Dear Ms. Oldham:
On behalf of the Town of North Andover, TEC, Inc. reviewed documents as part of the civil
engineering peer review for the proposed project to be located at 1600 Osgood Street. Osgood
Solar, LLC ("Applicant"), submitted the following documents, which TEC reviewed for
conformance with the Town of North Andover Zoning Bylaws:
• Solar Development Site Plans, 1600 Osgood Street, North Andover, MA, prepared by
Meridian Associates, Inc., dated May 6, 2016, revised June 16, 2016;
• Response to Peer Review Comments, 1600 Osgood Street, North Andover, MA,
prepared by Meridian Associates, Inc., dated June 16, 2016.
In addition to review of the documents and plans, TEC attended a meeting with the Applicant
on June 15, 2016. Upon review of the latest submission, TEC compiled the following list of
comments. For consistency, the outstanding original comment numbers have been retained
from the most recent TEC review letter dated June 7, 2016. The Applicants response to
comments is shown as bold; TEC responses are shown as italic.
1. The Applicant should confirm the total number for solar modules proposed. The Special
Permit— Site Plan Review Application indicates 11,000 solar modules and the
supporting narrative indicates 10,300 modules.
Applicant Response: The total number of modules is approximately 10,300.
The total system rating is 3.6 MWdc using 350wdc modules. The original
application considered using the same nameplate capacity with more,
slightly less efficient modules, but in the end decided to specify 10,300 high-
efficiency modules.
TEC., Comment addressed
2. Based on the definition of a "Structure"within the Town of North Andover Bylaws,
Section 2.68, it is unclear if the solar modules are considered a structure. TEC
recommends the Inspector of Buildings provide an interpretation. If deemed a structure
the Applicant shall revise the Lot Coverage calculation,

Applicant Response: The Building Inspector has informed the Town and the
Applicant that the solar modules are not considered a structure, but rather
electrical equipment.
TEC TEC received correspondence between the Building Inspector and Planning
Department, dated June 16, 2016, which identified the solar modules as equipment
sitting on the ground and not considered a structure. No further response required,
3. In accordance with Section 8.3.5.e.vi-Zoning Information, additional Bylaw information
should be shown on the table. Only dimensional and density requirements are shown
on the plans.
Applicant Response: The required detail is shown in a table in the Legal
Memo.

4. In accordance with Section 8.3.5.e.vii-Stormwater Drainage: No stormwater
management changes are proposed; however, there are no plans for the existing
stormwater management system. The stormwater management system review shall be
conducted by the stormwater review consultant,
Applicant Response: The stormwater management review is being performed
by Eggleston Engineering.
TEC., TEC defers to the 5tormwater Review Consultant. No further response required
5. In accordance with Section 8.3.5.e.viii-Building Location, the Applicant should identify
all existing structures including the number of stories, overall height in feet and gross
floor area in square feet of all structures.
Applicant Response: All applicable buildings are shown on the Record
Condition Plan. The Applicant requests a waiver for providing required
building details as they are not applicable to this project.
TEC.- The Board should note and discuss this waiver request. The proposed project does
not propose any new or alterations to existing buildings.
6. In accordance with Section 8.3.5.e.x— Location of Parking/Walkways—The applicant
should show the existing parking spaces on the existing conditions plans. It is difficult to
identify the existing parking areas on the plans and how the proposed solar arrays
impact the existing facilities.
Applicant Response: On the north array area, the majority of spaces
immediately surrounding the limits of work will be restriped as part of the
project. Further, it is noted on the plans that the existing parking striping is

compiled from record plans provided by Osgood Landing facilities
department and historical aerial imagery.
TEC, Comment satisfactorily addressed The existing parking striping was not Included
within the existing conditions survey and added to the plans by the Applicant In the
vicinity of the improvements based on historical and available information. No further
response required.
7. In accordance with Section 8.3.5.e.xv— Landscaping Plan —A landscaping plan was not
included as part of the Application. The proposed arrays are proposed in areas where
existing parking fields are currently located and previously approved. The required
landscaping as indicated in Section 6.6.h-Landscaping, Buffering, Lighting and Section
8.4 primarily regulate the buffering of parking facilities. The Applicant is proposing one
new area consisting of 27 spaces, which appears to require landscaping on three sides
with at least one tree for every thirty (30) linear feet. The Zoning Bylaw appears to be
unclear on modifications to existing parking facilities and if they are required to be
brought into compliance from a previous site plan approval.
Applicant Response: The updated plan clarifies that there are only eight new
parking spaces being striped, all of which are on existing pavement on the
westerly side of the north array and chain link fence. Further, the area
where these spaces are located has an existing grass barrier on two sides.
The planting of trees this close to the solar array is prohibited by design
principles. To the extent that the Planning Board believes that the Zoning
Bylaw requires such modifications, the Applicant requests a waiver.
TEC, The Board should note and discuss this waiver request, The proposed project is
within the limits of existing paved areas
8. In accordance with Section 8.3.5.e.xvii — Lighting Facilities— Identification of proposed
illumination. In the Project Narrative, the Applicant indicates that the project will include
lighting to the extent required to meet minimum IES Standards. The Applicant should
identify which areas will need additional lighting to meet the standards and provide
details for the proposed fixtures, if any.
Applicant Response: There are no areas of the project which require any
lighting improvements. The limits of work are inside a secure fence which is
off limits to the public and does not require lighting. No lighting changes will
be made to areas outside the limits of work.
The initial response related to the driving school tenant relocation. Since we
are no longer proposing a tenant relocation change and are only scaling back
active parking spaces,further analysis is not required.
TEC.- The Applicant should confirm that the light fixtures being demolished to install the
northerly array are not required to properly illuminate the closest parking spaces that
are to remain.

