HomeMy WebLinkAbout1965-08-09Monday - August 9, 1965 Regular Meeting & Hearings 11o The BOARD OF APPEALS held their regular meeting on Monday evening, August 9, 1965 at 7:30 P.M. in the Town Office Building with the following members present and voting: Daniel T. O'Leary, Chairman; William Morton, Secretary; Arthur Drummond and James A. Deyo; and Associate Member Robert J. Burke. There were 25 people present for the meeting. 1. HEARING: Bart Forzese. Mr. Morton read the legal notice in the appeal of Bart Forzese who requested a variation of Sec. 6.31 & 6.61 of the Zoning By-Law so as to permit the erection of a one story single family dwelling on the premises, located at the west side of Silsbee Road, 70 feet distant from the corner of Herrick Road and known as Lot #2. He also read the Buildlug Inspector's refusal. Mr. Forzese spoke on his own behalf and explained that he needed a variance in order to build on this lot because of its unusual shape. He would come within five feet of the side lot line. Four abutters were recorded in favor saying a house would improve the looks of the lot. Four abutters were opposed saying a dwelling on this particular lot would cause a congested condition in the neigh- borhood and that the house would be too close to the lot line. Mr. Morton made a motion to take the petition under advisement; Mr. Deyo seconded the motion and the vote was unanimous. 2. HEARING: Warren F. & Josephine Kelley. Mr. Morton read the legal notice in the appeal of Warren F. & Josephine Kelley who requested a variation of Sec. 6.31 of the ZonJ_~g By-Law so as to permit the division of a parcel of land into two lots as shown on plan submitted on the premises, located at the south side of Park Street; 87.2 feet distant from the corner of Chickering Road and known as#39-~l Park Street. The Building Inspector's refusal was also read. Atty. Edward Gordon represented the petitioner, who was also present. He explained that the petitioner wanted to construct a single family home on the lot adjoining the present dwelling. Four abutters were opposed because the lots would be too small in comparison with the adjoining lots in the neighborhood. The lot with the existing house would contain approx. 10,500 sq. ft. and the proposed vacant lot would contain approx. 9,320 sq. ft. Mr. Morton made a motion to take the petition under advisement; Mr. Drummond seconded the motion and the vote was unanimous. 3. HEARING: Sebastian J. Crescimano. Mr. Morton read the legal notice in the appeal of Sebastian J. Crescimano who requested a variation of Sec. 7.23 of the Zoning By-Law so as to permit the erection of a two-stall garage that would be closer to the lot line than 15 feet, on the premises located at the north side of Pleasant Street; 80 feet distant from the corner of Davis Street and known as 122 Pleasant Street. He also read the Building Inspector's refusal. 114 August 9, 1965 - cont. Mr. Crescimano appeared on his own beh~]* and explained that he wanted to leave room between the house and the garage for a 12 ft. breezeway in the future. Mr. Agey, an immediate abutter, spoke in opposition to the proposed garage, saying the garage would be too close to the lot line and that no foresight was used in the planning of his home - this is a fairly new structure. Mr. Burke made a motion to take the petition under advisement; Mr. Morton seconded the motion and the vote was unanimous. 4. HEARING: Ernest J. & Bertha Roberts. Mr. Morton read the legal notice in the appeal of Ernest J. & Bertha Roberts who requested a variation of Sec. 6.31 of the Zo=iugBy-Laws so as to permit the subdivision of three 5OxlO0 lots into two 75x100 ft. lots on the premises, located at the southeasterly side of Irving Road and known as 22 Irving Road. Atty. Ralph E. Finck represented the petitioners, who were also present. They desire to combine three 50xlOO ft. lots into two 75x100 ft. lots and that the size of these lots would be in keeping with the general area since there are mauy lots of this size there now. The petitioner is lookiug to the future in order to have land available when his children may want to build a home. One abutter was opposed his lot is lOOxlO0 and he doesn't see why the petitioner should be allowed to have his lots smaller. One person was not opposed but questioned whether the property would be sold outside of the family. Mr. Burke made a motion to take the petition under advisement; Mr. Drummond seconded the motion an~the vote was unanImous. The Board then discussed and voted on the hearings of the evening. 1. ROBERTS: Mr. Burke made a motion to GRANT the variance; Mr. Deyo seconded the motion and the vote was unanimous. The lots were not in non-conformity with the typical influences of the neighborhood. 2. Mr. Burke made a motion to grant the variance. There was no second. Mr. Drummond made a motion to DENY the variance; Mr. Deyo seconded the motion and the vote was unanimous. The Board feels there is no hardship involved. 3. FORZESE: Mr. Drummond made a motion to DENY the variance; Mr. Deyo seconded the motion and the vote was unanimous. There is no hardship involved. 4. CEESCIMANO: Mr. Deyo made a motion to DENY the variance; Mr. Drummond seconded the motion and the vote was unanimous. There is no hardship involved. The meeting adjourned at 9:30 P.M.
