This project will be brought before the Conservation Commission and the Planning Board very soon. As part of our site planning for this project we would like to discuss the following issues at your earliest convenience: 1. Our access is restricted by a stream to the north and a GLSD easement to the south. Our access drive may damage one large tree on the site unless it can be located a few feet onto the easement. If this is agreeable a relocation or reconfiguration of the easement will be necessary. 2 . We would like to conduct a thorough cleanup of the site and conduct selective thinning of vegetation to enhance the site's aesthetic qualities. Ideally, this would require vegetative thinning on GLSD property along our common boundary. We will need your permission to accomplish this. 3 . Visitors to the boat ramp could, from time to time, utilize the property for picnicking and other such forms of recreation. A new Notice will be filed within 30 days. This request is being forwarded to the No. Andover Conservation Commission, DEP and the Corps. Once local permits are in hand, we will proceed with the Corps permitting procedure and any other necessary procedures. We have preliminary indications from the State Public Access Board that 50% funding for construction may be available if contracts can be issued prior to June 30, 1991. My goal is to achieve all necessary permits by that date. I realize that the timetable is very tight. Division, Corps of Engineers 424 Trapelo Road Waltham MA 02254 Re m 23-88--1323 North Andover Boat Ramp Dear Ms. Adams This letter is to update you on the progress of the design/engineering phase of the North Andover Boat Ramp on the Merrimack River. Please see the enclosed schematic which is our current plan. This design has incorporated a recent survey showing an extreme low water elevation and mature vegetation along the bank. Much less bank disturbance is required with the latest plan. We can preserve all but one mature tree along the bank with this design and feel confident that this meets those related concerns of your March 6 letter. We have met recently with the State Public Access Board regarding technical assistance and partial funding and are pleased with the input received. This current schematic has been reviewed by Town staff and will be presented in an informal neighborhood meeting to be held on September 19 . This plan will be reviewed by the Board of Selectmen in September as well. I anticipate further input from the State Public Access Board, review by the local Planning Board through Site Plan Review, review by Town staff through the Technical Review Committee, and a re--opening of the public hearing with the Conservation Commission regarding the Notice of Intent. I hope to accomplish these steps in the months of September and October. Updated designs as well as construction estimates will be required along the way during the local review process. When all local permits are in hand, I anticipate state and federal permits can proceed soon thereafter. At that point, our plans and documents can be submitted to you in the appropriate format for your review. There has been some mis-communication between our respective offices in the past. To ensure that our files are current, please be advised that I am in receipt of correspondence from your office dated January 12, 1990 and March 6, 1990. You should be in possession of correspondence from me dated February 15, May 8 and June 7 of this year. Please review the enclosed plans and the previous documentation. Please contact my office if you have any input on our direction or current plans. I do not wish to expend public funds on this project if we are proceeding in a direction which you foresee as potentially unproductive. The GLSD Riverview St. pump station is our neighbor to the south. The natural topography of the land is such that the boat ramp and/or some pavement could best be located along our southern border or slightly over the border on the GLSD property. Before we progress further and incur additional design costs, I would like to get a sense from the GLSD if any possibility exists for an easement or swap of land so that the boat ramp could be constructed in the most environmentally sensitive manner. Please see the attached plan. The GLSD property in question is highlighted in green. This boat ramp is to be located on Town property adjacent to the GLSD pump station on Riverview St. Revised plans for this facility have recently been submitted by our engineering firm and I would like to share these preliminary plans with local residents to receive their input. These plans differ somewhat from the previous plans. An informational meeting will be held on Wednesday, September 19, 1990 from 6pm to 7pm in Town Hall. Please feel free to attend. If you cannot attend this meeting, please be advised that there will be ample opportunity for public input as this project will require permits from the Conservation Commission, Planning Board, the Department of Environmental Protection and the U.S. Army Corps of Engineers. I have attempted to reach Ms. Karen Kochenbach as suggested in the letter but have been unable to reach her. Your letter states that additional information on this file was requested in 1988 and not received. Due to this lack of information or correspondence, the file on this project has been closed and we must refile for a new permit. Your letter also states that this closing is due to the fact that you "have not received the requested information or any correspondence