Construction of AEG Modicon Manufacturing Building Release of $11 , 000. 00 Bond Submitted to Planning Board Dear Ms. Bradley-Colwell, Just prior to commencing construction in 1992 on the AEG Modicon "Manufacturing Building" at North Andover Mills, the former North Andover Town Planner, Chris Huntress, determined that North Andover Mills Realty must submit a bond in the amount of $11, 000 . 00 to the Town of North Andover, acting through its Planning Board, which would be held by the Town of North Andover until certain landscape material had been installed, which was addressed in Mr. Huntress ' letter dated July 27 , 1992 and which I have enclosed for your reference as Attachment #1 . For your reference, I have enclosed a photocopy of the "Performance Bond - Deposit of Money - North Andover Planning Board" Agreement, which is referenced as Attachments #2A & #2B, which was executed by all parties on September 15, 1992 , and I have also enclosed a photocopy of the Bay Bank Check #0349201 in the amount of $11 , 000 . 00 , which was submitted to the Town of North Andover and which is referenced as Attachment #3 . The AEG Modicon Manufacturing Building was completed in late 1993, and a. Certificate of Use and Occupancy was issued by the Town of North Andover on December 20 , 1993, copies of which are enclosed and referenced as Attachments #4A & #4B. During a recent review of our files for this project we determined that this $11, 000. 00 bond was still being held by the Town of North Andover, and as this project was completed four (4) years ago, this letter is our official request that this $11 , 000. 00 bond/check be returned to North Andover Mills Realty, which shall also include interest, as this $11 , 000 . 00 was deposited by the Treasurer of the Town of North Andover in an interest-bearing account, as stated on page 1 of the Agreement. Trucks queuing within the right-of-way as marked by yellow lines. Lack of definitive curbing allows movement across all areas of the right-of-way. Verbal representations to the then comprised Planning Board (four (4) current members & George Perna) maintained that the right-of-way would be moved from its current "legal" area as soon as a new owner of the condo project had been defined. While the Board has no objection to the current "legal" right-of-way except that to create a safe environment, curbing would have to run along side both sides of the right-of-way, effectively cutting off three (3) Modicon loading docks, it is apparent from current Building Inspector and Planning Staff observations that this remains true and that safety issues have increased due to the increased traffic surrounding the Modicon addition. 2 . No permission was ever granted for the stockpiling of dirt at the site. Dirt piles may be removed this month, but remain a health issue. Dirt screening was in violation of Zoning. 3. Fencing around dirt piles are inadequate. 4 . Dust control is deficient. We have some two (2) business days to accomplish this . The preparation of the legal documents and the plans are under your control and, therefore, our ability to meet this Tuesday deadline really rests with you. It is unfortunate that you couldn't do today' s scheduled 3:30 conference call to further discuss the .issues. It doesn't appear that this thing is going to get done unless a conscientious effort on your part is made to get it done, and we are running out of time. The following are some of the outstanding matters that need to be resolved immediately: I. The consent of the Boston Maine Corporation, which is crucial needs to be obtained. 2 . Insofar as the agreement itself is concerned, the outstanding issues really don't relate to the business deal but relate to changes which your attorney made to the documents in connection with the exclusivity aspect of the proposed new right-of-way. These changes are unacceptable, and are no longer applicable since the easement is no longer exclusive but will be in common. I would like to reiterate that we need to go back to our original agreement and only make changes which reflect our business deal, particularly given the time constraints we are under. As I indicated, I am willing to make a contribution toward the cost of construction of the new access road and related improvements. The amount of such contribu- tion would be equivalent to the value of the new access road through the Spiridoni property. While you have agreed to this in principle, you do not seers to agree with my construction estimates. Let me remind you that we are general contractors who have been in the building business for over 25 years, and we are well aware of what the construction costs would be with respect to this portion of the new access road. Therefore, the most that I am willing to offer toward the cost of the new access road and related improvements is $56,000 (i.e. , the amount of my construction estimate) . 