476 Chickerin Road - Sal's Pizza
Please be advised that Section 6.6(3) of the Sign By-Law allows one (1) sign
oriented to each street on which the premises has access, either attached or
ground, pertaining to-an apartment development or a permitted non-residential
principal use of the premises, such sign not to exceed ten (10) square feet in
area. As such, the building is allowed one (1) sign pursuant to Section 6.6(D)
(1) and two (2) additional because of access from Main and Park Streets for a
total of three (3) building signs.
The Applicant has agreed to re-configure the parking (spaces numbered 1-9, 18,
25, 28) in order to eliminate the spaces extending into the right-of-way and, if
necessary, request a variance of the 25 ft. wide driveway.

Please be advised that the site plan submitted for review did not include a
"restaurant" and the applicant stated a video, cleaner, convenience store,
delicatessen and a bank as occupants. The applicant never intended to have a
"restaurant" and the parking was estimated accordingly.

Dear Mr. Brem,
The Planning Board reviewed the revised plans at their meeting of January 21, 1997.
Unfortunately, a copy of the revised plans was not delivered to the Planning Department until
today therefore T have not been able to specifically identify the Planning Board's concerns until
now. The Board's major concerns are as follows:
• The building should have an entrance and street scape on Main Street. The
landscaping on this side must facilitate pedestrian flow into and out Of the site.
• The columns must be constructed of wood instead of brick.

• The dumpster must be enclosed with material that matches the building.
• The landscape design must be revised to complement the new building design. Under
Section 8.4 of the Zoning Bylaw, for all parking areas of 20 or more spaces, on at
least three side of the lot there shall be planted at least one tree for every thirty linear
feet. Trees required by this section shall be at least 3.5 inches in diameter and at a
height of four feet above ground at the time of planting and shall be of a species
characterized by suitability and hardiness for location in a parking lot.

I am responding to your-letter of May 13, 1998 requesting that I Issue a stop work^order
for the on going construction of'a building at 490 Main Street/478 Chickering Road. You have
made your request pursuant to G.L.. 40A Sec. 7. For reasons described below, I am declining to
Issue a stop work order.
Your letter describes certain alleged zoning violations based on your assumption that overhang
eave(s) on the Main Street side and In the side of the building facing Mr. Nassar's property
encroaches further into the required setback and violates the dimensional requirements of the
Zoning By-law. In fact, Section 7.3 -yard setbacks states that minimum front, side, and rear
setbacks shall be set forth in Table 2, except for e6ves and uncovered steps. As such, no
variance was required for eave (a)setback.

You also allege that the extension of the foundation one the side of the building facing
Mr. Nassar's building was not approved by the Board of Appeals in connection with the variance
granted by the Board of Appeals decision on Petition: 006-97, Dated March 20, 1998 which
addresses this and all other variances as shown one the site plan and granted by the Board of
Appeals.
Plans on file In the Planning Department reveal that the building under construction Is
the same as approved by the site plan review process.

In order for me to make an informed determination that the structure under construction meets
the Planning Board requirements I will need an as-built plan and a certification from the site
engineer and architect that the building is constructed in conformance with the approved plans.
This information must be supplied prior to release of the bond money held for this site.
I will however look at the site and make a determination as to whether or not there are any
obvious issues. If you have any specific areas/issues on which you would like ii$itt please let
me know.

Re: Sign Permit Applications for Sal's Pizza and Stop & Shop
In my memorandums to you last week concerning the sign permit applications for Sal's Pizza
and Stop & Shop,I did not intend to imply that my memorandum was sufficient for receipt of a
sign permit. During the site plan review process, the Planning Board reviews the aesthetic
aspects of the proposed signs only. The Board makes no determination as to the proposed sign's
conformance with the Zoning Bylaw. The Board's decisions regarding signs are always subject
to receipt of a sign permit from your Department. Applicant's who request letters from the
Planning Department as part of their sign permit application are always verbally informed that
the signs must also conform to-the Zoning Bylaw which will be determined by your office.
I apologize for any confusion this may have caused and will be more specific in my letters to you
in the future concerning the Planning Board's review of signs during the site plan review
process. If you have any questions please do not hesitate to contact me at 688-9535.

