Dear Mr. Lawless:
This letter concerns the application by the Town of North Andover
under Section 10 of the Rivers and Harbors Act of 1899 and Section
404 of the Clean Water Act for a permit to dredge 27 cubic yards of
material and place 112 cubic yards of fill below ordinary high
water into the Merrimack River off Riverview Street in North
Andover, Massachusetts. The dredge and fill activities are
associated with the proposed construction of a 17 ' x 80' boat ramp.
The public notice states that a roadway will be constructed off
Riverview Street to access the boat ramp. Jhe primary purpose of
the project is to provide emergency access 'to the Merrimack River
for the Town's Fire Department. At ,t`his time, EPA requests
additional information to determine if,phis project complies with
the 404 (b) (1) guidelines.
The public notice for this project does not appear to describe the
project purpose adequately. For example, the public notice state
that "the primary purpose of the project is to provide emergency
access to the Merrimack River. " Elsewhere, the boat ramp is
described as "a 17 ' x 80' concrete public boat launching ramp. In
addition to the access roadway, the site plans on sheets labeled 113
of 10" and 114 of 10" depict an additional roadway loot and 12
parking spaces proposed for the area. These plans appear to depict
a larger development scheme for this site than an emergency boat
launch ramp. EPA requests clarification of the project purpose for
this site.
The Merrimack River is the second largest drinking water source in
Massachusetts. In part, because of water quality concerns in the
Merrimack basin, EPA designated the Merrimack River as a priority
waterbody needing protection as described in EPA's Priority
Wetlands in New England (September, 1987) . Further, EPA has begun
work on the Merrimack River Initiative, calling for river corridor
protection to improve the water quality of Merrimack. EPA is
concerned with the adverse impacts this project might have on the
water quality of the already stressed Merrimack River. These
concerns stem from the proposed destruction of the diverse upland sr.
vegetation for construction of access roadways and parking areaE;q.—

proposed for this site. This densely vegetated corridor area not
only provides high quality wildlife habitat but also provides a
natural buffer which helps to minimize non-point sources of
pollution in the Merrimack River. In addition, EPA is concerned
with water quality impacts which will arise from the introduction
of oil grease, road salt, etc. from these paved surfaces. EPA
requests the applicant provide information which address water
quality concerns and submit a comprehensive stormwater runoff
management plan for our review.
Section 230 . 10 (a) of the 404 (b) (1) guidelines requires that no
discharge of fill material shall be permitted if there is a less
environmentally damaging practicable alternative which satisfies
the basic project purpose. If the project purpose is to provide
for emergency boat launching facilities for the Towns' Fire
Department then it is not clear why the boat ramp could not be
located at the end of North Main Street. North Main Street dead
ends near the River's edge and is located less then 1, 000 feet up
river from the applicant's proposed site. This area is already
disturbed and requires far less destruction of natural vegetation.
Moreover, the North Main Street location would appear to provide
for a quicker access route to the River than the proposed site.
EPA requests the applicant submit an alternatives analysis showing
why this North Main Street location is impracticable.
In summary, EPA requests the Corps clarify the project purpose. In
addition, we request an alternatives analysis for the location of
the proposed boat ramp and information which addresses water
quality concerns associated with the proposed project. Until we
have had the opportunity to review this information we can not
advise - as to this projects compliance with 230. 10 (a) of the
404 (b) (1) guidelines. This application should be held in abeyance
pending a review of this additional information.

The Town of North Andover and Kimball Chase Co. Inc. are in receipt of your
letter regarding public comment on the Riverview Street Boat Ramp permit application
(CENED-OD-R-21-199100898). We would like to take this opportunity to directly respond
to the concerns raised in your letter.
First, regarding an alternatives analysis for the end of North Main Street. An
exhaustive alternatives analysis was conducted by the Town of North Andover many years
ago as a rep-requisite to land acquisition (See attached copy). Although North Andover
enjoys 3 miles of Merrimack River frontage, most of that frontage is cut off by an active
AMTRAK line parallel to the river and large tracts of developed industrial land. Only a
very small area of accessible available land in North Andover actually fronts on the river.
The end of North Main Street you mentioned as an alternative was previously considered.
This land was deemed unusable for various reasons. The land is owned by the Greater
Lawrence Sanitary'District (GLSD) who maintain a major sewer line under that site. The
GLSD will not allow construction of any facilities on that land since this could disturb the
sewer line. This line feeds an adjacent pump station. The presence of the pump station,

turn-around space or other appurtenances. We therefore sought vacant land not
encumbered by such constraints and purchased the land nod` proposed as the site for the

boat ramp. This land was not only one of the last remaining vacant parcels, but depth
soundings in the river showed that deeper water was found not far from the bank. Deeper
water near shore is a major limiting factor for this project. The North Main Street site has
much shallower water and is unacceptable during low water.
Second, the purpose of this proposed project is both emergency and recreational
access. The boat ramp was initially intended to allow emergency access for the Fire
Department. Based on input from the public and from the Commonwealth of
Massachusetts Division of Conservation Services, who funded land acquisition through a
grant, the project will allow both emergency and recreational access. By accepting the
Commonwealth's grant for land acquisition, the Town of North Andover is now compelled
to allow recreational access and we fully support this condition.