4 . I have given the issue of maintenance and operating expenses with respect to the proposed new right-of-way some further thought. I thank your proposal to share the maintenance and operating costs on a 50/50 basis is unreasonable, particularly since your choice of Option #1 has substantially increased the length of the proposed new access road and, consequently, the costs involved with respect to maintenance and operation. Therefore, after further consideration I am willing to share the certifiable maintenance and operating costs with respect to the proposed new access road on a 75/25 basis (75% - North Andover Mills Realty, 25% - Elm Mill Realty Trust) . The maintenance costs which would be shared would be limited to snowplowing of and repairs to the proposed new access road. Also, I 've revised the Construction Schedule (see accompanying) . CONSTRUCTION SCHEDULE The Partnership shall construct, or cause to be constructed, at its sole cost and expense, the improvements in the New Easement (the "Improvements") in accordance with the plan entitled and dated , prepared by vanasse, Hangen, Brustlin, Inc. (hereinafter the "Plant') . The Improvements shall include, without limitation, the following: 1. The furnishing of all labor, materials, equipment, tools, services, and all other incidentals required to undertake and complete construction of the new access road and related work. The new access road shall start at the access way located on or about the Trustees ' property line and shall continue through the Partner- ship's property and to the New High Street curb cut located adjacent to Prescott Street as denoted on the Plans. The new access road shall be approximately 1, 000 lineal feet in length and shall consist of a thirty (301 ) foot wide bituminous concrete paved surface with exception to the approximately 180 lineal foot High Street entrance drive which shall be a forty (401 ) foot wide bituminous concrete paved surface as denoted on the Plans . 2. The furnishing and installation of a continuous bituminous concrete berm, Cape Cod style, along the entire length of both sides of the new access road (with exception to the curb cuts as denoted on the Plan) . 3 . The furnishing and installation of a functional and operational storm drainage system. 4 . The furnishing and installation of 6 foot minimum grassed landscape belt along the entire length of both sides of the new access road. Such grassed landscape belt shall be loamed and seeded or sodded and shall include, without limitation, a continuous bituminous concrete berm along the entire edge of the other side of the 6 ' grassed landscape belt where required. Such trees shall be American Linden, Norway Maple or Pin Oak with a minimum caliper of 2-1/2 inches to 3 inches. The Partnership shall furnish and install additional landscaping and plantings at the (40 ' wide) High Street location. 5 . The furnishing and installation of plant beds and islands which shall include, without limitation, the removal of existing bituminous concrete paving and gravel sub-base and the installation of new bituminous concrete curbs, Loam, mulch, seed and plantings as required. 5. The furnishing and installation of site lighting along the new access road including, without limitation, fixtures, light bases, conduit, power, and all incidentals and work required to make the site lighting operational. The site lighting fixtures shall be comparable or equal to the quality, type and size of the existing site lighting fixtures located on the Trustees ' property, and shall be installed at 100 foot intervals along the entire length of the new access road. The Partnership is currently considering new site lighting for the entire parking lot including, without limitation, this new access road. Final layout, design, type, quantity and size shall be as mutually agreed upon by the Partnership and the Trustees. 7 . The existing storage/maintenance building, fencing and appurtenances thereto located adjacent to the Trustees ' Property line shall, be demolished, completely removed and legally disposed of, and all, such areas shall be paved, landscaped and/or restored. S. The furnishing and installation of two (2) signs . Such signs shall be subject to the approval of the Partnership as to size, design and location (such approval shall not be unreasonably withheld) as follows: Page 2 ...... ... ........................_............................... a. A sign adjacent to High Street in style and size similar to typical signs in North Andover identify- ing public streets, identifying the driveway to Lot 2 with a name mutually acceptable to the Trustees and the Partnership; and b. One other sign at the point nearest to High Street where the New Easement diverges from the entrance to the Trustees ` parking lot, directing traffic to Lot 2 in that direction. Such sign shall be comparable in material, color, and lettering to the existing signage at the Trustees ' property. The letters shall be a minimum of twelve ( 12") inches in height. 9 . It is understood and agreed that the new access road shall be in direct alignment with the existing drive located on or about the property line of the Trustees ' property. Further, the degree of the road curves shall not exceed applicable standards of the local department of public work, and there shall be no curves which would create an unsafe means of travel. 10. The furnishing and installation of underground utili- ties, as the Trustees deem appropriate. The Trustees shall have the right to install additional underground utilities in the future. 