SELECT BOARD MINUTES SEPTEMBER 27, 2021
Call to Order: Chairperson Laura Bates called the meeting to order at 7:00PM in the Town Hall Select Board Meeting
Room. The open session meeting was recorded.
Attendance: Chair Laura Bates, Janice Phillips, Clerk Rosemary Smedile, Richard Vaillancourt, Chris Nobile, Town
Manager Melissa Murphy Rodrigues, Director of Administrative Services Laurie Burzlaff and Deputy Town Manger Denise
Casey were present.
Public Comment
1) Peter D’Angelo, 126 Meeting House Road, stated issues with curbing and sidewalks on North Main Street. Stated
one side was completed and the other side was not. Next, stated issue with burying the telephone lines because it
has not been completed as well as an issue with unified signage ordinance in the Downtown area. Proposed that a
low interest loan could be offered as a solution that could be given to store owners so that they can upgrade their
storefronts.
Recognition of Angel Flight NE
Ms. Bates recognized Angel Flight NE for their donation of free flights to families in need. Recognized for 25 years of
service.
PUBLIC HEARING- Joint petition from National Grid and Verizon New England to install pole on Sutton
Street
MOTION: Mr. Vaillancourt motioned to open the public hearing for the petition of National Grid and Verizon New England
for a joint pole located on Sutton Street. Ms. Phillips seconded. Motion approved 5-0.
David Boucher of National Grid was present at the meeting and explained the new device feeder monitor that measures
electricity to help with reliability at substations. Mr. Vaillancourt asked if there are any residences in the area. Mr. Boucher
stated there are many businesses in the area. Ms. Smedile asked if there would be any business interruption. Mr. Boucher
stated no, there should not be. Ms. Phillips asked how long of a process it is. Mr. Boucher stated about ½ a day to set the
pole. Ms. Bates asked if it can be remotely monitored. Mr. Boucher stated yes.
MOTION: Mr. Vaillancourt motioned to close the public hearing for the petition of National Grid and Verizon New England
for a joint pole located on Sutton Street. Ms. Smedile seconded. Motion approved 5-0.
Vote on joint pole petition from National Grid and Verizon New England-Sutton Street
MOTION: Mr. Nobile motioned to approve the petition of National Grid and Verizon New England-#30373447, subject to
the conditions contained in the proposed order as presented and include notification to the affected business in the area. Ms.
Phillips seconded. Motion approved 5-0.
Request of the Festival Committee to hang banners at the Town Common, High Street and
Main Street from January 1, 2022-December 31, 2022

Ms. Smedile gave an overview of the banners to be hung in celebration of the 375 year. Flags would be put up after
Veterans Day until May 2022 for the celebration. Ms. Bates asked if the holiday wreaths are a part of the program. Ms.
Smedile stated yes.
MOTION: Mr. Nobile motioned to approve the request of the Festival Committee to hang 375th Anniversary Banners at the
Town Common, High Street and Main Street from November 2021 through May 31, 2022. Mr. Vaillancourt seconded.
Motion approved 5-0.
Set Fiscal Year 2023 goals

Ms. Rodrigues went over the list of goals that each Select Board member would like to focus on. Ms. Rodrigues stated there
will be no vote at this meeting.
Town Manager Evaluation
MOTION: Mr. Vaillancourt moved approve the annual performance evaluation of Town Manager Melissa Murphy-
Rodrigues. Mr. Nobile seconded. Motion approved 5-0.
Request of Affordable Housing Trust for approval to disburse $100,000 from the Affordable Housing Trust Fund for
a Down Payment Assistance Program
Mr. Vaillancourt explained the program for down payment assistance for the first time home buyer.
MOTION: Mr. Nobile motioned to approve the disbursement of $100,000 from the Affordable Housing Trust Fund for a
Down Payment Assistance Program. Ms. Phillips seconded. Motion approved 5-0.

1. Maya Chin- Commission for Diversity, Equity and Inclusion
2. Courtney Igbinosa- Patriotic Observance Committee
3. Walter Mena- Commission for Diversity, Equity and Inclusion
4. Frank Ragonese- Elderly and Disabled Taxation Fund Committee
5. Scott Patrick Lane- Emergency Management
6. Bernard Zelitch- Neighborhood Conservation District Commission (Machine Shop
Village)
MOTION: Mr. Nobile motioned to appoint Maya Chin and Walter Mena to the Commission for Diversity, Equity and
Inclusion, Courtney Igbinosa to the Patriotic Observance Committee, Frank Ragonese to the Elderly and Disabled Taxation
Fund Committee, Bernard Zelitch to the Neighborhood Conservation District Commission, all through June 30, 2023; and
Scott Patrick Lane to Emergency Management through June 30, 2022. Mr. Vaillancourt seconded. Motion approved 5-0.
LICENSING
MOTION: Mr. Vaillancourt motioned to open a meeting of the North Andover Licensing Commission. Mr. Nobile seconded.
Motion approved 5-0.
PUBLIC HEARING-Application from Joshua Webber of Fireside Catering, LLC for an All Alcohol on
Premises Restaurant Liquor License at 723 Osgood Street
Ms. Rodrigues stated Humara Brady will be the manager of the Stevens Estate for the next 33 days.
MOTION: Mr. Vaillancourt motioned to open the public hearing for the application of Joshua Webber of Fireside Catering,
LLC for an All Alcohol on Premises Restaurant Liquor License at 723 Osgood Street. Ms. Phillips seconded. Motion
approved 5-0.
Ms. Bates asked if there will be an overlap in license. Ms. Rodrigues stated yes, the Town’s liquor license will be released
once Fireside Catering obtains their license. There was no public comment.
MOTION: Mr. Vaillancourt motioned to close the public hearing for the application of Joshua Webber of Fireside Catering,
LLC for an All Alcohol on Premises Restaurant Liquor License at 723 Osgood Street. Ms. Phillips seconded. Motion
approved 5-0.

