HomeMy WebLinkAbout1966-07-11157 Monday - July 11, 1966 Regular Meeting The Board of Appeals held their regular meeting on Monday evening, July 11, 1966 at 7:30 P.M. in the To~n Office Building. The following members were present and voting: John J. Shields, Chairman; James A. Deyo, Secretary; Donald J. Scott, Daniel T. O'Leary and Arthur Drummond. HEARING: Agnes Mildes. James A. Deyo read the legal notice for a variance to convert five lots, pre~iously recorded, /nto three lots. Atty. Charles W. Trombly pleaded the cause and developed, as sho~n on the plan of land submitted with said application, that there existed on an older recorded plan five lots of land, and that in 1961 a plan of land was recorded in the North Essex Registry of Deeds as Plan #4344; that the lots trader consideration ranged from S200 sq. ft. to 12,500 sq. ft. where the former lots contained, t~rpically, 6,000 to 8,000 sq. ft. It was further disclosed that in 1961, at the t/me of recording said plan, and acting in good faith, the petitioner or her agent did apply for Plan~g Board approval. The necessary indication on the plan was that the plan did not require sub-division control action. Atty. Trombly further pointed out that in order to convey any one or all of these lots, a variance was sought confi~-~ing the plan recorded in 1961; further, that the lot adjacent to Lot A on the northwesterly side contains less than 7,000 sq. f~. and was in existence prior to the adoption of the present Zoning By-Law. It was further developed that there were many lots in the immediate neighborhood of much less ~q. ft. area and street frontage than the subject lots. Three interested property owners of the neighborhood, not necessarily abutters, queried the frontage of Lot C on Cotuit St. and, when advised that Lot C contained 125 ' street frontage, appeared well satisfied and had no objection. Mr. Dr,-~m~nd mede a motion to take the petition under advisement. Mr. 0~Leary seconded the motion and the vote was unanimous. Tn executive session, it was determined that many typical lots of the immediate neighborhood influence ranged from 6,000 to 8,000 sq. ft. with several lots having apprca~m~_~tely 6Or frontage. Hr. OtLeary made a motion to GRANT the variance. Mr. Drw,..~.ond seconded the motion and the vote ~as unanimous. The reasons for granting are: 1. That to deny the application would create a severe hardship, both f~nancial and otherwise, upon the present o~ner; 2. That approving of said variance would not derogate from the intent and purpose of the existing Zoning By-Law. 3. That the granting of said variance would not be detrimental or adversely affect the neighborhood influences or derogate from the neighborhood values. 4. That the combining of five lots into three lots reflected the most acceptable plan of good land planning and would result in no perceptible differential of the immediate neighborhood. 158 The Chairman presented copies of the Waltham Board of Appeals Rttles and Regulations to each of the members to be studied in order to update this Board's present Rules and Regulations. The members signed the necessary plans and bills. The meeting was adjourned at 8:30 P.M. Chairman