Third, you question the need for such a "large" parking area. We do not consider
a parking lot for 12 cars "large" by any calculation. Certainly a private project of this nature
would have far more parking spaces and increased environmental impact. We have
received some criticism by sportsmen for such a "small" parking area. As stated above, the
Town of North Andover received a grant from the Commonwealth of Massachusetts to
purchase the property to build the proposed project. Our grant application stated that a
parking area for 10 to 15 cars would be constructed. We do not feel that it would be
possible (or appropriate) to change our plans now that public funds have been spent on
land acquisition. The Merrimack River is a large river with no suitable public access for
several miles. A smaller parking area would be out of scale with the size of the river and
its potential for use. Any overflow would quickly impact the adjacent residential area.
Twelve car spaces is the most we felt such a small site could contain and balance the need
for recreational/emergency access,while minimizing environmental' and residential impacts.
Also, the Massachusetts Public Access Board asked us to increase the size of the lot from
10 to 12 spaces during their review. We complied with this reasonable request. If you
would like to shrink the lot back to 10 spaces we suggest you contact the Public Access
Board and express your concerns. If they are in agreement we will alter our design
accordingly, but we do not see the need for such discussion since the impacts of 10 vs. 12
spaces is minimal and we will not pursue the project with less than 10 spaces.
Fourth, a copy of the stormwater runoff plan is included for your review. This plan
was reviewed and approved by both the local Conservation Commission and Planning Board
during their review processes.
Finally, regarding the comments of Mr. Albert A. Gammal of FEMA. Our
Engineers, Kimball Chase Co. Inc., are now in contact with representatives of FEMA.
Kimball Chase Co. will provide FEMA with all necessary information regarding compliance
with the federal regulations cited in Mr. Gammal's letter. We are confident that the project
as designed meets all the appropriate regulations.
We hope the above comments address all the pertinent points in your letter. If you
are in need of any additional information, please do not hesitate to contact the North

As you know, my office has been pursuing a boat ramp on the
Merrimack River adjacent to the GLSD pump station on Riverview
St. in North Andover. We had discussed, and the GLSD board had
su1:ri.)rted, the transfer of a small parcel of land from the GLSD
to the Town of North Andover for the boat ramp project. It has
taken much longer than we had anticipated to obtain all the
necessary permits. our final permit, from the. Corps of
Engineers, should be in hand very shortly.
I would now like to pursue the land transfer so that we can
finalize our plans for the boat ramp. I would like our attorneys
to discuss the procedure to complete this transfer. I ,would
appreciate it if your attorney would contact my office so that
this process can be initiated. I look forward to working with
you.

The corps of Engineers has recently forwarded their permit for the
Boat Ramp. This is the last permit required for this project which
required two local permits, two state permits and the Corps of
Engineers permit. A representative of the Town of North Andover
needs to sign the Corps permit and return one copy.
The project has not changed since it was approved by the
Conservation Commission and the Planning Board. I Hope to begin
cleaning up the site this winter and constructing some of the
parking and picnicking facilities this year. I will be filing for
grants in 1993 to construct the ramp in 1994 . The construction of
the ramp may be delayed to receive grant monies since we do not
have sufficient local funds to construct it at this time.

Dear Mr. Lawless:
Enclosed is a signed copy of the Department of the Army permit
for the Boat Ramp on the Merrimack River in North Andover MA. A
signed copy is being returned to you as required.
I would like to take this opportunity to express to you some
serious concerns I have regarding the permitting functions of your
Division. I have been responsible for administering both local and
state wetlands regulations here in North Andover for almost 4
years. It has now taken well over 2 years to receive a Corps
permit for the North Andover boat ramp. During the permitting
process I have found the Corps permit process to be so unwieldy,
and its staff so unresponsive, as to constitute a disservice to the
public. If I were not a public servant, and a regulator myself, I
would most likely have withdrawn my permit request and constructed
the project without a permit. I now understand why such violations
exist. While there is no good excuse to ignore the law, I now
understand why some people chose to do so.
While I fully understand the complexities and difficulties of
regulatory responsibilities, I cannot understand why the Department
of the Army can let such a situation continue. I certainly hope
that the permit process flows more smoothly and is managed better,
by more qualified and responsive staff, in other regions of the
country.