indicating (our) intention concerning this matter" . This is not completely accurate. I received a phone call a few months ago from (I believe) a representative of your office seeking information regarding our intent to continue with the project in question. I told her that I intended to pursue the project in 1990 and made it very clear that we wanted the permit to remain in effect. She made no mention of any "lack of response" to prior requests for information. She made no request for further information. I was under the impression that, based on our conversation, the permit would remain in effect. Please advise me what additional information was requested and not received. Please forward a copy of this previous request since it cannot be found in the file. The Town of North Andover, the Division of Planning and Community Development and our Citizens Advisory Committee have worked long and hard to pursue this project. The Town has spent a considerable amount of money on design/engineering and permitting. Please contact me at your earliest convenience so that we can discuss this issue. As you know, Kimball Chase previously designed such a facility for the Town, and is very familiar with the local issues surrounding this project . The background and experience of our technical staff, as well as our strong project management skill, makes us confident that we can provide the necessary services to accomplish a final permitted design which is acceptable to the Town. This project will be done out of our Lawrence, Massachusetts office which specializes in municipal and site development activities . As we discussed, I foresee this project being accomplished in two a phases, which include: PHASE I - PRELIMINARY DESIGN AND PERMITTING This phase will include: (A) Minor modifications to the existing plans as necessary, to conform to the design intent of the Conservation Commission, Fire Department and Community Development staff, as well as associated project meetings . (B) Assistance in preparation of permitting documents to the U.S. Army Corps of Engineers and Massachusetts Department of Environmental Protection, including attendance at a project meeting with each agency, as well as a site walk. f Given the status of the plans to date and your commitment to the project, it is assumed that Kimball Chase will primarily serve an advisory role in this phase of the project. As these Phase II tasks are contingent upon the progress of Phase I, we will negotiate those services under a separate contract. The cost to perform our proposed services, billed on an hoL:r.i.y basis at the rates shown below, will be about $3 , 860 . This is not an upset price but an estimate. However, for the purposes of control, no engineering charges in excess of the above amount will be billed without authorization from you. The fee includes all meetings , engineering, drafting, reports, and associated materials . Any substantial change in the scope of services described above may affect the amount of our fee. Principal in Charge - up to $ 85 .00 per hour Project Management - up to $ 70 .00 per hour Managing Engineer - $ 65 .00 per hour Engineering - up to $ 52 .00 per hour Landscape Architect - $ 45 .00 per hour Technician - $ 35 .00 per hour Drafting - $ 35 .00 per hour Soils Scientist - $ 47 .00 per hour Survey Crew - 3 man crew - up to $100 .00 per hour Survey Crew - 2 man crew - up to $ 80 .00 per hour Suzanne Lamoureux, P.E. , will serve as coordinator for your project. Any questions or concerns which might arise during the course of this engagement can be directed to either Suzanne or myself, depending upon availability. Billing is on a monthly basis payable within fifteen ( 15 ) days . outstanding balances of thirty ( 30 ) days or more are subject to interest charged at the rate of 2 . 0% per month. Reimbursable expenses such as additional plan sets, mylars , postage and mileage are billed monthly and considered in addition to professional service fees . Attached to this letter, for your information is a copy of our standard schedule of fees and conditions . This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4 . The work authorized hereunder shall be completed within one year from the date of this Order (under the Town Bylaw) and three years (under the State Act) unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act and/or the Town ByLaw; (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this order. 5. This order may be extended by the issuing authority for one or more periods of up to one year each upon application to the issuing authority at least 30 days prior to the expiration date of the order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7 . No work shall be undertaken until all administrative appeal periods from this order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. #242-540 Boat Ramp, Riverview St. 3 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry' s Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the North Andover Conservation Commission on the form at the end of this Order prior to commencement of the work. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection, File Number 242-54011 . 