Dear Mr. Lupoli,
Thank you for appearing before the Planning Board last night
to discuss your proposal for adding a breezeway to the pizza
shop. The Planning Board was generally in support of the
concept.
You may need to apply for a variance from the Zoning Board
of Appeals if the breezeway extends into the required set back
area. Bob Nicetta will make that determination.
The Board also voted to approve the modification to your
special permit. This modification will be filed with the Town
Clerk once I have received the information regarding the book and
page number of your previous decision. You will need to file the
modification with the registry of deeds.
If you have any questions please do not hesitate to call me

Re: Site Plan Review - Items remaining to be completed
Dear Mr. Lupoli,
I am writing at the request of the Planning Board to review
with you certain conditions of your permit that have not yet been
completed. The following items must be addressed:
j1. A 3 ' grass strip is to be created along the edge of the
granite curbing installed along Route 125.
2 . A handicapped access ramp must be provided for access to the

building located at 490 Main Street.
3 . Two handicapped parking spaces must be delineated at 490 Main
Street and at the pizza shop. Parking spaces must be painted
for handicap parking and signs must be affixed to the building
denoting the allocated spaces. (2 handicap spaces must be
j provided at each building)
4 . The planter in front of the Barber Shop must be removed and
replaced with a with a green strap including shrubs. (it
appears as though you are currently attendi.nq to this)
5. Entering and exiting will be allowed from the parking lot onto
Main Street, eliminating the "no exit" sign requirement.
6 . The Barber shop spaces should be allocated so as to allow the
easiest access to the handicap ramp.
As Town Planner. I will oversee these conditions. I have scheduled
a discussion of your project for the January 4 , 1994 Planning Board
meeting. The Board would like you to attend if possible. The
meetings start at 7 : 00 pm and are held at the Senior Center behind
Town Hall. If you have any questions please feel free to call me at

Re: Occupancy Requirements
Dear Sal;
Please be advised that prier to your receiving an Occupancy
sign-off from my department the following conditions of your
Planning Board approval must be addressed.
2 . The curbcut which provides access to Route 125, Chickering
Road, shall be abolished prior to the issuance of a
Certificate of Occupancy. This existing curbcut shall be
replaced with granite curbing and the two parking spaces
which back out onto Route 125 shall be relocated.
4 . Prior to a Certificate of Occupancy being issued for a
structure, the structure in question shall have received all
necessary permits and approvals from the North Andover Board
of Health.
I have spoken with Mr. Fred Harney, of the Massachusetts
Department of Public Works, District 5. In order to accomplish
the work required in condition number 2, (shown above) , you are
required to receive a permit from his office. As the MDPW is
scheduling repaving of Chickering Road for the Spring of 1992 ,
any work required in the Right of Way for your restaurant must be
completed prior to this spring.

Please be advised that the Department is in receipt of a letter dated
February 3, 1992, written to you by Mr.Christian C. Huntress, North
Andover sown Planner, concerning the proposed curb cut at your new
facility. As of this date, you have failed to respond to the Town's
request to cootactthis Office. 1 must advise you of the following:
under Massachusetts General Laws, Chapter 81 , copy enclosed, any person
who builds, expands or changes use abutting a State roadway is requested
to file with this Office.
You are also reminded that any modifications to this driveway must be
taken up immediately as the Department is scheduled to resurface this
portion of Chickering Road as soon as weather conditions allow. There-
fore, it is imperative that you contact the Department Permits Engineer

SECTION_60. Section 21 of Chapter 81 of the General Laws, as so
appearing, is hereby amended by striking out the. last two sentences
and inserting in place thereof the following two paragraphs:
Any person who builds or expands a business, residential, or other
facility intending to utilize an existing access or a new access to
a State highway so as to generate a substantial increase in or impact
on traffic shall be required to obtain a permit under this section
prior to constructing or using such access. Said person may be re-
quired by the Department to install and pay for, pursuant to a permit
under this section, standard traffic control devices, pavement mark-
ings, channelization, or other highway- improvements to. facilitate
safe and efficient traffic flow, or such highway improvements may be
installed by the Department and up to one hundred per cent of the
cost of such improvements may be assessed upon such person.
The Department may issue written orders to enforce the provisions of
this section or the provisions of any permit, regulation, order, or
approval issued under this section.

