Town of North Andover Site Plan Special Permit 384 Osgood/Public Works Building July 5,2016 The Planning Board herein APPROVES the construction of a 7,100 SF administration/office building, thirty one (3 1) parking spaces, the demolition and construction of an 8,000 SF salt shed and stormwater management,landscaping,lighting and utilities in the Residential-4 Zoning District. This Special Permit was requested by the Town of North Andover. The application was filed with the Planning Board on May 6, 2016. The public hearing on the above referenced application was opened on June 7,2016,and closed by the North Andover Planning Board on July 5,2016, The Applicant submitted a complete application,which was noticed and reviewed in accordance with Section 8.3, 10.3,and 10.31 of the Town of North Andover Zoning Bylaw and MGL c.40A,Sec. 9. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3: FINDINGS OF FACT: 1) On June 17, 1974 the North Andover Zoning Board of Appeals voted in favor to Grant a Special Permit to construct a new Municipal Garage and Office Facility under Section 4.122 (10) of the Zoning Bylaw and as shown in Table 1, "Summary of Use Regulations"in the R-4 Zoning District. 2) The North Andover Zoning Board of Appeals is reviewing the application for a Variance for the proposed administratior/office building for side setback, from Table 2, "Summary of Dimensional Requirements". The required dimension. is 20'. Side setback (left) of 16.8 feet is requested (relief is 3.2 feet) in the R-4 Zoning District. In addition, the Zoning Board of Appeals is reviewing a Variance for the proposed salt shed for side setback, from Table 2, "Summary of Dimensional Requirements". The required dimension is 20'. Side setback(left) of 10.4 feet is requested (relief is 9.6 feet) in the R-4 Zoning District. 3) The Salt Shed is being proposed as an Alternate Bid(Ad. Alt.)to the Project. An Alternative Bid is a bid that can be added or deducted by an owner if the defined changes are made to the plans or specifications of the base bid. The Applicant at the July 5, 2016 meeting stated that the Town will be pursuing both the Base Bid and the Alternate Bid. 4) Filed a Notice of Intent on May 27, 2016 with the Conservation Commission and the Massachusetts Department of Environmental Protection(MassDEP). 5) Existing parking conditions consist of twenty one(2 1)parking spaces in the front parking lot. 6) Per the Zoning Bylaw Section 8.4. (a) the Inspector of Buildings has determined twenty one (21) spaces are required for the 7,100 SF office/administration structure. The existing 22,960 SF structure has been determined as a "municipal garage" which requires six (6) parking spaces. The proposed 8,000 SF salt shed was determined by the Inspector of Buildings to not require parking spaces. The total required spaces for the site is twenty seven (27). Additionally, per 521 CMR Architectural Access Board section 23.2.1 (total number of parking spaces 26-50)requires two (2)handicap spaces of which one is required to be Van Accessible (521 CMR 23.2.2). (See memo from the Inspector of Buildings dated July 1, 2016). 7) The Applicant has provided a parking plan that provides ten (10) spaces in the front of the building, two (2) of which are handicap accessible, three (3) to the side of the existing building, and eighteen (18) spaces in the rear of the existing building accounting for thirty one(3 1) spaces for the facility. 8) The specific site is an appropriate location for such a use and the use as developed will not adversely 2 Town of North Andover Site Plan Special Permit—384 Osgood/Public Works Building July 5,2016 affect the neighborhood. 9) Based on input received from the Planning Board,the Town Engineer, and the Planning Board's consultant,Eggleston Environmental,the Applicant has provided sufficient stormwater management facilities to mitigate flow of stormwater: i. The options available for the site to reach full compliance with Stormwater Standards 4, 5 &6 are limited by the soils, groundwater conditions and topography at the site. The incorporation of LID measures such as a Rain Garden are not possible as at the front of the site the proposed building has roof drains that are collected and internally piped.At the rear of the site the same limitations in terms of soils, groundwater and topography exist making the use of LID measures unfeasible. ii. The Stormceptor units proposed have an internal bypass weir to bypass flows in excess of the treatment flow without re-entraining the solids previously settled out of the runoff stream. In addition,the unit proposed for the front area has a treatment flow(3.4 cfs)which is greater than the full 100 year flow from the roof and parking area(2.14 cfs).The separator at the rear of the site has been upsized and moved to be on the 36"drain so that with the reconfigured drainage it will treat the on-site runoff from the new catch basins. This 36' drain will be inspected for structural integrity and cleaned as necessary. It is noted on the plan in Note twelve(12)on sheet C-1. iii. The Alternate Bid portion of the project site constitutes a Land Use with Higher Potential Pollutant Loading(LUMPL). iv. Additional stormwater treatment has been provided by the addition of a new double rim catch basin opposite the fuel island, adding Eliminator catch basin hoods to the two other catch basins along Wayne Street and placing