To date,the ' Planning Board is holding two performance bonds totaling A2S,000asfollows: 1. Site Plan Review; $5,000 deposited 5/7/14 2. Downtown Overlay Special Permit; $20,000deposited 8/19/15 Ao background,the Site Plan Review allowed the creation ofon additional 3O parking spaces within an existing parking area, with associated landscaping and stormnvvatermanagement. All work was completed in compliance with the Site Plan Review Decision, except for items noted below: a. Only 26of the 3O parking spaces were built inthe Center Lot loop due todesign constraints with the four spaces removed. b. The rain garden design was modified to meet approval of the Conservation Agent. The modifications allowed for better drainage from the parking areas into the rain gardens. The initial Downtown Overlay Special Permit was approved on January 6, 2015 and allowed for thepartiu| dennoUtinmnfonebuHdingnn's|tu,thecreotiunofanevv12Ospacmpark|nO |ot, conservation and reconstruction of historic facades of adjacent buildings,conversion of existing space for upto42 residential apartments, implementation of the dgnage master plan, and all associated landscaping and grading activities within the Downtown Overlay District. The Decision was amended on July 20, 2019tn allow demolition of Building 37 in its entirety, re- orientation ofthe parking lot, revised landscape plans, revised storm water management plans and revised operation and maintenance report. The Decision was further amended on October 4, 2016tn allow entranceway upgrades to Building 36 and relocation and replacement ofthe QCG VVES'T WU NA. LLC � / ' existing cooling tower. All work was completed in compliance with the Planning Board approvals, except for items noted below: a. Only 39 of the planned 42 residential apartments were built to accommodate the final design and layout nf the proposed units. b. The two designated handicapped spaces in "Center Lot 11"were moved from the center of the lot to the back corner of the lot to better align with the handicap lift located near the doorway at5U High Street. c Two handicapped spaces were added in front of 40 High Street to accommodate the needs of the building. d. A total of 251 spaces are located in the new Center lots which is 3 less than originally approved due tm design constraints mentioned above inthe Center Lot Loop and the addition of handicapped spaces. This still represents a net gain of spaces in an area previously occupied bya building. Attached to this letter are as-built plans for the West Mill; a letter from both engineers that worked on the project stGtingthevvnrkiuinsubstontia|conlp|iancevxithw/hetm/amappnoved; and a current Stormnvvoter Inspection Report for the West Mill. Further, vve are including the most recent monitoring report from our Wetlands Consultant opining on the status ofthe requirements of the Conservation Commission and our request for Certificate of Compliance for this project. RCGVVeat Mill NALLC believes it has complied with the conditions nf the Planning Board Approvals, and as such, respectfully requests return of the payments as described above. We are happy to provide any additional information that is required by the Planning Board to release the bonds as well as attend a Planning Board meeting to discuss directly with the Board.
