Regular Meet~ug & Hearings
The BOARD OF APPEALS held their regular meeting on Monday evening, June 14,
1965 at 7:30 P.M. in the Town Office Building with the following members present
and voting: Daniel T. O'Leary, Chairman; William Morton, Secretary; Arthur
Drummond, John J. Shields and James A. Deyo.
There were 16 people present for the meeting.
1. HEARI~: Egilda D'Agata.
Mr. Morton read the legal notice in the appeal of Egilda D'Agata who re-
quested a variation of Sec. 7.23 of the Zoning By-Law so as to permit the extensio~
of the present garage and join lit to the house on the premises located at the
south side of Herrick Road, 59 feet distant from the corner of Youn~Road and
known as No. 41 Herrick Road. He also read the Building Inspector's refusal.
Atty. Reno Orlando represented the petitioner. He explained that the household
has three vehicles that have to be left in the open. This variance would allow
them to put the three vehicles in the garage. The proposed addition would be 28
feet long and joined to the house on the porch side and would be approximately
three feet from the lot line.
Atty. Donald F. Smith, who represented Mr. & Mrs. Bellino, immediate abutters to
the proposed addition, said this addition would be no more than 12 feet from their
home. It would also be overcrowding the land, the lot contains only 4,300 sq. ft.
and this addition would require ~n additional 300-&O0 sq. ft. It would be a
fire hazard because of the close proximity of the garage and Mr. Bellino's home.
This would be derogating from the purpose of the Zond~By-Law. Mr. Lambert,
16 Herrick Road, spoke of the dangers of these three vehicles because of the
school children in the area.
Mr. Shields made a motion to take the petition under advisement; Mr. Morton
seconded the motion and the vote was unanimous.
2. HEARING: Dorothy O. Archambault.
Mr. Morton read the legal notice in the appeal of Dorothy O. Archambault who
requested a variation of Sec. 4.0~ of the Zoning By-Law and a Special Permit under
the same section, so as to permit the conversion of an existing two-family home
to four bachelor apartments, on the premises, located at the west side of High
Street, 200 feet distant from the corner of Chadwick Street and known as No. 192
High Street. He also read the Building Inspector's refusal.
Mrs. Archambault appeared on her own behalf and explained her proposed apartments
and that she intends to beautify the house and yard. She will install a central
heating system. Mr. C.J. D~yer was recorded as opposed. Mr. Tardiff said he' was
not opposed but was interested as to what was to be done and what provisions would
be made for parking.
Mr. Morton made a motion to take the petition under advisement; Mr. Drummond
seconded the motion and the vote was unanimous.

3- HEARING: Joe's Diner (Margaret Legault)
~r. Morton read the legal notice in the appeal of Margaret Legault who requested
a variation of Sec. 7.3 of the Zoning By-Law so as to permit an addition to the
present restaurant to serve as a take-out area for food and ice cream on the premises,
located at the east side of Osgood Street known as No. 1211 Osgood Street.
Mrs. Legault appeared on her own behalf and explained that the land on which the
restaurant is located is o~ned by Stefano~icz and that She wants to make an addition
to be used as a take-out service for food and ice cream.
George Barker, Sr. and George Barker, Jr., immediate abutters, were opposed, saying
it would be detrimental and would create a worse parking problem than what already
exists. Philip Arrigo and Donald Culver were also opposed mainly because of the
parking problem as regards to Barker Street.
Mr. Shields made a motion to take the petition under advisement; Mr. Morton
seconded the motion and the vote was unanimous.
The Board then discussed and voted on the hearings of the evening.
1. D'AGATA:
Mr. Drummond made a motion to DENY the variance; Mr. Morton seconded the
motion and the vote was unanimous. The applicant will suffer no substantial hard-
ship, financial or otherwise, by the denial of this petition. The requested
variance will be in substantial derogation from the intent or purpose of the
Zoning By-Law.
2. ARGHAMBAULT:
Mr. Shields made a motion to DENY the variance and special permit; Mr.
Drummond seconded the motion and the vote was unanimous. The petitioner failed to
meet all the re~,~ements under Section ~.0~ of the Zoning By-Law.
3. JOE'S DINE~:
Mr. Drummond made a motion to DENY the variance; Mr. Deyo seconded the motion
and the vote was unanimous. The applicant will suffer no substantial hardship,
financial or otherwise, by the denial of this petition.
The meeting adjourned at 9:30 P.M.
