• The Administrator states the abutter notification has been straightened out. The applicant's engineer has
provided a written response that is in agreement with the Commission's 3rd party peer review comments .
She questions whether the NACC would like their third-party peer reviewer to attend a meeting.

• The Commission agrees attendance of the third-party reviewer at a meeting is not required.
• Nicholas Pauling, Goldsmith Prest Ringwall,Inc. states the third party peer reviewer suggested two
conditions which they agree with. They did not renotify abutters after being provided with an updated/revised
list,they contacted 146 Main St., GSD Assoc. abutter directly.
• Linda VanDe Voorde& Gregory Smith, 146 Main Street express concerns that they were not physically
notified as well as seven additional abutters on the updated list. They would like to ensure they are considered
an abutter to the project, so they have rights of appeal.
• The Commission agrees although the list was flawed the applicant has met the threshold of the regulations by
notifying the abutters based on a certified abutters list which was obtained through the Assessor.

• Mr. Smith states their concerns have been expressed directly to the engineer. They are not opposed to the
project but how the work will be done around the historic stone building. After reviewing the materials,he
states nothing is mentioned about the building itself within the scope of work.
• The Administrator states that parking, hours of operation and safety is not jurisdictional to the Conservation
Commission wetland purview, she believes this would be the responsibility of the contractor.
• Mr. Pauling states means and methods for the project will not be determined until a contractor is selected.
• Mr. Lynch states that the Order will include a condition that requires a status report with respect to
coordination between the abutter and the contractor/applicant,but that is all. These issues are beyond the
regulatory scope of the Commission to enforce.

• Mr. Lynch makes note of a scrivener's error on the letter relative to address number.
• Bob Prokop, Wetland Consulting Services states the project consists of demolition of the existing porch and
construction of an enclosed porch, deck with new stairs. They are proposing to add an additional 3-feet to the
new porch. A waiver request has been submitted; mitigation plantings are proposed within the mowed lawn.
Erosion controls have been proposed around the entire work area. The house was constructed in 1965,prior to
the wetland regulations,work is proposed within the 25-foot NDZ and the 50-foot NBZ.
• Krisoula Varoudakis,Archadeck states the existing screen porch is unsafe. The proposal reduces the
impervious area by 40-s.f. Helical footings are proposed, no excavation is required.
• Mr. Lynch states the NACC allows in kind replacement;it is rare they would allow anything new to get closer
to the wetland regardless of the age of the house. He expresses concerns with the location of the hot tub.
• Mr. Mabon questions what they intend to do with the hot tub and if the roof runoff will discharge to an
infiltrator.
• Mr. Prokop states they propose to leave the hot tub in its current location.
• Ms. Varoudakis states the roof runoff will discharge and spread out over the lawn.
• The Commission discusses the proposal and agrees they would not be in favor of granting a waiver to
encroach into the 25-food NDZ regardless of mitigation.
• Mr. Prokop offers to provide more mitigation plantings in exchange for the waiver request.
• Mr. Manzi states additional mitigation would need to be shown on the plan for consideration.
• The Administrator states they will be going before the ZBA in September for side setback relief. Historic
aerials were reviewed, and the existing hot tub was visible in 2007.
• John Brunette,the homeowner, expresses concerns about the recent development of the area and that the
Commission is not in favor of the proposal. He offers to remove the hot tub.
• Mr. Lynch states only one of the projects was granted a waiver due to extenuating circumstances. He suggests
the consultant consider redesigning the project to prevent the footings from getting closer to the wetlands.

access. The pool equipment isn't depicted on the plan,however there is ample space at the rear of the house
outside the 50-foot NBZ.No waivers have been requested. She recommends issuing a Negative
Determination#3 with conditions.

Request for Determination of Applicability

• The Administrator states the project involves installation of a generator within an existing paver patio. The
proposed generator will receive a poured concrete pad for stability. The generator will be at least 26-feet from
the BVW at its closest point based on conservative field measurements. Other possible locations would bring
the generator closer to the wetland, in an area upslope to the wetland and requiring vegetation removal, or too
close to the roadway. The house was built in 1966 and conservation has no previous files on record. A waiver
request has been submitted.
• Mr. Mabon would like to know if any ground disturbance is required for the gas line or electrical to power the
generator.
• Mr. Awerman,the homeowner states the gas line and electrical will be above ground through the basement.
• Mr. Lynch confirms any issues with the Fire Department and Electrical Inspector have been flushed out.
• Mr. Awerman states a basement window was flagged by the Electrical Inspector; the window will be sealed
up to allow the generator to be placed in this location.
• The Commission discusses the proposal and agrees that any changes to the location will require additional
permitting.

