This note is in reference to the" East Mill "project in town . As you know we have discussed this project at a TRC
meeting and I have had further discussions with several of the contractors who will be working on site.As of this date , the
Fire Department has had no issues with the project as it is being developed .

The North Andover Police Department recommends favorable action on the requests by RCG
North Andover Mills LLC to make improvements to High Street as part of their special permit
request for Phase One development of North Andover Mills.
We support the improvements to the crosswalks as well as the increased parking along High
Street with the recommended one-hour time limit. We have had discussions with the applicant
and have carefully reviewed the proposals and offer our endorsement of this phase of the project.

The Town Planner and I have discussed the proposed 848
space parking facility for use at North Andover Mills and
would request that the matter be referred to the Planning
Board's site plan review prior to your approval .
This would afford town departments an opportunity to
make comment prior to the issuance of a building permit .
Also, here is a copy of chapter 1.48 section 56 which was
approved at the 1963 town meeting. If this section is applicable
the matter would also have to be brought before the licensing
commission.

SECTION 54. Dropping, etc. , Lighted Cigarettes, etc. , Penalized.
Whoever drops or throws from any vehicle while the same is upon a
public or private way running along or near forest land or open fields,
or, except as permitted by law, drops, - throws, deposits or otherwise
places in or upon forest land, any lighted cigarette, cigar, match, live
ashes or other flaming or glowing substance, or any substance or things
which in and of itself is likely to 'cause a, fire, shall be punished by a
fine of not more than one hundred dollars or by imprisonment for not
more than thirty days.
SECTION 55 . Explosive Golf Balls.
Whoever manufactures or sells or knowingly uses, or has in posses-
sion for the purpose of sale, any golf ball containing any acid, fluid,
gas or other substance tending to cause the ball to explode and to
inflict bodily injury shall for the first offence be punished by a fine
of not more than five hundred dollars, and for any subsequent.-offence by
a fine of not more than one thousand dollars or by imprisonment for not
more than one year, or both.
SECTION 56 . Licensing of Open-Air Parking Spaces; Penalty. .
In any city or town. which accepts the provisions of -this section,
no person shall engage in the business of conducting or maintaining an
open-air parking space without a license therefor granted, in the city
of Boston, by its commissioner of traffic and parking, and in any other
city or town, by the local licensing authority, approved in .all cases by
the head of the fire department. Each license granted under this sec-
tion and the application therefor shall specify all the premises to be
occupied by the licensee for the purpose of conducting the licensed
business, the total area of the space therein to be actually used for
parking or storing vehicles, and the maximum number of- vehicles to be
parked or stored in such area. The fee for each such license shall be
such amount as may be established by the ,authority granting the license,
and said authority may reasonably classify said licenses and fees.
Licenses granted hereunder shall expire vn April thirtieth following the
date of issue, or on such .date as may be specified therein, and may be
suspended or revoked by such authority and by the head- of the fire
department. Whoever, not being licensed', ' engages in a business required
by this section to be licensed, or is concerned therein, or, being
licensed, violates any condition of his license or engages in such
business, or is concerned therein, and any other place than that' desig-
nated in his license or after notice to him that his license has been
suspended or revoked, shall be punished by .a fine of not more than one
hundred dollars. The provisions of this section shall not apply to any
open-air parking space established under ,paragraph (g)- of section three
of chapter one hundred and sixty-one A or under paragraph (g) of section
six of chapter one hundred and sixty-one B and maintained or conducted
by the Massachusetts Bay Transportation Authority or by an authority
created under said chapter one hundred and sixty-one B or a lessee or
licensee thereof.

Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening, November
19, 1984 upon the petition of North Andover Mills Realty, Limited .
The hearing was advertised in the North Andover Citizen on November 1
and 8, 1984 and all abutteis were notified by regular mail . The
following members were present anti voting: Frank Serio, Jr . , Chairman;
William J . Sullivan; Augustine 4'. Nickerson; -and Associate Members
Walter F. Soule and Maurice S. Fou.lds .
The petitioner seeks a Special. Permit under Se Nion 4, Paragraph 4. 11
( 3) of the Zoning By Law so as to permit thf extension of an
:industrial--S ( I--S) zone into a Residential-4 (f -4) zone to allow the
construction of a one level parking Aedk on prclises Located at 38 High
Street .
The project engineer testified that ' the parcel is the site of the
former Davis and Furber Machine Company. :he premises are being
renovated and the applicant proposes to e. ter the zoning line
approximately fifteen feet ( 15 ' ) Jnto 'the R-4 di.:�trict to allow the
construction of a one level parking deck . This proposal will be
aesthetic'aLly more pleasing to the surrounding neighborhood as opposed
to a three level_ deck which could be constructed under the Zoning By
Law.
Upon a motion made by Mr . foulds and seconded by Mr . Soule, the Board
voted unanimously to grant the, Special Permit with the following
conditions : ,.
1 . That all. Lighting be down lighting .
2. That the structure be .restricted to , no more than a total of
two ( 2 ) levels (ground level plus one) .
3 . That the remaining arQa in .the R-4 district be open and green,
suitadLy Landscaped, not built upon, unpavel, and not parked
upon .

In granting the Special,.,..Permit , the Board f- ads that Section 10. 31 of
the Zoning By Law has been satisfied . IS partioilar , the Board finds
that the specific site, being a mill in the process of extensive
renovation, is an appropriate location for such a structure; that the
use of a one :Level deck will not adversely affect the neighborhood,
where a three level deck 'would; that there will, be no nuisance or
serious hazawd to vehicles or pedestrians ; and that adequate and
- - appropriate facilities will be provided for the proper operation of the
proposed use .