a Stormeeptor STC-2400 on the 36"discharge pipe to provide some treatment of the runoff from this portion of the site and the neighborhood prior to discharge to the brook. V. If the Alternate Bid is included,the proposed project would entail the disturbance of more than one acre of land and be subject to EPA's NPDES Construction General Permit(CGP). Prior to the initiation of work the selected contractor will need to file a Notice of Intent for coverage under the CGP, and prepare a Stormwater Pollution Prevention Plan(SWPPP)to be implemented during construction. This requirement is noted on the plans. vi. The Town of North Andover Department of Public Works has a Pollution Prevention Plan which contains all of the required information,The plan is entitled,"Stormwater Pollution Prevention Plan For the Department of Public Works Facility,384 Osgood Street,North Andover,MA"prepared by Woodard and Curran dated June 29,2012.This document will be updated accordingly. vii. The Operation and Maintenance(O&M)Plan included in the Stormwater Report requires catch basins on the site, including the catch basin located on Wayne Street. Detail has been added to the O&M Plan that will require catch basins be inspected at least 4 times per year and cleaned a minimum of once per year,not just when sediment thresholds are reached, and; stormceptor units should also be cleaned a minimum of once per year,with a vacuum truck. viii. Designated snow storage locations are identified in Note eleven(11) on sheet C-1 of the approved Site Plan. Additionally, a note has been added to the O&M Plan. 3 Town of North Andover Site Plan Special Permit—384 Osgood/Public Works Building July 5,2016 See L. Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as Iisted in Section 8.3.5, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 11) Permit Definitions: A. The"Plans"refer to the plans entitled"Improvements to the Public Works Building North Andover,MA 01845", dated May 27, 2016 and revised June 14,2016,June 21, 2016,June 30, 2016 consisting of Sheets C I --C61),prepared by Linden Engineering Partners,LLC, 100 Trade Center Suite G700,Woburn,MA 01801 and CSS Architects,Inc., 107 Audubon Road Building 2, Suite 300 Wakefield,MA 01880 and"Plans"entitled"Improvements to the Public Works Building North Andover,MA 01845", dated May 6, 2016, consisting of Sheets Ll.1, A1.1,A1.2,A1.3,A2.1,E1,prepared by Linden Engineering Partners,LLC, 100 Trade Center Suite G700, Woburn, MA 01801 and CSS Architects,Inc., 107 Audubon Road Building 2, Suite 300 Wakefield,MA 01880. B. The"Locus"refers to the I I S,813 sq. $.parcel of land at 384 Osgood Street, Map 94,Lot 2. C. The"Project"refers to the construction of a 7,100 SF administration/office building,thirty one (31)parking spaces,the demolition and construction of a 8,000 SF salt shed and stormwater management, landscaping, lighting and utilities in the Residential-4 Zoning District. D. The"Applicant"refers to the Town of North Andover,the applicant for the Special Permit. E. The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time,which can include but is not limited to the applicant, developer, and owner. 12) Snow storage for the site shall be located on the site on pavement upgradient of the stormwater treatment system. All drainage structures are to be kept clear of snow. Excess snow should be removed from the site. See note 11 on sheet C-3A/B of the herein referenced plans. "No Snow Stockpiling" signs shall be placed at the three catch basins along"Wayne Street"and at the stormcepter units. These locations will be confirmed with the Planning Department prior to installation. Signs shall remain in perpetuity. 13) By November 1, 2016 the Division of Public Works shall update with the pertinent information from the Operation and Maintenance Plan referenced herein and implement the operational"Stormwater Pollution Prevention Plan for the Department of Public Works Facility 384 Osgood Street"(prepared by Woodard&Curran and dated June 29, 2012).. 14) The rip rap apron at the pipe outlet shall be reduced from the proposed 10' x 10' to a maximum of 5' x 5' to reduce impacts to Bordering Vegetated Wetland. 4 Town of North Andover Site Plan Special Permit—384 Osgood/Public Works Building July 5,2016 15) The Plans do not include directional signage in the salt shed area. The Applicant will work with the Town Planner to ensure directional signage, as needed, is proposed and installed. Signage details will be added to the final as-built. PRIOR TO THE START OF SITE WORK OR CONSTRUCTION 16)A dated sequence of construction, including installation of erosion controls, demolition, construction, paving and all other work approved through final stabilization shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. 17)A copy of an approved,recorded at the Registry of Deeds Zoning Board of Appeals Decision to GRANT a Variance for a side setback relief for the proposed administration/office building and the salt shed shall be submitted to the Planning Department upon expiration of the appeal period.If there are any changes made to the project that was presented to the Planning Board on the date of this Decision, deemed to be material by the Town Planner,the Applicant shall come before the Planning Board for further review. 