I visually inspected the site on September 4, 1998. The fagade of the building conforms to the
site plan approved by the Planning Board. I cannot comment any other requirements of the site
plan review approval as the parking lot, driveways, storm water management systems, lighting,
and landscaping have not yet been constructed and/or planted.
As I have previously stated to you I do not have an as-built foundation plan for the building
therefore I cannot comment on the alleged setback violations. The Planning Board would not
generally comment on setbacks where the Zoning Board has granted variances.

� I have reviewed the Says Pizza site and have determined that the conditions contained in the
Planning Board Site Plan Review Approval prior to occupancy are substantially complete with
the following conditions:

1. The owner must construct a fence around the building to be demolished in order to protect
the public from the construction site. This should be completed prior to the issuance of the
temporary occupancy permit.
2. The site currently contains 10 designated parking spaces. The number of seats should be
f limited to correspond with the number of spaces.

3. The owner must apply for a demolition permit as soon as possible after the issuance of the
temporary occupancy permit.
4. The building must be demolished as soon as passible after the issuance of the demolition
permit. The demolition of the building should-not take more than two days weather
permitting.
5. The rough grading, paving binder, curbing, finish paving, landscaping and line painting must
be completed within three weeks of the date of the demolition of the building as set forth
in the attached schedule submitted by J&M Contractors.

The Planning Board continues to hold $10,000 for final completion of the site. This money will

Dear Mr. Lupoli,
As per your request, I have reviewed the Planning Board decision for the items that must be
completed prior to release of the final bond money. I have attached a copy of the decision with
these items highlighted for you. You must complete the site landscaping, submit a final as-built
plan, and submit a letter from the architect or engineer of the project stating that the landscaping
and site layout substantially comply with the plan approved by the Planning Board. If you wish
to modify the landscape plan you must request the modification in writing and must have an
alternate plan prepared.
! Once you have submitted an as-built plan, a letter from the architect or engineer and have either
completed the landscaping as approved or submitted an alternate landscaping plan I will
schedule you for the next available Planning Board meeting. All information must be submitted
at least one week prior to the meeting.

This decision shall be recorded at the Essex North Registry of Deeds and a certified
copy of the decision delivered to the Planning Staff.
4. Prior to verification of the Certificate of Occupant
a) Lthelanst
icant must submit a letter from the architect or engineer of the project stating
uilding, signs, landscaping, lighting and site layout substantially comply with
referenced at the end of this decision as endorsed by the Planning Board.
j b) All artificial lighting used to illuminate the site shall be approved by the Planning St
All lighting shall have-underground wiring and shall be so arranged that all direct rays
from such fighting falls entirely within the site and shall be shielded or recessed so as
not to shine upon abutting properties or streets. The site shall be reviewed by the
Planning Staff. Any changes to the approved lighting plan as may be reasonably
required by the Planning Staff shall be made at the ownces expense.
c) The building must have commercial fire sprinklers installed in accordance with the
North Andover Fire Department.
5. Prior to the final release of security: - _ -- -
a) The site shall be reviewed by the Planning Staff. Any screening as may be reasonably
required by the Planning Staff will be added at the applicant's expense.
b) A final as-built plan showing the location of all on- site utilities, structures, curb cuts,
parking spaces and drainage facilities must be submitted to and reviewed by the
PlanningStaff'and the Division of Public Works,
L6. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan
and reviewed and approved by the Planning Staff. Any approved piles must remain covered at
all times to minimize any dust problems that may occur with adjacent properties. Any stock
piles to remain for longer than one week must be Fenced off and covered.
7. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in
this decision that die within one year from the date of planting shall be replaced by the owner.
8. The contractor shall contact Dig Safe at Ieast 72 hours prior to commencing any excavation.
9. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the.respective
utility companies.
10. All catch basins shall be protected and maintained during construction with hay bales to prevent
siltation into the drain lines.
11. No open burning shall be done except as is permitted during burning season under the hire '
Department regulations.
12. No underground fuel storage shall be installed except as may be allowed by Town Regulations.

