HISTORY AND BACKGROUND On May 20, 2008, the applicant applied for and received approval for a Planned Development Special Permit under the requirements of the North Andover Zoning Bylaw, section 11, 10.3, 10.31 and MGL C40A, section 9, so as to allow for the construction of Phase ILA of mixed-use redevelopment which included the renovation and conversion of approximately 65,000 s.f. of existing vacant space to fifty (50) residential one and two bedroom units, the conversion of other space within the existing building to commercial uses, expansion of surface parking to add 149 new spaces, landscaping and access improvement, drainage and stormwater management improvement, and other improvements as described in "Plans" cited below. After a discussion with the Planning Board regarding a modification to those plans, the Planning Board voted unanimously to APPROVE an INSUBSTANTIAL CHANGE to the above noted Planned Development District Special Permit. At the Planning Board meeting of December 14, 2010, David Steinberg, representing RCG North Andover Mills LLC, described to the board his plans to renovate one of the mixed-use buildings on the site at 21 High St, into residential use, as opposed to commercial use, as originally specified in the Application for Definitive Plan Approval for Planned Development District (PDD) Special Permit Phase 11A. The change would allow the applicant to create 8 new residential units in a building located at 43 High Street, previously designated for commercial use. 21 High Str.—RCG North Andover Mills LLC Mal)69,Parcels I and 10 Planned Development District Special Permit(Insubstantial Change Decision) December 20,2010 FINDINGS OF FACT After review by the Planning Board on December 14, 2010, the Board determined that the re- location of the residential units to an area of the property previously designated for commercial use constitutes an "INSUBSTANTIAL CHANGE" to the original "Plans" - Planned Development District Special Permit Decision, dated May 21, 2008. CONDITIONS The Planning Board's finding of no substantial change is conditioned on the following: 1. That this Decision is recorded with the Registry of Deeds and evidence of recording is to be provided to the Planning Department. Accordingly, RCG North Andover Mills, I. may proceed with the proposed renovation project in accordance with the Site Plans referenced in the Special Permit Decision, as modified by the plan and adjustments referenced above.