• The Administrator provides background on the project. The survey did not pick up municipal street drainage
connections. Once the existing pipe was removed during construction,it was discovered that street drainage
was coming into the site. Options were reviewed with the Town Engineer to reestablish connection. They are
requesting a Modification to the OOC to connect a new 36-inch HDPE pipe to run through the site and
completely separate from the existing drainage, exiting through the retaining wall into a properly sized riprap
terminal apron. The Town Engineer agrees with this proposal and has requested an easement to be noted on
the plan.
• The Commission discusses the proposal.
• Phil Henry, Civil Design Group, LLC states the survey did not detect the street drainage since it was
connected to a manhole that was buried below grade. The new pipe is passed through flow, the pipe was sized
to prevent backup without significantly altering the project.
• A motion to approve the Modification and require an updated plan depicting the easement is made by Mr.
Manzi, seconded by Mr. Lynch.

• The Administrator provides background information on the project. The applicant is proposing to rotate the
pool and associated patio 90-degrees. This request moves the pool further away from the 50-foot NBZ and
moves over half of the pool outside the 100-foot Buffer Zone. The project is all within the lawn and zoning
setbacks for the house have been met. Condition#42 requiring the corner of the patio apron to be surveyed
and staked prior to work can be eliminated from the Order.
• The Commission discusses the proposal and requires a revised plan depicting an updated location for the
shed.
• The Administrator states this request can be conditioned and added to the existing Order. The plan is to be
presented at the pre-construction meeting.
• A motion to approve the Modification, strike Condition#42 and added a new Condition#42 requiring a

• Sriniketh Velagapudi,Eagle Scout Troop#76 presents a PowerPoint proposal for the Rolling Ridge,Giving
Garden Orchard pathway . The proposal consists of a new mulch path around and through the orchard as well a
shelter and covering for three beds of blueberry plants. The blueberry plant coverings will consist of eighteen 6-
foot tall arches constructed from metal conduit covered in netting. Each arch will be constructed out of a 10-foot
long and two 5-foot long conduits. The 10-foot long section will be bent using a hoop bender and the 5-foot
sections used to provide height on either side and secured with connectors. The end of each arch will be hammered
2-feet into the ground. The mulch path will be approximately 360-feet long, 3-feet wide. They propose to clear out
the weeds using a lawn mower, line trimmer and shears,cardboard will be laid and topped with mulch to create the
pathway.
• The Commission discusses the proposal and agrees the project is well thought out.
• The Administrator states the project is approximately 65-feet from the wetland.
• A motion to issue a Friendly Enforcement Order for the orchard path and blueberry protection is made by Mr.

• The Administrator provides background on the Order issued in February of 2009. Approximately 3,200-s.f. of
restoration of wetland and Buffer Zone was required in the OOC. Our Field Inspector along with the
consultant performed a site evaluation in July and found the restoration area to be well vegetated with over
75%growth. The post and rail fence with wetland markers was installed. A bluestone walkway stones set in
lawn was approved by the previous Administrator. The site is stable and in compliance.

inches below grade. Our Field Inspector confirms that the deck is located approximately 80-feet from the
BVW at its closest point. The Administrator recommends approval of the project under Category "B" with

• The Administrator states the proposal is for an in-kind deck replacement of existing decks. There are two
decks at the rear of the property outside the 50-foot NBZ. One of the rear decks will be re-decked with
composite material with the smaller rear deck being demolished and completely rebuilt. The front deck is
proposed to receive new composite deck boards. All work will be done by hand. The stockpile location will
be in the front yard and a dumpster placed in the driveway. The Administrator recommends approval of the
project under Category "B" with conditions (pre and post construction inspections and all excavated soils to
be taken off site).