Dear Sirs/Madam:
This letter is being submitted as the first .progress report
and construction sequence for the North Andover Boat Ramp as
required by the Order of Conditions (OOC) and as a request for
Modification of the OOC. I would like to discuss this matter
further at the commission's meeting of January 6, 1993 .
No work has begun on the project but the final permit, from
the U.S.Army Corps of Engineers, has just been obtained. Since
there are not enough funds to construct the boat ramp project, I do
not anticipate construction of the ramp itself until we either
obtain grant money or petition the Town to fund it. We do have
funds to complete all or a large portion of the access roadway and
landscaping. With this in mind, I would like to suggest that the
project be segmented as follows:
Winter 1992-93
Record permits, flag no-cut zone, cut trees and brush in remainder
of site, clear debris from site - all using Town employees and
volunteers.
Sprina/Summer 1993
Construct road base, install binder coat of pavement, complete the
portion of landscaping which screens the site from the neighbors.
If this work is completed with Town employees no bond will be
posted. If not, half the bond ($5000) will be posted.
1994
post full bond ($10,000) , Construct the ramp itself, complete
roadway and landscaping.'

Dear Riverview St, Resident:
This letter is to inform you of the status of the Merrimack River Boat Ramp project.
The Town of North Andover has recently obtained the final permit for this project from the
US Army Corps of Engineers. We will be seeking grant money from the state and federal
government to construct the ramp itself. Some preliminary work may begin very soon. This
may include surveying, removal of debris and tree cutting. This work will be done by town
employees and volunteers. Some of this may be done on weekends since that is when we can
get volunteers from our local trail committee.
Riverview Street will be receiving a new water line and new pavement this year.
Construction of the parking for the boat ramp and some landscaping may also take place this
year if the town has the funds and resources to do the work. The ramp itself will require
additional funds and will probably not be done until 1994 or later. If you have any questions
about the water line or repaving you should contact the DPW. Any questions about the Boat
Ramp should be directed to me. You will be notified by this office before any heavy
construction activity is begun on the Boat Ramp.

Dear Riverview street Resident:
I would like to inform you of a meeting that has been
scheduled for Wednesday, March 24 at 7: 30pm at the High School AV
Studio. The purpose of this meeting is to provide local residents
and interested parties with an update on the status of the
Riverview Street Boat Ramp Project.
We have been informed that the State Public Access Board is
willing to fund this project entirely. The State Public Access
Board will require a minimum of 6 parking spaces for trailered
boats as a condition of the grant. Based on recent discussions
with our engineers, representatives of the Public Access Board and
the Town of North Andover, we are planning to make the necessary
roadway and traffic improvements so that this will not be a burden
on the local neighborhood. Riverview Street will be widened and
repaved and traffic signs will be added.
If you have any questions or comments on this project please
do not hesitate to contact me or attend the meeting on the 24th.

RE : Merrimack River Boat Ramp
Thank you for the opportunity to meet with the Selectmen on May 17 ,
1993 to discuss the Merrimack River Boat Ramp. I will be
presenting a brief update of the project and our projected
timetable for construction. Mr. Jack Sheppard, Chief Engineer and
Director of the State Public Access Board will also be on hand to
discuss his involvement. The Public Access Board has committed to
build the Boat Ramp for us at no cost to the Town of North Andover.
While there is widespread public support for this project, . it is
not without some controversy. Residents of Riverview Street, where
the ramp is proposed, have objected to the current design which
includes 6 parking spaces for trailered boats. They are concerned
that this will negatively impact their neighborhood. These
trailered parking spaces are a requirement to obtain funding from
the Access Board. I have met with the neighbors, the DPW and our
design engineers from Kimball Chase Inc. to plan for the necessary
site, roadway and traffic improvements to minimize the impacts on
the neighborhood. We are planning to install the necessary traffic
signage and will delineate "Resident Only 11 parking areas as well
as "No Parking" areas. We will also screen the boat ramp with
heavy landscaping. We will make whatever other improvements the
neighborhood can identify which will make this project more
acceptable to them but the removal of these trailer parking spaces
is not an option if we are to obtain state funding.
Mr. Sheppard, Fire Chief Dolan and myself will be on hand to
discuss this project and to answer any questions you may have.

RE : Boat Ramp
Attached you will find some information regarding the original
state grant for the boat ramp as requested at our last meeting on
this subject. Also attached is a revised cost estimate by Norm
Cote of Kimball Chase Inc. As you can see, the revised cost
estimate is essentially the same as the original and the potential
elimination of trailered boats will have a negligible impact on the
total project cost.
I believe the boat ramp as it stands now is a viable project and
one that the community sorely needs. The project' s merits have
been discussed in detail for many years. I do not feel that
revisiting these issues once again will be productive. It has
taken many people a great deal of time and money to get to this
point. While I am sensitive to the neighborhood issues, these must
be weighed against the greater public good. I strongly recommend
that we move ahead on the construction phase of this project
immediately. If we do not move ahead now I fear that the project
will never get built.

Re: Boat Ramp
The members of the Planning Board respectfully request
information pertaining to the Boat Ramp issue. At the beginning
of May the Board received a letter from you stating that you
would pursue this issue in the coming fiscal year. As such the
Board requests that you outline the steps you will take to seek
funding for this project. The Board is willing to help in any
manner feasible to facilitate the resolution of this matter. As
the Board has issued site plan approval for this project any
changes must come back before the Board for review prior to any
construction.
