Conservation Conditions of Approval,NACC#282
Pursuant to section 4.4 of the North Andover Wetlands Protection Regulations, Stacey Bowne, the
homeowner, filed for a Small Project Perrriit for work proposed at 625 Turnpike Street,North
Andover. Work involves installing 5-foot-tall chain link fence at the rear of the property and 6-
foot-tall PVC fence oil the sides. All portions of the proposed fence are located within the 100-Foot
Buffer Zone to Bordering Vegetated Weiland (BV\V, ). The fence is approximately 52- feet from the
BVW at its closest point.
During the August 11,2021 public meeting, the North Andover Conservation Commission voted
unanimously to approve this as a Small Project Category"IT'.The project is approved only as it
relates to the Consenation Commission and any and (if applicable) all other approvals should be
obtained by the applicant/homeowner. The applicant is responsible for determining property
boundaries. All work shall conform to the following:

1. Pre-construction meeting with the Conservation Department to review fence installation
procedures & to review the 6-inch gap requirement at the bottom of the fence.

2. Any excess excavated soils from the post holes shall be taken off site.
3. il post construction site inspection shall be scheduled with the Conservation Department to
verify compliance with this approval.
zt. This permit shall expire one year from the date of issuance.

❑ The applicant maintains that the project falls within the small project category below and activities and/or
structures are located outside the 25-foot NDZ,50-foot NBZ and 75-foot NB7 Ephemeral Pool.
❑ A.Open slotted decks,without roofs,equal to or less than 300 square feet surface area,inclusive of
stairs and ramps,which are to be attached to an existing home,where soil disruption during
construction is limited to less than 50 square feet,and where no permanent soil alteration's are
planned under the footprint of the deck
❑ B. In kind replacement of lawfully existing decks,regardless of size.
❑ C.Sheds or other outbuildings of less than 100 square feet,which are to be placed on footings,not
permanent foundations.
❑ D. Sewer system connections as required by the Town of North.Andover.
❑ E. Unpaved pedestrian walkways (less than four(4)feet wide)for private use or for public access on
conservation property.
❑ F.Patios less than 300 square feet,not requiring excavation or grading.
❑ G.. Tuning of existing vegetation,planting of new native vegetation and gardening.
® H. Fences and stone walls which do not alter the flow of surface waters nor alter wildlife habitat or
movement(does not include retaining walks).

Two (2)copies(and an electronic copy when possible)of a 1" =20' scale (or other as deemed appropriate by the
Conservation Commission or agent thereof) drawing showing existing and proposed conditions and the
delineated wetland resource areas (see plan requirements below for additional detail).

Q/The delineated resource area boundaries have been confirmed by the Conservation Department as accurate.
Plan Requirenients (Section 4.4.3 B):
Certified and/or professionally prepared plans are not required. However,the North Andover Conservation
Commission or its designated agent shall have the final authority to determine whether the submitted
plans/drawings are adequate and include all pertinent information for review.
At a minimum,all plans submitted shall clearly and accurately show the present conditions and proposed work
and depict the location of all wetland resource areas within 100' of the proposed work. All plans must be signed
and dated by the person who prepared them.
The Commission may also require the following information on the proposed plans in addition to the
aforementioned criteria where applicable:
F1 Location of any subsurface sewage disposal systems.
El Locations of any drainage structures.
El Locations of any easements,including but not limited to,drainage and utility easements.
El Locations of any open space boundaries if(e.g.if the lot is affected by the 50' open space boundary as required
in a Planned Residential Development(PRD)).
El Location and nature of all proposed alterations to the Buffer Zor esource Area.

El COMPLETE- APPLICATION-The application meets the submittal requirements. Therefore,the Conservation
Department has prepared a written list of conditions necessary to protect any adjacent wetlands for approval by
the Conservation Commission.
This condition list shall be filed with the North Andover Conservation Department as NACC#
❑ INCOMPLETE APPLICATION-The following sections of the Wetland Protection Bylaw&/or Regulations
have not been complied with and as a result this Department is rejecting this incomplete application w/in two
(2)business days from the date of receipt (Section 178.4 North Andover Wetland Protection Bylaw). You may
pick up this application and supporting plans at the Conservation Office and re-file with the required
supporting documents and information.
El NOT A SMALL PROJECT-The North Andover Conservation Commission has determined that the proposed
project as submitted does not meet the small project criteria and hereby del-des the application. As such,a
Request for Determination of Applicability (RDA)or a Notice of Intent(NOI) must be filed.

This proposal includes a fence that is constructed out of a white PVC privacy fence on
either side (vertically) that measures 6' in height and 38' in length (L) and 30'(R). The
back of the fence (horizontal) will be black chain link measuring 5' in height and 90' in
length. Due to the proximity of the wetlands, there will be a 6" gap below all fencing. As
the drawing indicates, the fence will be flush to the house and measured out
accordingly.