18) In consultation with the Town Planner, the Applicant shall designate an independent construction monitor. The monitor shall read, sign, and return to the Town Planner the Letter of Agreement for Independent Monitors. The monitor shall make weekly inspections of the project, provide monthly reports to the Planning Department, and detail any areas of non-compliance and corrective actions. The monitor will also provide reports following heavy rain events. The monitor must also be available upon notice to inspect the site accompanying a Planning Department designated official. 19) Erosion controls shall be installed between all construction areas and wetlands. Erosion controls shall consist of minimum 12" compost filter sock (biodegradable materials only, no plastic netting) or straw bales backed by trenched siltation fencing(where required). The erosion control will be survey staked an properly installed and placed as shown on the plans approved and referenced herein and shall be inspected and approved by the Planning Department or its agent prior to the start of construction and shall remain intact until all disturbed areas have been permanently stabilized to prevent erosion. 20) Prior to the commencement of any work, the Applicant shall submit to the Planning Department a copy of the approved NPDES Storm Water Pollution Prevention Plan(SWPPP) if disturbance is more than 1 acre for the entire property. 21) Per Health Department requirements, prior to any demolition on the site the building(s) must be inspected by Pest Control prior to receiving a demolition permit. 22) A pre-construction meeting must be held with the construction monitor, the Applicant, their construction employees, Planning Department and other applicable departments to discuss scheduling of inspections to be conducted on the project and the construction schedule. 23) The Applicant must comply with any requirements/decisions of the Conservation Commission related to this project. 24) The Applicant shall provide the Planning Board with copies of permits, plans and decisions received from all North Andover Boards. 5 Town of North Andover Site.Plan Special Permit—384 Osgood/Public Works Building July 5,2016 PRIOR TO THE ISSUANCE OF A BUILDING PERNIIT 25) The Notice of Decision and signed plans must be recorded at the North Essex Registry of Deeds. 26) Two (2) copies of the signed, recorded plans and Notice of Decision must be delivered to the Planning Department. DURING CONSTRUCTION 27) Dust mitigation must be performed weekly, or more frequently as directed by the Town Planner, throughout the construction process. 28) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. 29) It shall be the responsibility of the Applicant to assure that no erosion from the construction site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site sewer or other off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the project is not in compliance with the plan; provided, however, that the Planning Board shall give the applicant written notice of any such finding and ten days to cure said condition. 34) All stormwater best management practices shall be maintained as specified in the Operation and Maintenance Plan as referenced herein. PRIOR TO CERTIFICATE OF OCCUPANCY 31) The Applicant must submit a letter from the architect and engineer of the project stating that the building, lighting, landscaping, and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. 32) All stormwater structures shall be cleaned,in accordance with the approved Stormwater Operation& Maintenance Plan. 33) The Planning Staff shall review the site. Any screening as may be reasonably required by the Planning Staff will be added at the Project Owner's expense. 34) "No Snow Stockpiling" signs are to be posted along the wetlands and near the three (3) catch basins along Wayne Street. 35) A final as-built plan showing final topography, the location of all on-site utilities, structures, curb cuts,parking spaces and drainage facilities must be submitted to the Planning Department. GENERAL CONDITIONS 36) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 37) Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies. 6 Town of North Andover Site Plan Special Permit—384 Osgood/Public Works Building July 5,2016 38) The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 8:00 a.m. and 5:00 p.m. on Saturday. 39)No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 40) No underground fuel storage shall be installed except as may be allowed by Town Regulations. 41) The provisions of this conditional approval shall apply to and be binding upon the Applicant, its employees and all successors and assigns in interest or control. 42) Any action by a Town Board, Commission, or Department, which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board. 43) This Special Permit approval shall be deemed to have lapsed June 21, 2018 (two years from the date of issuance) exclusive of the time required to pursue or await determination of any appeals, unless substantial use or construction has commenced within said two-year period. Substantial use or construction will be determined by a majority vote of the Planning Board. 44) The Applicant is hereby notified that should the applicant disagree with this decision, the applicant has the right under MGL Chapter 40A Section 17,to appeal this decision within twenty days after the date this decision has been filed with the Town Clerk. 45) Any revisions shall be submitted to the Town Planner for review.
