Dear Mr. Long: The Planning Board held a public hearing on May 3, 1990, in the Town Hall , Selectmen ' s Meeting Room, upon the application of Watts Regulator, P. O. Box 628, Laurence , MA. , requesting approval under Section 8 . 3 of the North Andover Zoning Bylt -1. The hearing was duly advertised in the North Andover. Citizen on April 18 and April 25 , 1990 and all parties of interest were properly notified . The following members were present: George Perna, Jr: . , Chairman, John Simons, Clerk, Erich Nitzsche and John Draper . Jack Graham was absent. The petitioner seeks Site Plan Approval for the construction of a 4,000 sq. ft. addition to an existing structure , to be used as offices . The premises affected is located aL the intersecLion of Chestnut Street and the Salem Turnpike , Route 114 , in are Industrial-1 ( I.--1 ) Zoning District. John Simons read the legal notice to open the public hearing . A letter was read from Watts Regulator to Karen nelson, Director of Planning and Community Development. Carlton Brown, Pori: Engineering, presented the I30a1-d With a few facts . 1 . Proposed is an 80 ' x50 ' addition 2 . Minor development 3 . No increase in employees 4 . No wetland involved 5 . No Notice of Intent needed 6 . No increase in run-off . Page 2 : Christian Huntress, Town Planner, stated that the applicant would be going before the Technical Review Committee on Friday. Chris also stated that he has spoken to Mr. Borne with regard to the lighting and it will be addressed . George Perna scants boxed lighting to reduce the lighting situation on Marian Drive . This will be part of the consideration of this Special Permit. John Draper asked about landscaping . John Simons grants the land abutting the residential area buffered with four season type of trees . George Perna would like to see renderings of what the proposed will look like from Route 114 . Paul Hedstrom, Oakes Drive , stated that other towns are requiring 10 foot trees at a cost of $150 . 00 each, mature trees to buffer. Pat Cavanaugh, Marian Drive , stated that the addition would bring the building closer to the residential area. Joan Grover, Marian Drive , asked how close to her home the proposed addition would be . Carlton Brown told Mrs . grover that the proposed would be about :310 feet. Carlton Brown was told by the Board to work very closely with the Technical Review Committee . A motion was made by John Simons to continue the public hearing to May 17 , 1990 . The motion was seconded by John Draper and voted unanimously by those present. On May 17 , 1990 the Planning Board held a regular meeting . The following members were present: George Perna , Jr . , Chairman , John Simons, Clerk, Erich Nitzsche and John Draper. Jack Graham was absent. Christian Huntress, Town Planner went over concerns that the Board had expressed. Those concerns being the lighting of the area and the landscaping. Chris has spoken with Mr . Horne and after 10 : 00 p. m. the four lights that still pose the probl.e€n gill be shout off . The Board requested that a condition be in the decision relating to the lights and additional landscaping will be required for the site . The Board will visit the site before the next meeting . A lengthy discussion took place on lighting of the site . A motion was made by Erich Nitzsche to continue the public hearing to June 7 , 1990 . The motion was seconded by John Draper and voted unanimous by those present. On June 7 , 1990 the Planning Board held a regular meeting . The following members were present: George Perna, Jr. , Chairman , John Simons , Clerk, Erich Nitzsche and John Draper . Jac}: Graham was absent. Page 3 : Christian Huntress, Town Planner, gave the Board copies of a draft decision. George Perna visited the site in the evening and the situation seemed to be better with four of the lights turned off . He suggested that pine trees be planted to add a buffer area . A motion was made by Erich Nitzsche to approve the Watts Regulator Site Plan Review in accordance with the draft decision and amending Condition #15 to read "A minimum of 10 red pines" be added. The motion was seconded by John Draper and voted unanimous by those present. Attached are those conditions which the Planning Board based its approval . NORTH ANDOVER, MA SITE PLAN REVIEW APPROVAL, SECTION 8.3 OF THE NORTH ANDOVER ZONING BYLAW. The Planning Board makes the following findings regarding this Site Plan Review Application as required by section 8 . 3 of the North Andover Zoning Bylaws: FINDINGS OF FACT: 1.. The proposed use and site design for this lot are appropriate, due to it's location in Town. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided. 3 . The landscaping plan as shown and revised, meets the requirements of section 8 .4 of the Zoning Bylaws, with the addition of the following conditions. 4 . The site drainage system is designed in accordance with the Town Bylaw requirements. 5. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8 . 3 of the Zoning Bylaw. 6. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this proposal generally complies with the Town of North Andover Zoning Bylaw requirements as listed in section 8 . 35 but requires minor conditions in order to be fully in compliance. Therefore, in order to fully comply with the approval necessary to construct the facility as specified in the Site Plan Review application before us, the Planning Board hereby grants a approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. The plant bed located around the existing structure shall be continued around the proposed structure in the same style and manner. Further, the four cherry trees shown on the plan as "To Be Relocated" shall be relocated to the south side of the proposed addition. 2 . The material used in construction of the proposed addition shall be of the same material used for the existing structure. l 3 . Any Plants, Trees or Shrubs that have been incorporated into the Landscape Plan approved in this decision, that die . within one year from the date of this approval, shall be replaced by the owner. 4 . Prior to the issuance of a building permit the applicant shall place erosion control measures on site as directed by the Town Planner. 5. All Planning Board Order of Conditions are to be placed upon the recorded final plan, ( Cover Sheet ) prior to Planning Board endorsement and filing with the Registry of Deeds. G. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 7 . Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 8 . All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 9 . No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 10. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 11. All buildings shall have commercial fire sprinklers installed prior to the issuance of the Certificate of Occupancy, per order NAFD. All fire suppression systems shall be in accordance with the rules and regulations of the 3 NAFD. 12 . Prior to a Certificate of Occupancy being issued for any structures, this site shall have received all necessary permits and approvals from the North Andover Board of Health. 13 . Prior to a Certificate of Occupancy being issued for the structure, the site shall be reviewed by the Planning Board. Any screening as may be reasonably required by the Planning Board shall be added at the owners expense. 14 . The four main lights in the rear parking lot, numbered one through four on the approved site plan, shall be turned off after 10 : 00 pm every evening. A note to this effect shall be placed upon the final plans. In addition, the applicant shall place two additional walkway lights around the south side of the proposed addition. 15 . A minimum of 10 Red Pines (Pinus Resinosa) shall be planted along the existing vegetation line between the residential neighborhood and the existing Watts Regulator Building. These Pines shall be ten to twelve (10-12) feet in height and spacing shall be no more than Twenty (20) feet. Exact location and quantity shall be as determined by the Town Planner.
