A public hearing was held :by the Board cf_Appeils c.n June 17, .1974 upon'application of the Town of North Andover Municipal Facility Building Committee who requested a Special Permit from the North Andover Zoning By4aw Section 4.122 (10) so as to permit the erection of a Municipal-darage'and 0lfioe'`=Fa.cility as''ehown on a plan of land owned by the. The hearing was advertised in the Lawrence'ogle-41ribune on June 1 and June :8, 1974 and all abutters -were duly notified by regular. mail. .r .. The purpose of this application ia'to permit the Tow of North Andover, through its Municipal Facility Building.Committee to construct a facility on land on Wayne Stye®t at the corner of Osgood Street. _ AS the Annual Town Meeting held on .April 27 and 291 1974 Section 4.122 00) of the Zoning By-Last which became effective on May 28, 1974 amended Section 4.122 (10) allowing "Municipal building and public service corporation use (special permit required)�� After the public hearing the Board reviewed the evidence submitted, the plane and application of the petitioner and found that the speoific site .is an appropriate location for such use, that no serious hazard or nuisance is Present and that adequate facilities will be constructed. The Board also found that the neighborhood will not be adversely affected. Accordingly, the Board voted unanimously to CBANT the Special Permit. Very truly yours, . Board of Appeals Monday — June 17, 1974 Special Meeting ® 1 Hearing The BOARD.OF APPEALS met on Monday evening, June 17► 1974 at 7:30 P.M. in 'the Town Office meeting room specifically for a hearing on the ToTem Garage. The following members were present and voting: Frank Serio, Jr. , 'Chaixman; Dr. Eugene A. Beliveau, Clerk; Alfred E. Frizelle, Esq.; William N. Salemme; and Louis DiFruscio. Approximately 10 people were present for the meeting. RAYMOND G.TURCOTTE: This was a continued hearing from June '10, 1974. The BOARD decided to ask the Building Inspector to inspect the house on the inside and report back to it on July 8, 1974 and, also, to got a statement from Bain Pest Control stating what the extent of the damage is at the house. Would like the Bain people there when the Building Inspector goes to inspect the property. Mr. Serio suggested that her. Turcotte gat his land zoned back to residential at the next Toim Meeting because this variance is a critical one inasmuch as it involves zoning. The BOARD voted unanimously to hold a special meeting on June 18, 1974 at 8 P.1,1. to rule on the above matter. At this meeting the Building Inspector will give his report. TOVId OF NORTH AND0VXP4 MUNICIPAL FACTLIT1f BUILDING CO1911ITTEE: The clerk read the notice. Charles Foster, Building Inspector, spoke in favor of the petition. Mr. Foster stated that it would be most helpful if there could be a prompt decision. He went on to state further that he is a delegated member of the committee of which there are 11 members duly appointed by the Selectmen. Mr. Foster, in his presentation, said that he would like to assure any abutters or neighbors that the garage will not affect the vicinity adversely. It will be a facility of which we will all be proud. The existing trees will be used as a visual and audio buffer. As *to legality, the necessary zoning changes were approved by the Atty. General, effect— ive 'date May 28► 1974 and the hearing was duly published in the Eagle--Tribune. Site plan is by Frank Oelinas assisted by Joe Borghesi idth many recommendations and evaluations by the whole committee. The lot is large but narrow. The committee moved the facility as far as possible from Cochichewi.ck Brook in order to eliminate any environmental impact on the Brook. The main building is the garage facility and the smaller one is the administration— office section. Parking will be between that and. Osgood- St. Equipment traffic conies in Hayne St. The salt and sand shed will be covered. Leo Lafond assured the committee that lie will supply the necessary shrubs ?n-id trees. June" 17, 1974 -- cont. Repairing and maintenance will be done inside, according to Mr. Foster, and there will be very little, if any, outside storage of materials. - If there is any of this it will be screened so it is 'out of sight." This very important for the BOARD to show where this is an appropriate location for the proposed use. The nearest residences are 250 ft. away from the proposed garage.. Osgood st. is a desirable access to the facility. The site was given to the Town by the Stevens family. The committee doesn't feel there are any serious hazards to vehicles or pedestrians. ,School officials were contacted and their reaction was that their peak hours do not conflict with ours. The Town hours do not endanger the school children. Water will be serviced to the site throubh' a main from Camden St. and heating will be with natural, gas. All departments concerned are making every effort to use their facilities. The cost of the facility will be $462,000. The committee has to obtain all necessary permits and variances before going; to the Conservation Commission. Pair. Cyr is putting in rip--rap wall to protect the Brook. Discussion with the BOARD followed. The Town will be developing; Mayne St, (necessary fill and gravel. Mayne St. is a paper street from years ago and normally the abutters would have to pay for it to be developed. Raymond Canty, Phillips Ct. , spoke in favor of the petition. There was no oppoStion. Recommendations from the Fire Chief were read as follows: the building be fully equipped with a sprinkler system, one fire -hydrant be installed on the garage property, the garage be equipped with an adequate number of fare extinguishers, prominently Mounted and marked. He also stated that he favors the proposal agppresented. The Planning Board's letter stated that they feel this is the proper location for the construction of this building. Member DiFrusc h expressed concern regarding the test borings. Mr. Foster stated that the architect is being held responsible for all the necessary test borings. Fir. Salemme made a motion to O INT the Special Permit under Sec. 4. 122 and 7. 1 ac specified on the site plan. Mr. DiFruscio seconded the motion and the rote was unanimous. MOUSING APPEALS COMMITTEE LETTER: Notice of the hearing with the Archdiocese and the Board of Appeals was read by Mr. Serio. ELCTION OF OFFICERS. Mr. DiFruscio nominated Frank Serio, Jr. for Chairman, Mr. Friselle seconded the motion and the vote was unanir,ou.s. June 17, 1974 coat. Mr. DiFruscio nominated Dr. Beliveau for Clerk, Mr. Salemme seconded the motion and the vote was unanimous. Mrt DiFrLlsci0 made a motion nominating Atty. Frizelle for Vioe—Chairman, Dr. Beliveau secondod the motion and the vote Wa' s unanimous. The BOARD gave an official welcome to the new associate member, Mr. Walter J'amitko ski. A discussion was held by BOARD members regarding the possibility of appointing a Reviewing Committee to look at all petitionersO property. No action was taken. The BOARD discussed the conversion on Saunders St. owned by R & T Realty. They were all concerned about the parking situation.
