The projFct is located at 562 Boxford Street. The applicant has requested variances from the Town of North Andover Board of Health Rules and Regulations due to the presence of Bordering Vegetated Wetlands on-site and the size of the lot. The following variances were requested: • Table 1 -Setback Distance Table. A variance is requested to reduce the required setback between a primary leaching area and a wetland resource area. Below is my same comment from the previous review about the variances: The larger item to take into consideration for yourself and the BOH would be whether or not the applicant has satisfied the requirements of section 8.1 to receive approval for the variances for new construction as requested.The designer has indicated on the plan that the required setbacks cannot be met due to the existing location of the well and wetland which is true. The question to consider would be, does the existing conventional septic system establish a level of public health and environmental protection that is at least equivalent to that provided under the BOH regulations?The BOH may wish to consider asking for a secondary treatment unit to achieve this equivalent level of public health and environmental protection.We are available to discuss this topic further with yourself and/or BOH members as desired. Abutters have been added to the design plan. 2. A variance has been requested to reduce the required 50' setback between a building sewer and private well to 42' 3. A variance has been requested to reduce the required 100'setback between a reserve leach field and wetlands to 51'. 4. See attached letter. 5. The existing contour lines have been labeled. 6. Note 16 has been added to address the abandonment of the existing septic system. 7. Note 8 has been revised. 8. The location and elevation of the foundation drain have been provided. 9. The inspection port was added to the plan view. 10. The breakout elevation was added to the profile. A breakout protection barrier is proposed around the majority of the system. The only portion of the system which does not contain a barrier is the beginning of the trenches. The breakout elevation was added at this location of the profile. The breakout elevation is an odd number. Adding an odd contour on plan view would cause confusion and is not necessary. 11. The leaching trench detail was revised to specify"double"washed stone. 12. The distribution box has been revised to accommodate H-20 loading. 13. Buoyancy calculations have been provided. 14. The number of dosing cycles has been added to the pump chamber detail. 15. The drain back volumes was recalculated to be 3.6 gallons. 16. The distance between the pump floats has been provided in inches. Elevations have been provided previously. We would like to note this comment is not required under the regulations. 17. The ESHWT has been added to the profile in the location of the septic tank and pump chamber. The tank and pump chamber were raised to be above the ESHWT. 18. An effluent filter has been provided. 19. The proposed grading within F of the property line is at a lower elevation than the abutting property. The grading will not prevent the runoff from flowing onto the property. A swale has been provided where the grading ties in to the existing contours. Due to comments received from the Conservation Commission, we have also made the following modifications: • An additional wet flag was added which required the septic tank and pump chamber to be shifted slightly to the west. • The size of the dwelling was reduced and the location of the foundation drain was modified. I would encourage this to at least go to a hearing before the Board of Health for a hearing with abutter notification, etc. Alternatively, I would encourage the applicant to consider the standards that are already established in the regulations in Section 3.8 which allow this type of scenario to go through without a hearing if they use a DEP- approved pre-treatment system to reduce wastewater pollutant levels below 30 mg/L BOD &TSS. If I can assist you or the board further on this matter please do not hesitate to inquire. Unfortunately, the plan cannot be approved until the following items are corrected. The specific section in Title 5: 310 CMR 15.000, or North Andover regulation that is not met by this design follows each item where applicable. 1. Abutters from the most recent tax map were not depicted on the design plan(NA 3.2). 2. A variance request is required to propose a building sewer line less than 50' to a private well(NA 3.2). 3. The variance request for the reduced setback from the leaching area to the wetland resource area should indicate the distance from the reserve area(5 1') as well as the primary area(55'). 4. Please be prepared to explain the need for the variance(s)request to the Board of Health at a public meeting, specifically as it relates to NA section 8.1. 5. On sheet 1 of 2,the existing contour lines were not labeled. 6. Proper abandonment of the existing septic system should be noted on the design plan (310 CMR 15.354 &NA 3.2). 7. On sheet 1 of 2, General note#8 is incorrect. 8. On sheet 1 of 2,the foundation drain location is not indicated and the elevation is not shown on the design plan(NA 3.2). 9. The inspection port location was not shown on the design plan(310 CMR 15.240(13)). The breakout elevation for the leach area is not depicted on the design plan. 11. On sheet 1 of 2,the leach trench detail does not depict double washed stone(310 CMR 15.247). 12. The distribution box is required to be H-20 loading(NA 3.2). 13. Based on the soil testing results, it appears the bottom of septic tank and pump chamber will be below the ESHWT. Therefore, buoyancy calculations are required(310 CMR 15.221(8)). 14. On sheet 2 of 2,the number of dosing cycles were not depicted(310 CMR 15.220(4)(r)). 15. On sheet 2 of 2, it appears the drain back volume for the 2"force main of 1.6 gallons is incorrect. Approximately 3.4 gallons appears to be the correct drain back volume. 16. On sheet 2 of 2, In the pump chamber detail please indicate the distances between the pump floats in inches to better assist the installer during construction. 17. Please indicate the ESHWT in the location of the septic tank and pump chamber in order to confirm the inlets and outlets are above the ESHWT(310 CMR 15.227(5)). 18.
