The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site will cause further alteration of the wetland resource areas. In order to prevent ally alteration of wetland resource areas a twenty five foot(25') No-Disturbance Zone and a fifty foot(50') Na-Build Lane and a 1.()(?-foot area of undisturbed ve cg�tatic�n in I iverf ont on Lot 7 shall be established from the edge of the adjacent wetland resource area as shown on the plans referenced herein. The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local bylaw. No disturbance of existing grade,soils or vegetation is permitted in the No- Disturbance zone. (See Section 3.4 &Apperulix F of the local Regulations). 2. The owner shall maintain the permanently marked edge of the limit of disturbance on all delineated wetlands with a 2-foot by 2-foot dry laid field stone walls (location shown on the herein referenced plans,existing wall to be augmented to meet this requirement). The wall shall be monumented with signs or markers spaced evenly every 35 feet incorporating the following text: "Protected.Wetland Resource Area" and the associated rules (I. square for every 3 round markers). This will designate their sensitivity and assure no further inadvertent encroachment into the wetland 25--foot No-Disturbance Zone or 100-foot zone of undisturbed vegetation from mean annual high water (10.58 (4)(d)(1)(a)). These permanent markers are subject to review and approval by the NACC. The applicant shall. instruct all agents to explain these markers to buyers/lessees/landscapers and all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. Markers may be obtained at the Conservation Department($2 round/$3 square). 3. The stormwater management system has been designed based on a limit of clearing and proposed impervious area on each lot(see table on Sheet 5 of 12 of the approved site plan). The applicant or new owner must provide documentation that these limits are adhered to during lot development or a modification/amendment shall be required. 4. All stormwater best management practices shall be maintained as specified in the Pollution Prevention and Operation and Maintenance Plan (O&M) submitted with the Notice of Intent and incorporated in the Order of Conditions (overall site maintenance dated October 17,2018-homeowner specific O& M dated November 21,2018). Evidence of maintenance of the stormwater management system shall be provided to the NACC on an annual basis by a Registered l rofessional Civil Engineer during construction. All catch basins shall contain oil/grease traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/grease traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Certificate of Compliance is issued and the owner or his/her agent shall so specify in the request for Compliance, 6. The Applicant/Homeowner's Association shall provide the NACC with a copy of a maintenance contract/agreement of not less than one year entered into with a certified maintenance contractor for all responsibilities outlined in the November 21,2018 O&M (attached herein). The maintenance contract and the qualifications/ credentials of the certified maintenance contractor shall be provided to the NACC for its files prior to putting the storinwater management system on-line. This special condition,including ongoing renewals of the maintem-a-ice contract by qualifier personnel,shall survive the issuance of a Certificate of Compliance (COC) for the project. Upon request, the Applicant shall provide the Commission with copies of subsequent renewals of the maintenance contract following the initial period. 7. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant within one (1) business day. No construction vehicles are to be stored within 1.00 feet of wetland resource areas,and no vehicle refueling,equipment lubrication,or maintenance is to be done within 100 feet of a resource area. 8. No underground storage of fuel oils shall be allowed on any lot within one-hundred (1.00) feet of any wetland resource area. This condition shall survive this Order of Conditions and shall run with the title of the property, This condition is issued under the authority of the Town's Wetland protection Bylaw, 9. Fertilizers utilized for landscaping and lawn care shall.be slow release,low-nitrogen types (<5%) and phosphorous free, and shall not be used within 25 feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition shall survive this Order of Conditions and shall run with the title of the property. This condition is issued under the authority of the Town's Wetland Protection Bylaw and shall remain iri perpetuity. 10. The use of coal tar-based pavement sealants is prohibited on the property,as they have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs) to storn-twater runoff. This condition shall survive the Order of Conditions and shall run with the title of the property. 11. There shall be no dumping of leaves, grass clippings,brush,or other debris into a wetland resource area including the Buffer Zone. This condition shall survive the issuance of a Certificate of Compliance.
