The Project will be relocated on existing bituminous concrete parking areas. The existing stormwater management system within the limit of work will remain. In these areas,the proposed improvements will not result in an increase in stormwater runoff rate and volume during the 2, 10, and 'I 00-year stoma events. The stormwater guidelines are not applicable because no work is being proposed within a wetland resource area or a buffer zone,therefore neither the North Andover Conservation.Commission nor Massachusetts Division of Environmental protection(DEP)Division of Wetlands and Waterways have l jurisdiction over the project under the Wetlands Protection Act,the North.Andover Wetlands Protection Bylaw, and the DEP Stormwater Management Policy. 1 The proposed NETTTS O&M Plan addresses a practical net improvement to storm water management. There are no changes to pedestrian access ways oil the property. Further,none of the proposed relocation areas impede any pedestrian access ways. (xi) Location of Wethinds/Notice of Intent- A wetland delineation was conducted in 2005 which remains valid under the Permit Extension Act (Section 173 of Chapter 240 of the Acts of 2010,as amended). An Abbreviated Notice of Resource Area Delineation(ANRAD)was filed on August 12, 2005 by Epsilon Associates, Inc. (DEP File##: 242-1336)and the Conservation Commission subsequently issued an Order of Resource Area Delineation(ORAD)on October 19, 2005 approving the wetland boundaries for the site following a thorough peer review by Seckamp Environmental Consulting,Inc. The ORAD references ANRAD Plans prepared by Chas. H. Sells,Inc, dated August 8, 2005 and revised September 30,2005 that depict Bordering Vegetated Wetlands(BVW), Isolated Vegetated Wetlands(1VW, both `jurisdictional' and `non jurisdictional' under the Bylaw, but recognizing that tlae`non jurisdictional' IVWs may be jurisdictional under the Federal Clean Water Act), intermittent streams, perennialmay streams/Mean Annual High Water and their associated 200•-foot Riverfront Areas. A determination of Bordering Land Subject to Flooding(BLSF,concurrent with the 100-year Floodplain)was excluded from the ANRAD/ORAD process. Epsilon then filed a Notice of Intent(NOi)Application on March 31,2006 for Vegetation Management on the site,and included the October 19,2005 ORAD and NOI Plans showing the approved Wetland Resource Areas. The Commission subsequently approved the project, and issued an Order of Conditions (OOC)on April 27,2006. Epsilon requested two extensions of the OOC on March 27,2009 and March 31,2010, and the Commission extended the OOC through April 27,2010 and April 27, 2011, respectively. Based on a review of the Permit Extension Act(PEA)and discussions with Mass DEP, it is believed the OOC remains valid through April 27,2018,and the Wetland Resource Areas established in the ORAD and referenced and depicted on the NO] plans and in OOC also remain valid. xii Location of Wa�3s: The Project will not result in the alteration or removal of existing walls or signs.New markings to direct traffic and maintain safe operating conditions are shown oil the submitted plans. (xiii) Location of Roadways/Drives. The Project will not create any new roadways. The southwest parking area will include a more detailed loading dock access way(approximately 250')to the main building on existing bituminous concrete surface. This will be delineated by painted striping and tempot•ary barricades,as shown on the site plan. The western perimeter roadway will continue to be utilized, allowing a direct and dedicated access way for the north and south training as'eas to connect. There will be no increased demand on public services or infrastructure. The project will not require water or sewer use. There will be no additional children in the Town's school system as a result of this project. There will be no impact oil traffic to the site after the relocation. The proposed relocation is not anticipated to impact the value of adjoining properties. The Project is proposed to be relocated on tine existing Northern and Western parking lots that are currently set back from Osgood Street.The proposed project will have no change to visual impact from Osgood Street or any abutters due to the existing vegetation, terrain, buildings, and the existing industrial activities already Oil the property. There are no expected costs to the Town resulting from the proposed relocation. The proposed relocation will be set back from Osgood Street in existing surrounding neiglnba parking areas that are not visible from Rt. 125 or are currently/historically used in a similar industrial capacity(foi•nearly 60 years). The proposed relocation has been carefully designed to ensure that there will be little to no impacts with ff=site environmental quality. The proposed O&M Plan addresses a practical net respect to on-site and o improvement to storm water management. The project will not result in any radiological emissions or other hazardous materials. The proposed relocation will not require water or sewer services. six Site Plain Review Is Not Required Section 8.3 of the Bylaw, at Section 2.a. defines when Site Plan Review is Required: i) New building or construction containing more than 2,000 square feet gross floor area, or five or more additional parking spaces. 6 Construction to existing buildings adding more than 2,000 square feet gross floor area, or five or more additional parking spaces. iii) Construction, site improvements, new uses in existing structures or developments which contain new processes not normally associated with the existing use AND which result in changes in: potential nuisance to adjacent property,traffic circulation, storm water drainage onto or off of the Site; or 5 or more new parking spaces. iv) Construction of a new wireless facility. The relocation of NETTTS DOES NOT trigger any of these 4 criteria,therefore Site flan Approval is NOT required. Eroding or barren areas should be immediately re-vegetated. Inspection and Maintenance of Catch Basins The catch basins shall be inspected four (4) times per year and at the end of the foliage and snow removal seasons, and if necessary, any maintenance shall be performed so that it functions as designed. The basins shall be cleaned four times per year, or when sediment in the bottom of the sump reaches Y2 the depth from the bottom of the invert of the lowest pipe in the basin. Inlet and outlet pipes should be checked for clogging. Debris and Litter Removal Trash may collect in the BMP's, potentially causing clogging of the facilities. All debris and litter shall be removed when necessary, and after each storm event. Sediment and debris collected from vacuuming and/or sweeping should be disposed of at a permitted waste disposal facility. Avoid disposing of this material on site, where it could be washed into the proposed subsurface infiltration systems. Parking Lot Sweeping NETTTS leased areas shall be swept annually in the early Spring (Exhibit A). Sweeping shall be conducted with a high efficiency vacuum or regenerative air sweeper rather than a mechanical broom sweeper.