Any person who violates any provision of this section or any permit,
regulation, order or approval issued thereunder (a) shall be punished
by a fine of not more than one thousand dollars per day ,for each -such
violation or (b) shall be subject to a civil penalty not to exceed one
thousand dollars per day for each such violation; provided, however,
that each day such violation occurs or continues shall be a separate
offense. The superior court shall have ,jurisdiction, upon petition
of the commissioner of the department, to enforce the provisions of
this section or of any permit, regulation, order, or approval issued
thereunder.

Dear Mr. Lupoli,
Please be informed that this office will not be recommending
that you receive a Certificate of Occupancy for the above
referenced property until the following work has been completed:
A. The curbcut which provides access to Route 125, Chickering
Road, shall be abolished. The existing curbcut shall be
replaced with granite curbing and the two parking spaces
which back out onto Route 125 shall be relocated, as per
Site Plan Review approval issued by the Planning Board on
October 11, 1991. Further, I have attached a letter
dated February 14 , 1992 from Mr. David J. Wilson,
District Highway Engineer with the Commonwealth of
Massachusetts, Dept. of Public Works. Mr. Wilson has
dictated that work on this driveway must be taken up
immediately as the Department is scheduled resurface
this portion of Chickering Road as soon as weather
conditions allow.
jB. No access will be allowed to Main Street from the
existing. parking lot. All cars will be required to exit
onto Park Street. Signs stating "NO EXIT" shall be
placed at the access to Main Street.
C. The structure in question shall have received all necessary
permits and approvals from the North Andover Board of
3 Health.
D. All lighting found within the site shall be as approved by
the Planning Board and shall not project into adjacent
properties. Prior to a Certificate 'bf Occupancy being issued
for the structure, the site shall be reviewed by the
Planning Board. Any changes to the approved lighting plan as
may be reasonably required by the Planning Board shall be

made at the owners/applicants expense.
E. All signs within the project shall be of wood, stone or

e metal, with uniform lettering and design. The signs shall in

no way be interior illuminated. (Neon or other means) The
applicant shall be required to have any final sign proposals
reviewed by the Town Planner and shall apply to the Building
Inspector for a sign permit. (Section 6. ZBL)
F. As per order of the North Andover Fire Department, the
dumpster shall be located at least 25 ' from either
structure, or as otherwise directed by the Fire Department.
G. The hashed area on the plans shall be revised to show a
landscaped island with a minimum width of eight (8) feet so
as to limit the width of the curbcut onto Main Street. The
applicant shall be required to have all landscaping approved
by the Town Planner prior to the issuance of a Certificate
of Occupancy. Due to the fact that the applicant has not
been required to submit a Landscape Plan as required under
section 8.4, the Town Planner may require minor
modifications to the landscaping at the time of occupancy.
H. A handicap access ramp shall be provided for access to the
building located at 490 Main Street.
As I anticipate your request for an Occupancy in the near
future I would like to avoid any confusion with regard to
requirements from the Town of North Andover.

I have spoken. with Mr. Salvatore Lupoli with regard to his proposed signs which he
would like to place on his restaurant located on Chickering Ave.
This property is subject to a Site Plan approval which conditioned the following with
regard to signs:
10. All signs within the project shall be of wood, stone or metal, with
uniform lettering and design. The signs shall in no way be interior
illuminated (Neon or other means). The applicant shall be required to have
any final sign proposals reviewed by the Town Planner and shall apply to
the Building Inspector for a sign permit. (Section 6. ZBQ
Mr. Lupoli has stated that he understands the intent and purpose of this condition
and that the signs shall be made of wood with exterior lighting only. As long as the final
plans are in compliance with the above condition I would see no objection from this office.