11. stripping of topsoil, excavation, backfilling and grading for the Improvements at all unpaved locations . 12. The furnishing and installation of gravel under the new access road (at all existing unpaved locations) . The gravel product shall be new bank gravel, and the gravel depth under the new access road shall be a minimum of eight (8") inches. 13. The furnishing and installation of two and one-half (2-1/2") inches of bituminous concrete paving at areas to be newly paved and one ( 1") inch overlay at all existing and paved areas along the entire length of the new access road. 14. The repair of disturbed areas caused during construction of the Improvements including, without . limitation, regrading, bituminous concrete repairs, loaming, seeding and general cleanup. The proper tie-in and connection of the new access road to the existing drive and/or improvements located on or about the property line of the Trustees` property. Such work includes, without limitation, the furnishing of all materials and the performance of all work required with respect to such connection, and the cleanup, regrading and reseeding of all areas disturbed during such tie -in and connection operations. 16 . Cleaning, removal and legal disposal offsite of all rubbish, debris and/or surplus materials caused by or resulting from construction of the Improvements . 17 _ The Partnership shall give all notices and shall comply with all applicable laws, ordinances, rules, regulations and orders of all governmental authorities exercising jurisdiction over the Improvements or the conduct thereof and/or the Partnership's execution of the work called for herein. This report summarizes our observations for September 10, 1993 (refer to the attached Field Sketches for location of activities). 2. Work Performed and Observations Made: Cour and Roadway Subcrade Pre aration a. Upon arrival to the site, the undersigned observed that the Contractor had continued to fine grade and compact the pavement base course Gravel Fill within the courtyard area, shown as Area A on the attached Field Sketch A_ A 12-inch-thick lift of off-site Gravel Fill (fine to coarse SAND, some Gravel, trace Silt) had been previously placed to approximately elevation 82 feet within the proposed courtyard roadway. The pavement base course material had been compacted prior to the arrival of the undersigned on site. The surface of the base course material appeared dense and stable. In addition, the Contractor had placed steel reinforcement (rebar) in three areas along the proposed courtyard roadway. Also, the Contractor had completed the construction of two concrete slabs as part of the courtyard roadway (refer to the attached Field Sketch B for location of rebar and concrete). Six field density tests (Nos. 316 through 321) were performed within the proposed courtyard roadway area (refer to Field Sketch B for approximate location of field density tests). Test results indicated the degree of compaction achieved was in accordance with Project Specifications. It is unclear which of the two easements was delineated. No physical barrier has been constructed along this delineation. 2 . All of the non-DEP dirt piles have been removed. The construction debris has been moved out of the parking area. 3 . The additional testing was completed on the DEP dirt piles. According to the on-site manager at MODICON the piles should start to be removed by the end of next week. 4 . The piles of concrete have been removed. 5. The screening equipment has been removed. 6. There is an orange snow fence around the dirt piles. This fence must continue to be maintained. 7 . The dirt piles have been covered with plastic. The plastic must continue to be maintained as it is a light weight plastic and is easily blown off. 8. An orange snow fence has been erected around the detention basin. This fence must be maintained. 9 . The parking lot appeared to be swept. It must continue to be swept on a regular basis. 10. The landscaped area between the buildings has been cleaned up and appears to be ready for planting. 11. Upon arrival to the site, the undersigned met with Mr. George Petersen, Assistant Project Manager for GZA, and with representatives of American Reclamation (AMREC). The AMREC representative stated the removal of Stockpile A material (consisting of granular soil and miscellaneous fill) would begin on this date. Results of previous screening tests of the representation soil samples from the stockpile detected elevated levels of a virgin petroleum fuel oil product. The soil was being removed from the site under a Bill of Lading, dated September 1, 1993, issued by the Massachusetts Department of Environmental Protection (DEP). In general, the stockpiles are located in the northern paved parking area. Refer to the attached Field Sketches for approximate location of the stockpiles. In addition, Mr. Petersen and the undersigned delineated the approximate limits of cells 22 and 26 within Stockpile A. The material within the two cells was scheduled to be transferred to Stockpile B. Refer to the attached Field Sketch 2 for approximate locations. Transfer of Cells 22 and 26 a. I have enclosed