Regular Meeting & Hearings
The Board of Appeals held their regular meeting on Monday evening, l~_~h
1966 at 7:30 P.M. in the Town Building. The followi~ members were present

1. HEARING: Roy Fart.
Se~r~t~Merton read the legal notice in the appeal of Roy R. Faz~A~ who requested a
Special Permit under Sec. 4.7 of the Zoning By-Law so as to permit the construction
of 12 garden-type apartment buildings, each contA~4-~ not more tb~- twelve dwelling
units, as sho~n on the site plan filed herewith, and conform~-~ with the provisions
of S. 4.73 of said By-Law and such conditions as may be imposed by this Board; on
the premises, located at the west side of~ Chickering Road, as shown on the pre-
Atty. Stephen F. LoPiano, Jr. represented the petitioner, who was also present.
The Building Inspector and five abutters were present and asked questions of the
petitioner. ~r. Caparco, representing his father Di_~_m_~_~te Caparco who could not be
present, said he was opposed. The petitioners explained that this is the last phase
of apartment building in that area. There will be no more apartments built there
after the construction of these 12 building~ if granted. The Bldg. Insp. was also present.
Mr. Mert~m made a motion to take the petition under advisement. Mr. Gilman seconded
the motion and the vote was unanimous.
2. HEARING: Ibra~m E1-Hefai.
Secretary ~orton read the legal notice in the appeal of Ibrahim E1-Hefni who re-
quested a variation of Sec. 6.33 of the Zoning By-Law so as to permit the division
of an existing lot into two lots, having more than the required frontage ~rat less
t~ the required area, on the premises located at the north side of Great Pond Road;
4000 feet distant from the corner of 0sgood Street and kaown as Lot ~25.
Atty. Harold Morley, Jr. represented the petitioner, who was also present. He ex-
plained that the lots have more than enough frontage and that one of the lots is
au unu~,A1 ly shaped lot. He was unable to purchase additional land from abutters in
order to meet area req,~i~ements. Mr. E1-Hefni ~ill fence off the area with a 4-5 ft.
chain link fence, which will solve a current problem for the Town since there is au
Article in the Special Town Meeting for the Town to construct a fence because of
parking problems in the area.
Mr. Morton made a motion to take the petition under advisement. Mr. Drummond
seconded the motion and the vote was u~animous.
The Board signed the bills for the month.
In Executive session, after thorough discussion, the following decisions were made~
1. Roy Fart.
Mr. Gilman made a motion to GRANT the Special Permit for the apartment development.
Mr. Deyo seconded the motion and the vote was unanimous.