• The Administrator states the contractor was unable to secure frac tanks required in the Amended Enforcement
Order issued in advance of hurricane Ida. The Administrator reports that the site held up well during the
storm. The Administrator provides a brief report on the filtering and pumping of the sediment pond which
started this past Friday. All of the berms around the top have been bolstered and a Swale established along the
westerly edge of the property to direct water away from the neighbor at#70. Blocks for the retaining wall
were delivered and rap has been installed on the access driveway. Norse is waiting to gain permission to
access the downstream site where wetland impacts occurred before they start flagging and surveying. The
Administrator believes the priority is dewatering and cleaning the sediment basin.
• Mr. Manzi would like an estimated time frame on the dewatering and reconstruction of the detention basin
and whether the basin up top is still holding water.
• William Linskey, DWT Holdings, LLC estimates the process will take approximately 5-10 days. The
detention basin water level is down approximately 1 to 2-feet.Pumping is occurring approximately 8-hours a
day with the process documented every hour by photo. Pumping will become more difficult as the water level
gets lower due to the sediment. Once the filter stops working the system shuts down. They propose moving
the entire operation up top to pump the upper basin using this same method. The bottom basin will be
reconstructed to remain as part of the design. All exposed slopes have been stabilized and blanketed,patches
will be repaired as needed.
• Mr. Lynch would like to know if they have the resources onsite to handle the upcoming storm events.
• Mr. Linskey believes they have reinforced the site to handle upcoming storm events.
• The Administrator questions if the NACC would reconsider instituting fines and having a monitor on site
during the pumping.
• The Commission discusses the Enforcement Order and agrees to allow work to continue and stay the fines.
They request the applicant attend the September 22nd meeting to provide a progress update.

• The Administrator provides background on the DOA issued at the last meeting. The project was started prior
to the pre-construction meeting. Some work and disturbance occurred in unexpected areas. All work was
stopped, and erosion controls installed. All disturbed areas are to be scarified, spread with native seed mix and
blanketed with straw by September 22nd. The majority of the work has been completed. The remaining work
will be accomplished by hand through the existing gate at the front of the house.
• Mr. Lynch questions if the work was performed prior to the phone call regarding waiving the pre-construction
meeting.
• The Field Inspector states he visited the site the day after the call was made. It is his opinion that the work
conducted would have taken approximately 1-day to complete.
• Jay Henshall, Gibraltar Pools Corp. states they were the applicant for the project. They used a subcontractor
for the installation of the pool which led to a communication error.
• Mr.Napoli states Gibraltar Pools was the responsible party to ensure the subcontractor understood a
preconstruction meeting was required prior to the start of work.
• A motion to ratify the Enforcement Order as recommended is made by Mr. McDonough, seconded by Mr.
Manzi.

• The Administrator provides background on the property. The new owner started unpermitted work that
involved the removal of trees, grading for anticipated landscaping. Additional grading toward the rear of the
house was also conducted which resulted in impacts to the 25-foot NDZ. The homeowner was directed to
cease all work and given direction to stabilize the site in anticipation of hurricane Ida. The homeowner has
been compliant with all requests thus far. The Administrator describes the forms of stabilization used on the
site. The site held up well to the hurricane and is currently stable. The homeowner has engaged a wetland
consultant to delineate the wetlands as directed in the EO. The Administrator states a survey plan will be
required to show the wetlands and limit of disturbance. A restoration plan will be required for the 25-foot
NDZ as well as a Notice of Intent for future plans.
• Tate Sahagian,the homeowner states he was unaware permitting was required for the work. He expresses
concerns with leaving unstable soil on site and requests the NACC review the proposed landscape plan that he
prepared so they may start seeding. The material used when the septic work was done is unsuitable to plant.
• The Administrator presents photos of the site prior to work being done by the previous homeowner.
• Mr. Sahagian states there was dumping in the backyard, which appears to have been going on for years.
• The Commission discusses the request and agrees no further activity is allowed until the wetlands have been
delineated and further direction is given. An Existing Conditions Plan and 25-foot NDZ Restoration Plan
must be received no later than September 22, 2021. A Notice of Intent is required to be filed within four
weeks.
• Mr. Lynch questions if the project falls under an NOI.
• The Administrator believes the filing will require more than three conditions requiring an NOT.
