NOTICE OF DECISION (INSUBSTANTIAL CHANGE)
SITE PLAN REVIEW

FACTS
Oil September 29, 2014, RC(i, l.,LC(on behalf of RCG West Mill NA LLC) filed an Application for a
Downtown Overlay Special Permit with the F'lanuing Board pursuant to Section 8.1, 10.3 and 18 of the
Town of North Andover Zoning Bylaws. On January 16, 2015,the Planning Board unanimously voted to
grant the Applicant a Downtown Overlay Special Permit approving the Project.
On February 4, 2016, the applicant requested approval of the following design modifications:
1) Minor parking, grading, and sidewalk changes were made with modifications to building entry
locations and elevations. Changes include the elimination of a curb bumpout along Building 5;
enlargement of curb bumpouts on the northwest and southwest end of the center of the site;
renloval of the proposed sidewalk ramp and stairs near the western entrance to Building 5; and
adjustment to the sidewalk layout in front of Building 36 and former Building 37.
2) Bioretention system 4 was relocated approximately 30 feet west to accommodate the minor
adjustments to site layout noted above.
3) Bioretention systems 2A, 2B, and 2C were consolidated into one bioretention system.
4) Biorctention systems 6 and 7 were combined into a single bioretention system (renamed system
6)to simplify the design.An emergency overflow is proposed to connect to the existing twin
culverts via the existing drainage structure DMIJ 1.1.0 and existing pipe connection.
5) Bioretention systems 4, 5,aricl 6 were modified from Type 2 to Type 1 (see details on Sheet C-
10)to replace the linear channel forebays with typical forebays. The adjusted design provides the
approved pretreatment volume.
6) The proposed linear channel bioretention pretreatment detail was modified,replacing the concrete
forebay with metal plate with a trench drain pan. The pretreatment function is identical to the
approved design.
7) The design of the site's center greenspace was simplified. The proposed bioretention system 5
berms and double underdrain pipe was edited to provide a single vegetated drainage area with an
underdrain.
8) The extent of the proposed block retaining walls in the center of the site was reduced.
9) Additional annotation and detail was added throughout the plan set for constructability.
10) The proposed wooden deck and associated ramp systems were deleted from the proposed plan.
These changes are reflected oil the plan dated October 2015 and revised. December 2015,. titled West Mill
Redevelopment Construction 'Plans, prepared by I-Iorsley Witten Group, Inc.

The project has been reviewed by the town's consultant, Eggleston Environmental, as noted by email
correspondence dated February 22, 2016. Ms. Eggleston has reviewed the proposed revisions and
concurs that the revised design does provide the required pretreatment and treatment volumes in the
basins consistent with the approved plan and that the revisions proposed are minor and insignificant with
respect to the Wetland Bylaw,
DECISION
With the exception of Item 10,the proposed changes are deemed to be insubstantial and do not alter either
the intent or the conditions of the original Special Permit. The changes do not require a vote of the
Planning Board.
CONDITIONS
The Interim Town Planner's finding of Insubstantial Change is conditioned on the following:
1) This Decision and the revised Plans(sheets C-I through C-13) dated 10/2015 and revised
12/2015 shall become part of the record and the changes will be reflected on the final as-built
drawings which will be reviewed and approved by the Planning Department.
2) The proposed wooden deck and associated ramp systern design to stabilize the culvert must be
approved and agreed upon at a later construction phase.