10. Where the Department of Environmental Protection is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11. Upon completion of the work described herein, the applicant shall request in writing that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12 . The work shall conform to the following plans/documents (except as noted in the remainder of this document) : , (a) Notice of Intent prepared by Kimball Chase Inc. and submitted on 11/30/90. (b), Plans entitled "Boat Launch, Riverview Street, North Andover MA. dated Nov. 1990. (c) Drainage Calculations for Point Discharge of Proposed Culvert prepared by Kimball Chase Inc. 13 . The following wetland resource areas are affected by/within the 1001 buffer zone of the proposed work: bank, land under water, bordering land subject to flooding. These resource areas are significant to the interests of the Act and Town Bylaw as noted above. These resource areas are also significant to the recreational and wildlife interests of the Bylaw. The applicant has not attempted to overcome the presumption of significance of these resource areas to the identified interests. 14. The NACC agrees with the applicant's delineation of the wetland resource areas on the site as shown on the plans dated 11/30/90. The NACC also finds this proposal to be a "water dependent use" limited project as defined in 310 CMR 10. 53 (3) (1) . #242-540 Boat Ramp® Riverview St. 4 PERFORMANCE & DESIGN STANDARDS 15. The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site to construct a boat ramp will cause further alteration of the wetland resource areas during the construction activities. In order to prevent any alteration of wetland resource areas beyond those proposed in the Notice of Intent and approved herein, a 10 foot no-cut zone shall be established from the edge of all bank resource areas except at the Riverview St. entrance and the boat ramp itself. 16. No earthen embankment in the buffer zone shall have a slope steeper than 2: 1. Any slopes of steeper grade shall be rip- rapped to provide permanent stabilization. CHANGES 17. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be significant, the NACC will call for another public hearing (at the expense of the applicant) . Within 21 days of the close of said public hearing the NACC will issue an amended or new Order of Conditions. Any errors found in the plans or information submitted by the applicant shall be considered as changes. 18. The proposed project may be still under review by other local or state boards or agencies. This may result in changes to the project plans or wetland impacts. If any such changes occur, a final set of plans and a letter from the professional engineer, land surveyor or landscape architect who prepared these plans shall be submitted to the NACC for review and approval prior to the start of construction. Said letter shall describe any and all changes between the final plans and those reviewed and cited above by the NACC. No work shall begin on a project until written approval has been granted by the NACC. CONSTRUCTION 19. The applicant shall contact the Conservation Office prior to site preparation or construction and shall arrange an on-site conference with an NACC representative, the contractor and the applicant to ensure that all of the Conditions of this Order are understood. This Order also shall be made a part of the contractor's written contract. The applicant or contractor shall notify the NACC in writing of the identity of the on-site construction supervisor hired to coordinate construction and to ensure compliance with this Order. #242-540 Boat Ramp, Riverview St. 5 20. Prior to any activity on site, the applicant shall submit a construction schedule/sequence to the NACC detailing the proposed sequence of work on site to complete this project. 21. The applicant shall submit, to the NACC, a written progress report every 3 months detailing what work has been done in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence listed above. 22. Prior to any activity on the site, a filter fabric fence backed by a single row of staked hay bales shall be placed between all construction areas and wetland areas per Soil Conservation Service or D.E.P. standards. This barrier will be placed as shown on sheet 3 of the plans dated 11/30/90 (including the recent revisions made by the Administator) . This siltation barrier shall be inspected and approved by the NACC prior to the start of construction and shall remain intact until all disturbed areas have been mulched, seeded, and stabilized to prevent erosion. All erosion prevention and sedimentation protection measures found necessary during construction by the NACC shall be implemented at the direction of the NACC. 23 . The Applicant shall supply the NACC with a construction sequence including de-watering prior to the start of construction. 24 . The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of 25 hay bales and sufficient stakes for staking these bales. Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion. 25. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. If the latter course is chosen, stabilization will be considered once complete vegetative cover has been achieved. 26. No exposed area shall remain unfinished for more than thirty (30) days, unless approved by the NACC. 27 . There shall be no stockpiling of soil or other materials within twenty-five (25) feet of any resource area. 28. After proper grading, all disturbed areas located within a resource area which will not remain as wetland areas, shall be loamed (minimum of 411 of quality loam) , limed, fertilized and seeded. This shall all be done in accordance with SCS guidelines. All disturbed areas located within wetland resource #242-540 Boat Ramp, Riverview St. 6 areas which are to be only temporarily disturbed during construction, shall be restored to their original grade, soil profile and vegetative cover. Soil used for this purpose will either be wetlands topsoil or a minimum of 411 of quality loam. 29 . During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant as soon as practical. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. 30. Washings from concrete trucks, or surplus concrete, shall not be directed to, or dumped in, any drainage system or wetland resource area. 31. All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters at the site for the storage and removal of such spent construction materials off-site. 32 . Accepted engineering and construction standards and procedures shall be followed in the completion of the project. OTHER CONDITIONS 33 . Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate and/or effect compliance with this Order of Conditions. The NACC reserves the right to require, following field inspection, additional information or resource protection measures. 34 . Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding or storm damage. 35. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. This Condition shall survive this order of Conditions, and shall run with the title of the property. This condition is issued under the authority of the Town of North Andover' s Wetland Protection ByLaw. 36 . Fertilizers utilized for landscaping and lawn care shall be organic and low-nitrogen content, and shall be used in moderation. Pesticides and herbicides shall not be used within #242-540 Boat Ramp, Riverview St. 7 100 feet of a wetland resource area. This condition is issued under the authority of the Town of North Andover's Wetland Protection Bylaw. 37. The conditions of this decision shall apply to, and be binding upon, the applicant, owner, its employees and all successors and assigns in interest or control. 38. A proper bond or a deposit of money or negotiable securities running to the Town of North Andover shall be provided in the amount of $10, 000 which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC' s review and approval. This condition is issued under the authority of the Town of North Andover's Wetlands Protection Bylaw. 39. In addition to the requirements of Conditions No. 11, the applicant shall submit a letter to the NACC from a Registered Professional Civil Engineer or Land Surveyor certifying compliance with this Order of Conditions and the approved plans referenced herein (or approved revisions) . A stamped "As-Built" topographic plan of all areas within the jurisdiction of the Wetlands Protection Act and Bylaw shall be submitted when a Certificate of Compliance is requested. As described, the project entails construction of an 80-foot pre-cast/cast-in-place concrete ramp structure extending into the Merrimack River, with a bituminous concrete entrance and access way. Proposed activities will alter 680 sq. ft. of Land Under a Waterway and 1,360 sq. ft. of River Bank. Approximately 27 cu. yds. of material will be excavated from below the water, and 112 cu. yds. of fill will be placed below the water to allow construction of the ramp at a slope of 14 . 5%. Pre-cast concrete sections will be used to construct sections of the launching ramp that are in the water. Work will take place during the period of low water, allowing cast-in-place sections of the ramp to be constructed in the dry. Haybales and silt curtains will be deployed around all work in the water and in the River Bank. No vegetated wetlands will be disturbed by the proposed activities. Construction will take place during July, August and September, which will avoid disturbing fish runs. Our original agreement with Kimball Chase was signed in July of 7.987 , our current agreement was signed in May of 1990 and revised in October. It was our understanding at that time that this new agreement was an extension of a prior agreement and in conformance with all pertinent regulations. Staff has talked with Anne Hyland of Kopleman & Paige regarding this matter and she has requested that we forward to her our past and present agreements with Kimball Chase to see what procedural requirements are necessary to conform with the Uniform Procurement Act. Would you let me know if this should be determined in-house or whether it should be forwarded to Town Counsel . As you know, Kimball Chase previously designed such a facility for the Town, and is very familiar with the local issues surrounding this project. The background and experience of our technical staff, as well as our strong project management skill, makes us confident that we can provide the necessary services to accomplish a final permitted design which is acceptable to the Town. This project will be done out of our Lawrence, Massachusetts office which specializes in municipal and site development activities . As we discussed, I foresee this project being accomplished in two phases, which include: PHASE I - PRELIMINARY DESIGN AND PERMITTING This phase will include: (A) Minor modifications to the existing plans as necessary , to conform to the design intent of the Conservation Commission, Fire Department and Community Development staff, as well as associated project meetings . (B) Assistance in preparation of permitting documents to the U.S . Army Corps of Engineers and Massachusetts Department of Environmental Protection, including attendance at a project meeting with each agency, as, well as a site walk. Given the status of the plans to date and your commitment to the project, it is assumed that Kimball Chase will primarily serve an advisory role in this phase of the project.