a photocopy of a reduced scale site plan of North Andover Mills, which shows the locations of this material on site, and identifies these stockpiles as Pile A, Pile A' , Pile B and Pile C. At this time, it appears that 4', 300 tons of material from Pile A has been removed from site, but that 1, 500 tons of material from Pile A still remains, and because of this 26%± overage, it is necessary to receive approval from DEP for this increased tonnage. As stated in GZA' s letter of September 16, 1993, it is believed that this additional DEP approval will require 1 to 2 days and that AMREC will require 2 to 3 days after this approval to remove all of Pile A and A' from the site, which would result in Pile A and A' being 'off-site' by the end of the workday on Thursday, September 23, 1993. September 16, 1993 Mr. Richard Nardella Re: Removal of Stockpiled Material from North Andover Mills Pile B, is in the process of being submitted to the State of Maine DEP by Aggregate Recycling Corporation (ARC) , which should be completed by September 20 or 21, 1993. The Maine DEP will require approximately three (3) weeks to approve ARC' s submittal/application and ARC will require approximately one (1) week to remove Pile B from the site after they have received approval from the Maine DEP, which would result in the total removal of Pile B, sometime during the week of October 18, 1993. Pile C, contains normal concrete construction debris, which may be disposed of as such, but for the fact that this Pile C is currently ' land-locked' by Pile A and Pile B. Once the removal of Pile A is completed by AMREC, Pile C could be removed from site by the General Contractor' s Site-work subcontractor within 2 or 3 days, which would place the removal of Pile C on or about September 28, 1993. The Board has scheduled a special meeting on September 15, 1993 at 7 : 00 pm in the Planning Office to discuss your compliance with these concerns. At that meeting the Board would like to have final documents concerning the final agreed upon location of the access easement to Sutton Pond condominiums presented. If an easement has not been agreed upon by that date, the Board may move forward in requiring the delineation of the existing easement with a physical barrier of some sort. As expressed previously the Board is concerned with the public safety issues of sending residential traffic through an active construction site without clear access. MILLS The following are my comments on the above projects now before the Planning Board: Lacy St. has filed a Notice of Intent with the Conservation Commission and will be heard this evening. At a recent site visit the Commission discovered that some grading had taken place on the common drive and that earth had been moved immediately adjacent to the wetland boundary. Some exposed soil remained on the road shoulder adjacent to the pond as well. This must be hand raked and stabilized. Also, some illegal dumping in the wetland and a pile of soil near the wetland must be removed. The house itself will not likely be a problem but the above issues make me concerned about future work since this work was done before any permits were issued. The above items should be addressed before any permits are issued by anyone. My comments regarding Woodland Estates are not positive. I am not in favor of the proposed design. All the applicant has done is maximize the number of lots with little regard for wetlands or topography. There are too many wetland crossings. The drainage outlets cannot direct runoff immediately into wetlands or water bodies. They should be directed into retention/detention structures and then enter wetlands via grassy swales. The wetlands line has not been reviewed and the lots may not meet the 75% CBA requirement. North Andover Mills may be closed tonight (12/4) and I anticipate a decision by 12/18. The issues remaining include the wetland replication plan and the design of the drainage system. The proposed building shall be have a full fire suppression system installed ( fire sprinklers ) . The fire department connection as required in Section 1014 . 1 of the building code will not be required on the sprinkler riser for the building but shall be connected to the central fire department connection for the complex . This central connection point is in a concrete pit beneath the fire department connection shown on the plan. 2 . The building shall include a full fire detection system comprised of pull stations , horn lights, smoke detectors, control panel, remote annunciator and other devices as may be required. The zoning of this system and its relation to existing systems is of great importance to the fire department . 3 . The Chief and the Fire Prevention Officer will be available to work with subcontractors for the installation of the suppression and detection system. 4 . Access to the rear of the building by the construction of the twenty foot wide driveway is suitable for fire department access . 5 . Access to the front of the proposed building in the "courtyard" area shall provide fire department vehicular access to the buildings on the perimeter of the courtyard. 