9, The proposed solar modules are proposed in locations where existing utilities are
currently located, including drainage, water, electrical, as indicated on the Existing
Conditions Plans.
a. The Applicant should confirm if these utilities are intended to remain active. If
so, how will the drainage be properly maintained (i.e. catch basin cleanings),
water gates accessed to isolate water mains and other utilities managed and
maintained.
Applicant Response: All utilities are intended to remain active. in order to
better improve the maintainability of the catch basins, modules have been
removed to create an access way.
TEC• Comment partially addressed. The Applicant should confirm if the active utilities
can be properly shut down and isolated In the event of an emergency, break or needed
repair within the limits of the arrays. Can the modules be temporarily moved to flx a
damaged utility pipe?
b. The Applicant should confirm if there are there any easements associated with
the underground private utilities (electric, gas) that need to be maintained.
Applicant Response: There are no easements associated with underground
private utilities.

10. It appears that a hydrant near the cooling towers adjacent to the Chiller Building will be
blocked off by the proposed solar modules. The Town of North Andover Fire
Department should confirm if access to this hydrant is required.
Applicant Response: The hydrant in question remains accessible to the Fire
Department. The proposed and existing access are exactly the same. See 11
(below).
TEC.• Proposed access and fence line remains consistent as compared to the existing
conditions. Upon further review of the access around the southerly array, two gates are
proposed that block access through the access way unless by emergency vehicle with
Knox Box Key access. SIgnage should be placed to notify other vehicles that may try
and travel around the site that access is not allowed prior to the user travelling down
the access way at this location.
11.An 18.3'wide maintenance aisle is provided within the solar array. The Town of North
Andover Fire Department should confirm if this is adequate to access this area, if
needed. It appears that the fire access is provided along the edges of the project, and
the maintenance aisle is provided for system maintenance, not emergency access.

Applicant Response: The Fire Department has reviewed,commented on, and
approved the updated plans. The aisle described is intended for maintenance
and not emergency vehicle access.
TEC TEC received correspondence between the Fire Department, Massachusetts
Division of Fire Safety, and the Planning Department, dated June 7, 2016 which
Included recommended revisions regarding access The revised plans appear to address
the Fire Department recommendations. No further response required.
12.The Applicant should confirm the construction of the Interconnect Line. Is this line
intended to be above grade or below grade? The location appears to go within limits of
buildings.
Applicant Response: The medium voltage interconnection line has been
redesigned to route through the buildings and existing infrastructure. No
overhead lines are required. Limited sections of underground duct banks
adjacent to the transformers are shown on the drawings.

13.The Special Permit—Site Plan Review Application indicates that the array will be placed
on existing paved surfaces or new crushed stone surfaces. The Applicant should identify
on the Site Plans where the new crushed stone locations will be located and if so a
detail should be provided.
Applicant Response: There are no new crushed stone areas proposed. The
note on the plans has been revised to properly state that pothole/pile
remains within the proposed array to be levelled with gravel and stone.
Within each pothole/pile remains area there is 1"-2"of leveling required.

14.The Applicant should confirm if the required parking demand shown on the project
narrative is for the current tenants in the building or for the total gross square footage
(leased + unleased) space. If parking is not based on the total gross square footage,
the Applicant should identify how parking is allocated and/or adjusted as new tenants
occupy the existing space.
Applicant Response: The project narrative parking analysis is for current
tenants. The building inspector has worked with the building management
team during the permitting process to ensure adequate parking is available
for each new tenant.

15.TEC recommends that the existing parking striping on the southerly end of the northerly
array be modified to eliminate dead end parking stalls. It appears that restriping the
drive aisle adjacent to the fence will eliminate this condition.

16,TEC recommends that a detail be provided for the proposed striping,

TEC, Comment addressed. It should be noted that the proposed access drive striping
will be standard 4"painted lines, not the thickness shown on the Site Plans. TEC
recommends that the Board require a regular re-striping program of the access drive as
needed to ensure proper identification for vehicles, delivery trucks, and emergency
response. It appears that the existing striping at the facility Is In poor condition In areas
that are not consistently used for pal-king.

Hello Jean,
I'm not sure if you've received any response back yet from John Simons, but I discussed this some more with
our team, and I think the issue is more complex. Since Joe is an expert on our case, including the matter in
appeal, he could be a witness. Though I hope that it never gets there, I think that until our case is closed, Joe is
still the Town's expert. Which reinforces my thought, that we ought to get the solar project in and out of planning
as soon as possible. That would remove any concern.
As I mentioned earlier, I'd like to think that brining in a new peer review at this point wouldn't delay things, but I
really think there's a lot of ground that we've already covered with Joe and his team that could take more than a
few weeks to get through with a new firm.
