Goldberg: Confirmed lot size and stated that two lots without square footage is not an issue. Does not believe 15 the Board can endorse a Plan that has insufficient frontage. 16 T.Zalior it o: Was directed to go to the Planning Board first but understands that both boards are involved. 17 M. Gregoire: If lie appeared before Zoning first,they would be granting variances on lots that don't exist. We had him identify the lots as non-buildable, even though they both have buildings on theta right now. If you endoi-se {19 this plan you are endorsing the plan as ""non-buildable."The plans must front on a public way, must sleet frontage 20 requirements and have vital access. 21 M. rre oil• : One Board is not obligated to honor the decision of another. The Applicant was sent a copy of the 22 ANR Handbook and several eases related to this issue. 23 T. horui o. I would not record a Plan until all applicable boards decisions were jade. You wouldn't want to 24 record a plan that jeopardizes the legitimacy of the existing lot. 25 E. Goldberg: The Board can endorse an AND.with zoning deficiencies, if so noted on the Flan and these would 26 not be considered lots because it is taking one lot, dividing it into two and neither is buildable. Technically,these 27 are not lots until you get approval from the ZBA. Based on that,I think we can approve the endorsement. 2 Board: Discussed potential AN , on a public way, frontage is inadequate, it's not a subdivision; decided they 29 cannot approve the plan without the endorsement of the Zoning Board. 30 MOTION: J. Weighed in 4 on whether a waiver or permit was necessary deciding that the application was substantive. A two year terns limit 45 should be placed on the waiver, 46 MOTION: P.