MOTION: Mr. Vaillancourt motioned that the Select Board, acting as licensing commissioners to approve the application
from Joshua Webber of Fireside Catering, LLC for an All Alcohol on Premises Restaurant Liquor License at 723 Osgood
Street. Ms. Smedile seconded. Motion approved 5-0.
Application of Joshua Webber of Fireside Catering, LLC for a Common Victualler License and
Entertainment License at 723 Osgood Street
Ms. Burzlaff stated a call was received from an abutter stating to move the speaker away from his home.
MOTION: Mr. Vaillancourt motioned that the Select Board, acting as licensing commissioners approve the application from
Joshua Webber of Fireside Catering, LLC for Common Victualler License and Entertainment License at 723 Osgood Street.
Ms. Smedile seconded. Motion approved 5-0.
Application from Tricia Dunphy of Smolak Farms for six (6) one day wine and malt licenses for Fall Festivals in the
Farm Stand Tent on October 2nd, 3rd, 9th, 10th, 16th and 17th from 10:00AM to 4:00PM and request to waive the
police detail
Deb Ingalls of Butlers and Bars represented Tricia Dunphy. Mr. Vaillancourt asked how many people are expected and why
the request for the police detail to be waived. Ms. Ingalls stated the crowd control is done by Smolak Farms and already has
a police detail in place for traffic.
MOTION: Ms. Phillips motioned that the Select Board, acting as licensing commissioners approve the applications from
Tricia Dunphy of Smolak Farms for six one day wine and malt liquor licenses for the Fall Festivals held in the Farm Stand
tent on October 2nd, 3rd, 9th, 10th, 16th and 17th from 10:00AM to 4:00PM and further move to waive the police detail for
all events. Ms. Bates seconded. Motion approved 5-0.
Application from Deborah Ingalls of Butlers and Bars for six (6) one day all alcohol licenses for wedding receptions in
the large event tent and waiver of police details on October 2nd, 8th and 15th from 5:00PM to 10:00PM, October 9th
from 4:00PM to 10:00PM and October 16th and 23rd from 4:30PM to 10:00PM
MOTION: Ms. Bates motioned that the Select Board, acting as licensing commissioners approve the applications from
Deborah Ingalls of Butlers and Bars for six one day all alcohol liquor licenses for wedding receptions in the large event tent
on October 2nd, 8th and 15th from 5:00PM to 10:00PM, October 9th from 4:00PM to 10:00PM and October 16th and 23rd
from 4:30PM to 10:00PM and further move to waive the police detail for all events.”. Ms. Phillips seconded. Motion
approved 5-0.
Application from 99 Restaurants of Boston, LLC for a change of Officers at 267 Chickering Road
MOTION: Ms. Phillips motioned that the Select Board, acting as licensing approve the application from 99 Restaurants of
Boston, LLC for a change of Officers at 267 Chickering Road. Ms. Bates seconded. Motion approved 5-0.

267 Chickering Road.”. Ms. Bates seconded. Motion approved 5-0.
MOTION: Ms. Smedile motioned to close a meeting of the North Andover Licensing Commission. Ms. Bates seconded.
Motion approved 5-0.
Select Board meeting schedule-January –June 2022
Ms. Bates asked the Select Board to move the 4/25/22 meeting date to another date.

MOTION: Mr. Vaillancourt motioned to move that the Select Board approve and accept all consent items. Mr. Nobile
seconded. Motion approved 5-0.
APPROVAL OF OPEN SESSION MINUTES OF SEPTEMBER 13, 2021
MOTION: Mr. Nobile motioned to approve the Open Session minutes of September 13, 2021. Ms. Phillips seconded. Motion
approved 5-0.
TOWN MANAGER’S REPORT
Ms. Rodrigues gave the following report:
- Update on Steven’s Estate transition. Ms. Smedile asked Ms. Rodrigues if Holly Days would still be happening.
Fireside Catering is trying to do it next year instead of this year due to the transition. Ms. Bates asked the date of the
transition is on 10/15. Ms. Rodrigues stated yes, 10/15.
- Ms. Rodrigues went over the Black History Month project with residents Tina Klein and Lynn Wentzel. Ms.
Rodrigues stated the Cultural Council applications have been sent out which will help with funding.
- Certified $12.9 million in free cash

- Hazardous Waste Day is set for October 9
- Lake Cleanup Day is on October 16th

- Ms. Phillips spoke about the recent Fall Festival

- Ms. Smedile mentioned the Artisan Market is coming soon
ADJOURNMENT
MOTION: Mr. Nobile made a MOTION, seconded by Ms. Phillips to adjourn the meeting at 8:27PM. Motion approved 5-0.