Re: 490 Main Street(Sal's Pizza)--Site Plan Review
As per your request, I will address Attorney Speicher's points regarding the site plan as set forth
in his letter of August 7, 1998 to your Board:
1. The building as constructed is a one-story building.
2. The approved building elevation depicts an overhang on all four sides of the building.
3. The approved plan shows an employee parking space on the Nassar properly side of the
building. As constructed there is a stairway in approximately the salve location. This
change,however, would not require review by the Planning Board, as it is mirror in nature.
Technically the applicant should have provided the Planning Department with copies of the
revised plan for review and approval, this did not occur. The applicant however, must
demonstrate that sufficient parking has been provided. The variance issued by your Board
jstates that there must be 27 parking spaces, it is unclear if this requirement can be met with
the construction of the stairway. I anticipate that the Building Inspector would review this
issue prior to issuing a certificate of occupancy.
s Due to the flooding of our office space located at 30 School Street our files have not been in their
proper order. I have not been able to locate the Planning Board file for this project until today
therefore I apologize for the lateness of this letter. If you have any further questions or need

This decision shall be recorded at the Essex North Registry of Deeds and a certified
copy of the decision delivered to the Planning Staff.
4. P40 to verification.of the Certificate of Occupancy:
a) The applicant must submit a letter from the architect or engineer of the pro' stating
that the building, signs, landscaping, lighting and site layout substantially co ply with
the plans referenced at the end of this decision as endorsed by the Planning Board.
b) Ail artificial lighting used to illumiriate the site shall be approved by the Planning Staff.
All lighting shall have underground wiring and shall be so arranged that all direct rays
from such lighting falls entirely within the site and shall be shielded or recessed so as
not to shine upon abutting properties or streets. The site shall be reviewed by the
Planning Staff. Any changes to the approved lighting plan as may be reasonably
required by the Planning Staff shall be made at the owner's expense.
c) The building must have commercial fire sprinklers installed in accordance with the
North Andover Fire Department.
S. Prior to the:final release o security:
a) The site shall be reviewed by the Planning Staff. Any screening as may be reasonably
required by the Planning Staff will be added at the applicant's expense.
b) A final as-built plan showing the location of all on- site utilities, structures, curb cuts,
parking spaces and drainage facilities must be submitted to and reviewed by the •
Planning Staff and the Division of Public Works.
6. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan
and reviewed and approved by the Planning Staff. Any approved piles must remain covered at
all times to minimize any dust problems that may occur with adjacent properties. Any stock
piles to remain for longer than one week must be fenced off and covered.
7. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in
this decision that die within one year from the date of planting shall be replaced by the owner.
S. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation.
9. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective

10. All catch basins shall be protected and maintained during construction with hay bales to prevent
siltation into the drain lines.

11. No open burning shall be done except as is permitted during burning season under the Fire
Department regulations.
12. No underground fuel storage shall be installed except as may be allowed by Town Regulations.

Dear Mx. Lupoli,
I have reviewed the as-built plan submitted for this site. The following items must be addressed
prior to release of the full bond amount:
1. The approved plan shows 26 parking spaces. The as-built plan shows only 25 spaces. The
parking area closest to the intersection of Park Street and Main Street was designed for
compact parking spaces which are 7.5' x 16' in size. This reduced size allows five spaces to
fit into the area that is currently marked out as four spaces. This area must be re-lined for
five spaces.
2, Where is the dry well?Was it installed correctly?
3. The landscaping must be completed as shown on the approved plan. As we have previously
discussed, if you wish to alter the landscaping you must prepare a plan and bring it to the
Planning Board for review.

Per Salvitore Lupoli's request, I visited the Sal's Just Pizza site at North Andover on 6-29-99.

The purpose of the visit was to verify that all of the plants had been planted in accordance with the
specifications of the proposed revised landscape plan, including quantities, sizes, and approximate
locations of the plant materials.
All of the plants were installed except one tree, which was replaced with three junipers. T agree with
this change from the original plan and feel it does not compromise the aesthetics of the site.

Due to the recent drought, some of the plant materials appear to be wilting. I recommend watering
the plant materials on a more frequent basis.