Dear Mr. Lupoli :
It has been called to the Departments attention that you have taken the
liberty to resurface the existing commercial parking lot at 476 Chickering
Road. I have been advised that members of my staff, along with representa-
tives from the North Andover Planning Department, met with you to discuss
this matter before this work was undertaken.
It was agreed by all parties at this meeting that you would retain the
grass strip throughout the entire frontage of your property. Therefore,
you must have your Contractor remove the bituminous concrete which was
installed, whereupon, four (4) inches of loam must be placed and seeded.
Failure to comply with this request will result in your permit 5-20937
being revoked and this matter turned over to our legal section for
further action.

This office has been made aware of several violations to an
approved "Site Plan Review" approval granted for the above
referenced property on October 11, 1991. Should you not respond
to these concerns within seven (7) days of receipt of this
Letter, I shall be forced to take any legal action necessary to
protect the overall public health, safety and welfare of the
inhabitants of the Town of North Andover.

The observed violations are as follows:
1. The access to Route 125 has not been properly
€ eliminated. In conversations with both this office and
the State Highway Dept. , you had stated your intention
to create a 3 ' grass strip along the granite curbing
recently installed for your occupancy of the building
located at 476 Chickering Road.
Attached you will find both a copy of my letter dated
March 16, 1992 , and a letter to you form the Mass.
Highway Dept. dated August 4, 1992 which informed you
of this requirement.
2 . To date you have failed to provide "No Exit" signs at
the parking lots access to Main Street.
3 . You have removed the planter adjacent to Main Street,
which has been required through the Site Plan review
approval.
4 . All proposed parking spaces must be properly lined and
delineated.
5. A handicapped access ramp must be provided for access
to the building located at 490 Main Street.

This is the third request that you investigate the above site for the fallowing violations
of"Site Plan Review Approval".
1. The curb-cut which provided access to Route 125 has been closed with sloping curb in
lieu of vertical curb and the required grass plot has been paved with bituminous
concrete. Because of this condition vehicles are still using this as an ingress, egress to
the parking area.
2. Parking spaces aces on the new pavement have not been designated.
3. Pavement has been removed in front of the main entrance door and not replaced,.
making it a safety hazard for the general public and impossible for disabled persons to
enter the establishment.
4. Facing 490 Main Street (Barber Shop), the grass area to the right of the building has
been removed and the area paved with bittin'inous concrete.
S. The "No Exit" signs placed at the access to Main Street have been removed.
6. "The landscape island which was untended to limit the width of the curb-cut onto Main
Street has been removed.

7. Temporary signs have been placed on the sides of the building in direct violation of the
"approved" wood sign condition. A sign permit for same has not been applied for nor
issued.

8. The handicap access ramp to the building at 490 Main Street has not been constructed.
The"Site Plan Review"authority(Planning Board)is constantly preaching their power
to set public safety rules and to promote convenience and welfare in the Town of North
Andover. Your immediate attention and action, to require the owner to correct these
violations and to comply and abide by the "Site Plan Review Approval", is appreciated.

I am writing in response to your memorandum dated August 20,
1992 with regard to the above referenced property.
Although we have discussed this property over the last few
days , I consider your memorandum as my first official
notification, and not a third.
Further, you will find attached hereto a letter from my
office to Mr. Salvatore Lupoli dated August 20, 1992 addressing
the very same concerns listed in your memorandum.
I would also like to address your remark with regard to the
Planning Board ' s "preaching" of public safety rules and
regulations. As dictated by Section 8 . 3 of the North Andover
Zoning Bylaw, as I am confident you are aware, the Planning Board
is placed with the responsibility to promote, among other things,
the public health, safety, convenience and welfare by
establishing a uniform system of review. The Planning Board does
not unnecessarily "preach" their powers. As Town employees
placed with the responsibility of enforcing all Planning Board
decisions, we should be the first to recognize this.

the following comments .
The premises will be required to have an automatic fire
alarm system consisting of manual pull stations , horn/lights,
control panel and heat detectors . This system is not required to
be connected to the municipal fire alarm system although that is
recommended .
The dumpster should be located away from the building at
least twenty five feet to avoid fire exposure to the existing
building . The dumpsters in this area have be the subject of such
vandalism.
I concur with the majority opinion of the committee that in
order to make the site more accessible the rear of the building,
which is used for storage, should be removed to allow more
access .
