NEGATIVE DETERMINATION OF APPLICABILITY
SPECIAL CONDITIONS
50 Duncan Drive, North Andover
At the August 11, 2021 public hearing, the North Andover Conservation Commission
(NACC) voted to issue a Negative # 3 Determination of Applicability for the in-kind
replacement of existing deck boards on two decks within the 50-foot No Disturb Zone & the
75-foot No-Build Zone, replacement of existing handrails, stairs and walkway within the 100-
foot buffer zone and partially within the 75-foot No-Build Zone, connection of a drain pipe to
a terminal catch basin within the 50-foot No Disturb Zone, returning of previously poured
concrete areas to mulched landscape beds and lawn within the 50-foot No Disturb Zone &
partially within the 25-foot No Disturb Zone. Although shown on the submitted plan,
fencing has NOT been approved under this permit.

SPECIAL CONDITIONS:
1. Pre-construction meeting with the Conservation Department to review RDA
installation procedures for all activities with the homeowner/ contractor
2. Dumpster for disposal of existing deck & walkway materials to be placed outside of
the 50-foot No Disturb Zone.
3. Post construction site visit with the Conservation Department to verify compliance
and approve the removal of erosion controls.

B. Determination
Pursuant hz the authority ofW1.G.Lc. 131. G4U' the Conservation Commission considered your
Request for Determination of Applicability, with its supporting documentation, and made the following
Determination.
Project Description (if applicable):
In-kind replacement of existing deck boards within the 50-foot No Disturb Zone and 75-foot No Build
Zone to an epherme| pool. Replacement ofexisting old handoai|a, stairs and walkway within the 100400t
buffer zone at the front of the house. Most of the existing vvo|kmxsv is within the 1OO-foo(buffer zone, but o
small portion is within the 75-foot No Build Zone. Walkway will be replaced with concrete pavans and
granite cobble edge. Repair existing retaining vva||. Connection of roof gutters to a 3-inch drain pipe, as
well as layers of3/4" gravel with a terminal catch basin for overflow within the 50'hnnt No Disturb
Zone.The area where the concrete was poured & removed within the 50-foot No-Disturb Zone & partially
within the 25-foot No Disturb Zone is proposed to be returned to a mulch landscape bed with plantings
and/or lawn.
Fencing is NOT proposed or appro ed under thispermit.

Protection Act and regulations:

Note: No work within the jurisdiction of the Wetlands Protection Act may proceed until a final Order of
Conditions (issued following submittal of a Notice of Intent or Abbreviated Notice of Intent)or Order of
Resource Area Delineation (issued following submittal of Simplified Review ANRAD) has been received
from the issuing authority(i.e., Conservation Commission or the Department of Environmental Protection).

Note: No further action under the Wetlands Protection Act im required bythe applicant. However, ifthe

request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.

Buffer Zone.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner cdland abutting the land
upon which the proposed work istnbe done, or any ten residents of the city or town |o which such land ie
|onahad, are hereby notified of their right to request the appropriate Department nfEnvironmental

mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal Form (see

time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant if
he/she is not the appellant. The request shall state clearly and concisely the objections to the
Determination which is being appealed. To the extent that the Determination is based on m municipal
ordinance or bylaw and not on the Massachusetts Wetlands Protection Act orregulations, the Department
of Environmental Protection has no appellate jurisdiction.
