The l~ollowing ~mmbers ware present and voting: Daniel T. O'Leary, Oheirma~ William Horton~ Seer~; James Deyo, John J. Shields,~Arthur Drummend. ~ There were 10 people present at the meeting. 1. HEARING: Salvatore and Frances Fichere. Mr. Morton read the legal notice in behalf of Salvatore and Frances Fichera who requested a variation of Sec. 6.31 and 6.62 of the Zc~-g By-Law so as to permit the combination of six lots, each having a 50-foot frontage, into four lots, each having a 75-foot frontage and to decrease front depth to 20 feet, on the premises, located at the north side of Shawsheen Rd. at the corners of Inglewood Street and Jetwood Street. Atty. Charles Trcmbly represented the petitioner who ~as also present. He explained the lots involved to the Board, on the plans presented. The orig~r,~l developer had 50x100 lots. He wants the lots divided so as to allow four houses. There is sewer A~d water on the streets. It would help the to~n by bx~ilding houses and adding to the tax base, etc. Mr. Fichera and Mr. Boo~an were recorded in favor. Mr. Shields made a .motion to take the petition under advisement. Mr.. Drnw~ond seconded the motion and the vote was una___~us. 2. PFARING: Richard A. Shellnut, Adm., Estate of Alice M. Shellnut. Mr. Morton read the legal notice in behalf of Richard 3hell-ut who requested a variation of Sec. 6.31 and 7.23 of the Zo-~-g By-Law so as to permit the subdivision of a lot into two lots having less than 12,500 sq. ft., on the premises located at the east side of Chickering Road, at the intersection of Bay State Road. Atty. Harold Morley, Jr. represented the petitioner, who was also present. There were six abutters present who Just aaked ~aestions of the petitioners, but were not opposed. Atty. Morley explained that the petition was Just a matter of form that needed the Boardts approval for legal purposes in order to clarify the deed and to record the two lots. A house is presently located on one lot and the other lot would be available for a single f,w~ly residence. The State tohk some of Lot ~79 for high~ay purposes, also some of Lot #78. Lot A is now under somebody else's name. There is an existing dwalling on Lot A. Mr. Dr~m~d made a motion to take theppatition under advisement. Mr. Shields seconded the motion and the vote was unan~,~us. 3. J~LIA FIONTE. This hearing was continued from the November 8 meeting, at which time no repre- sentative for the petition was present and no plans had been submitted. Mitchell Bootman was present representing the petitioner. However, his plans ware incomplete - he only had a linen copy. Mr. Norton made a motion to proceed with the hearing and he could submit the paper copies later. Mr. Deyo seconded the motio~ the vote was 148 Jaa,,-~y 10, 1966 - Cdat. Mr. Mortcm read the legal notice in the appeal of Julia Fionte who requested a variation of Sec. 6.61 of the Zoning By-Law so as to permit the erection of a small entrance porch on the side of the new dwell_t~g to provide shelter to th~ entrance o~ the premises, located at the east side of Glenwood Street; approx. 400 feet distant i~om the corner of Massachusetts Ava. and known as Lot Glenwood Street. Mr. Bootma~ said he had nothing to say, the notice was self-explama~. Mr. Mort~m mede a moticm to take the petition ~der advisement. Mr. D~m~md seconded the moti~ a~d the vote was unanimous. In Executive Sessiem, after thorough discussion, the following decisions were ~de: 1. Julia Fionte: Mr. Mortcm made ~a motion to GRANT the variance subject to the Boar~ receiving the necessary copies of the origimal pl-~ submitted. Mr. D~--~d seconded the motion and the vote was unanim~,_s. $. FICHERA: The Board discussed whether or not they should view the premises. After further discussion, Mr. D~w~d made a motion to DENY the variance. Mr. Deyo seconded the motion and the vote was ~ma~irm~s. The variance was denied because the applicant will suffer no ~mbstantial hardship financial or otherwise, by the denial. The requested wriance will he in substantial derogation from the intent or purpose of the Zoning By-law. 3. S~T.T.~T -- Mr. Sheilds made a motion to GRANT the variance. motion and the vote was u~tmous. Mr. Dr~ond seconded the The Board members sig~ed the plans of the vartamcas that were approved.
