy said that's what we said on that, we approved it subject to Fire Chief's approval. Mr. Wilson said if the Fire Chief ~ approve 10 feet, will you people approve 10 feet? Mr. O'Leary asked the othor members what they thought about having 10 feet c~ each aide. The other members agreed. The building should have cement block - fireproof coustruction, subject to the Fire Chiefts approval. 44 March 9, 1°~/. - Cont. Mr. Morton made a motion to GRANT the variance subject to the submission of proper plans and to the approval of the Fire F.~mineer. Mr. Dram, cad seconded the motion and the vote was Mr. Wilson said they ~r~ll submit new plans with the new ~ensione. He explained that the building is go~h8 to be used to store the electricians own supplies; that it is not actually a warehouse. The new plans will show that the front of the building is to be in line with other structure in the area. Ten feet are to be allowed on side yard spaces and the rear yard is to contain the required 35 feet. OLENI0: Mr, Dan 01chic appeared before the Board and asked what would he required to make a tract of land in an Industrial area into a recreation=! golf area. This land is o~ned by ~n~ggebauer. Mr. Lund questioned whether this Board can give recreational rights in an Industrial area. There are alot of things that aren't in the By-Laws at all - we don't know what we can do on some things. Mr. O'Lenio said this is a variation from the requirements. Mr. Lund said if we put something in that shouldnlt be there, we are c~-~ging the zoning. Mr. O'Lanio said ha could fix up that field and use it for himself and his fr4-mds, that~ s the only ~ay to do anything around here. STEInbeRG: Mr. Albert Steinberg appeared before the Board and ahked if the Board had any copies of his plans sho~ septic tank m~kings. Mr. O'Leary and Mr. Morton said we wouldult have an~tb~8 to do with that - thatls the Board of Health, we wouldn't have anything here. Then he asked about removing fill and what the Board requires of B*-, Mr. O'Leary said he would have to coma before the Board for a hearing. He then explained to the other members about requesting the DelDuca Co. to put up a chain fence because the neighbors in the area complained about parkers. A letter was re- ceived from Atty. Trombly saying the chain had been put up. The Board signed a b~ll for Anna Donahue for $40.00. The meeting adjourned at 8:45 P.M. Ohairma~ Clerk