6 . Two hydrants of the typed approved by the DPW shall be located off the proposed twenty foot wide drive. One of these hydrants shall be provided by relocating the existing hydrant at the Northeast end of the proposed building to the edge of Southeast edge of the drive. The second hydrant shall be on the Northeast edge of the drive in the area where the drive enters the turnaround. It is preferred that these hydrants have their water supply from the municipal water system. 7 . The developers shall notify the fire department and work with them for the fire protection measures required for special protection areas, i. e. computer rooms, clean rooms, flammable storage areas . 8 . LACY STREET - COMMON DRIVE Without the inclusion of built in fire protection for the proposed dwelling the fire department is opposed to the plan as flubmltted . Water Street is a residential/commercial street with pedestrian traffic and on street parking that would be negatively impacted by large trucks. C. Access from High Street to the north seems more appropriate. The NACC orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. GENF•`72AL CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3 . This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three year from the date of this Order. 5. This order may be extended by the issuing authority for one or more periods of up to one year each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Where the Department of Environmental Protection is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11. Upon completion of the work described herein, the applicant shall request in writing that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. The work shall conform to the following plans/documents (except as noted in the remainder of this document where revisions may be required) : (a) Notice of Intent filed by Kaminski & Associates filed on November 8, 1991. (b) Plans prepared by Kaminski & Associates: Sheets 1 of 4 11/20/91, 2 of 4 12/2/91, 3 of 4 12/4/91, 4 of 4 Revegetation and Construction Sequence undated but submitted 12/10/91. The following wetland resource areasare within the 100' buffer zone of the proposed work: bank, land under water, bordering land subject to flooding, and bordering vegetated wetland. These resource areas are significant to the interests of the Act and Town Bylaw as noted above. These resource areas are also significant to the recreational and wildlife interests of the Bylaw. The applicant has not attempted to overcome the presumption of significance of these resource areas to the identified interests. 14. The NACC agrees with the applicant's delineation of the wetland resource areas on the site as shown on the plans dated 11/20/91. . ... ...... ........................................................................... #242-563 North Andover Mills 4 PERFORMANCE & DESIGN STANDARDS 15. The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site to construct a manufacturing facility with associated parking and landscaping will cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland resource areas beyond those proposed in the Notice of Intent and approved herein, a twenty- five (25) foot no-disturbance zone and a fifty (50) foot no- construction zone shall be established from the edge of the adjacent wetlands except at the bridged section of the building. No disturbance of existing grade, soils or vegetation is permitted in the no-disturbance zone. 16. No earthen embankment in the buffer zone shall have a slope steeper than 2: 1. Any slopes of steeper grade shall be rip- rapped to provide permanent stabilization. Slopes on the inside of the proposed detention basin shall be no steeper than 3:1. 17. All effluent catch basins shall contain oil/gasoline traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/gasoline traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Compliance is issued and the owner or his/her agent shall so specify in the request for a Compliance. 18. The NACC finds the applicant's proposal for 1550 sq. ft. of wetland replication to be adequate. The Replication areas shall be constructed prior to other construction activity on site and this sequence shall be reflected in the construction sequence. At least 750 of the surface area of the replacement area must be established with indigenous wetland plant species (listed as OBL, FACW or FAC by USF&W) within two growing seasons. Invasive weed species such as loosestrife will be disregarded when calculating the success of the wetland replacement area. One growing season is considered approximately from March 15 to October 15. CHANGES 19. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be significant, the NACC will call for another public hearing (at the expense of the applicant) . Within 21 days of the close of said public hearing the NACC will issue an amended or new Order of Conditions. Any errors found in the plans or information submitted by the applicant shall be considered as changes. #242-563 North Andover Mills 5 20. The proposed project may be still under review by other local or state boards or agencies. This may result in changes to the project plans or wetland impacts. If any such changes occur, a final set of plans and a letter from the professional engineer, land surveyor or landscape architect who prepared these plans shall be submitted to the NACC for review and approval prior to the start of construction. Said letter shall describe any and all changes between the final plans and those reviewed and cited above by the NACC. No work shall begin on a project until written approval has been granted by the NACC. CONSTRUCTION 21. The applicant shall contact the Conservation Office prior to site preparation or construction and shall arrange an on-site conference with an NACC representative, the contractor and the applicant to ensure that all of the Conditions of this Order are understood. This Order also shall be made a part of the contractor's written contract. The applicant or contractor shall notify the NACC in writing of the identity of the on-site construction supervisor hired to coordinate construction and to ensure compliance with this Order. 22. Upon beginning work, the applicant shall submit written progress reports every 1 months detailing what work has been done in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence. 23 . Wetland flagging shall be checked prior to start of construction and shall be re-established where missing so that required erosion control measures between construction activity and wetland resource areas can be properly placed. 24 . Prior to any activity on the site, a row of staked hay bales backed by a siltation fence shall be placed between all construction areas and wetlands. The erosion control barrier will be properly installed and placed as indicated on the plan and shall be inspected and approved by the NACC prior to the start of construction and shall remain intact until all disturbed areas have been permanently stabilized to prevent erosion. All erosion prevention and sedimentation protection measures found necessary during construction shall be implemented at the direction of the NACC. 25. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of 50 hay bales and sufficient stakes for staking these bales (or an equivalent amount of silt fence) . Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion. #242-563 North Andover Mills 6 26. The applicant will submit a certified foundation plan stamped by a Registered Land Surveyor once the foundation has been completed and prior to the construction of the building itself. A letter will also be submitted detailing any differences between the approved footpring and the foundation plan. 27. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. If the latter course is chosen, stabilization will be considered once complete vegetative cover has been achieved. 28. No exposed area shall remain unfinished for more than thirty (30) days, unless approved by the NACC. 29. There shall be no stockpiling of soil or other materials within twenty-five (25) feet of any resource area. 30. The area under the bridged section of the building will be rip rapped to prevent erosion. 31. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant as soon as practical. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. 32. Washings from concrete trucks, or surplus concrete, shall not be directed to, any drainage system or wetland resource area. 33 . All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters at the site for the storage and removal of such spent construction materials off-site. 34 . Accepted engineering and construction standards and procedures shall be followed in the completion of the project. #242-563 North Andover Mills 7 OTHER CONDITIONS 35. Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate and/or effect compliance with this Order of Conditions. The NACC reserves the right to require, following field inspection, additional information or resource protection measures. 36. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding or storm damage. 37. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. This Condition shall survive this Order of Conditions, and shall run with the title of the property. This condition is issued under the authority of the Town's Wetland Protection ByLaw. 38. Fertilizers utilized for landscaping and lawn care shall be organic and low-nitrogen content, and shall be used in moderation. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition is issued under the authority of the Town of North Andover's Wetland Protection ByLaw. 39. The conditions of this decision shall apply to, and be binding upon, the applicant, owner, its employees and all successors and assigns in interest or control. 40. A proper bond or a deposit of money running to the Town of North Andover shall be provided in the amount of $20, 000 which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC's review and approval. This condition is issued under the authority of North Andover's Wetlands Protection Bylaw. 41. In addition to the requirements of Conditions No. 11, the applicant shall submit a letter to the NACC from a Registered Professional Civil Engineer certifying compliance with this Order of Conditions and the approved plans referenced herein (or approved revisions) . A letter from a qualified wetland scientist certifying compliance with local/state regulations is also required for the wetland replication/restoration area.
