Pledge of Allegiance
Pursuant to Chapter 20 of the Acts of 2021, this meeting of the North Andover Conservation Commission will
be conducted in person and via remote means, in accordance with applicable law. Specific information and the
general guidelines for remote participation by members of the public and/or parties with a right and/or
requirement to attend this meeting can be found on the Town's website, at www.northandoverma.gov. For this
meeting, in person attendance of applicants, their representatives, members of the public and Commission
members will be permitted Members of the public who wish to watch the meeting live may do so on their
televisions by tuning to Comcast Channel 8 or Vernon Channel 26 or online at www.northandovercam.org.
Every effort will be made to ensure that the public can adequately access the proceedings in real time, via
technological means. In the event that we are unable to do so, despite best efforts, we will post on the Town of
North Andover website an audio or video recording, transcript, or other comprehensive record of proceedings as
soon as possible after the meeting. If the public would like to participate in public hearings, but not attend the
meeting in-person, please email your question/comment prior to or during the meeting to

• The Administrator provides background on the proposal. Pre-construction requirements were met, and the
work has been completed.All areas of disturbance have been stabilized for the winter. The Administrator
recommends keeping the EO in place. Once the area of work is fully stabilized in the spring the EO can be
lifted, and the Applicant may apply for a COC.
• Mike O'Neill, Consulting Engineering Services is present for questions.
• Mr. Mabon questions if the EO required a performance bond and if NHESP has responded.
• The Administrator states a response was received from NHESP stating the work will result in no impact/no
take. The performance bond will be conditioned in the Order.
• The Commission discusses the proposal and how to proceed.

• The Administrator reviews the proposal for the sewer line replacement/repair in 3 different areas of town. The
Ipswich Street area involves the replacement of 200-linear feet of existing 8-inch clay pipe to be replaced with
8-inch PVC. The area consists mainly of Japanese Knotweed and bittersweet, with limited removal of small
saplings. The work is within the 25-foot NDZ, 50- foot NBZ and remaining Buffer Zone. The wetland
delineation was reviewed by the Field Inspector and found to be accurate.
• Rhianna Sommers, Epsilon Associates & Shannon Beaton, Woodard& Curran are present on behalf of the
Applicant.
• Mr. Capachietti requests that all excavated soil/roots be removed from the site to prevent the spread of the
knotweed.
• Mr. Mabon confirms that the Administrator is satisfied with the dewatering detail provided and whether
construction access is an issue.
• The Administrator states she is satisfied with the dewatering detail however a location must be determined,
which can be done at an on-site consultation. Construction access is not an issue; the manhole is at the edge of
the paved roadway.
• The area of Morningside Lane consists of two 10-foot sections of pipe requiring repair. The work is entirely
within a paved ROW in the Buffer Zone,just inside 50-foot NBZ. All areas will be returned to pre-existing
paved conditions. The narrative does not speak for the need of dewatering in this location. Staff reviewed the
wetland line and found W2 Series to be accurate. Flag changes on the W3 Series wetland(IVW)were
requested. These revisions do not impact the project in anyway,revised plans have been provided .
• Mr.Napoli requests a dewatering plan be provided, and location to be determined in the field, due to high
water levels in this area.
• The Administrator states Flagship Drive is the final area proposed for 230-linear feet of existing 8-inch clay
pipe to be replaced with 8-inch PVC. All of the proposed work is outside of NACC jurisdiction. She
requested this area be included in the NOI due to the proximity to 40 Flagship Drive,which is under a current
Enforcement Order, so that the Commission was aware of work being done in this vicinity. The work will
occur entirely within the paved ROW, all areas will be returned to pre-existing paved conditions.

• The Administrator states the proposal is for the replacement of a failing septic system. The new septic system
will be conventional pipe and stone. The majority of the leaching field is outside the 100-foot Buffer Zone.
The wetland line was reviewed, and one flag change requested. Flag A3 was moved 3-feet back and made no
significant impact to the project. The property contains NHESP habitat and 100-Year Floodplain, however all
work is outside of these zones. The construction access and stockpiling area are depicted on the plan. The
design was approved by the Health Department. The Administrator states that during a site visit she noticed
unauthorized encroachments into the 25'-foot NDZ and 50-foot NBZ in the form of a gravel area and 10-foot
metal posts with fabric netting. A Certificate of Compliance was issued in 2005 for OOC 242-1241 to the
same homeowner. The as-built plan accompanying the COC request showed no disturbance in the 25-foot
NDZ at that time. The Administrator recommends issuing an Enforcement Order requiring restoration of the
area to be completed by late spring.
• Thorsen Akerley,Williams& Sparages states the system is not in a catastrophic failure; however there has
been charge out of the distribution box at times. The Applicant is hoping to replace the system this winter if
the Health Department and weather conditions allow.
• The Administrator states the project cannot close tonight; a DEP number has not been assigned.
• Mr. Mabon requests they refine the proposal to include restoration of the 25-foot NDZ.
• The Commission agrees the performance bond required in the OOC will need to cover the cost of the
restoration to remedy the violation.
• Mr. Akerley states the area in question was lawn when the home was purchased. The homeowner has agreed
to remove the posts and gravel and requests to re-establish the area as lawn rather than plantings. He requests
that the Commission keep in mind that the proposal doesn't require a lot of work when determining the bond.
• Mr. Manzi states anything within the 25-foot NDZ requires revegetation with plantings.

Request for Determination of Applicability
Glennie Woodlot/Town Farm Boardwalk(FONAT)
• The Administrator provides background on the proposal heard at a previous meeting. Concerns regarding the
beavers were addressed. The Administrator has spoken with Mr. Rand who no longer opposes the project. A
response was received from NHESP stating the work will result in no impact/no take.
• Mr. Manzi requests additional language be added to the DOA to continue the work to eliminate the beavers
from the area. He believes that breaching the dam and trapping the beavers is not a permanent solution. He
suggests the NACC require written communication from FONAT with regards to the beaver activity.
• The Commission discusses the proposal and agrees written communication will be required twice a year.
• The Administrator states the DPW has licensed trappers on staff who are experienced in dam breaching. They
are trying to be more intentional with their management and intend to revisit this area.
• Rob Jones, FONAT states their goal is to maintain the trails and is willing to do what is needed to get the
project approved.
• Mr. Manzi states he does not intend to burden FONAT and suggests that if any FONAT members see
increased beaver activity to simply contact the Conservation Department to inform the Town.

• The Administrator states the project is for the construction of a second story addition over the same footprint
of an existing sunroom. The Contractor proposes to install 2'x2' crushed stone infiltration pits at gutter
discharge to infiltrate new roof gutters. A sketch of the cross section has been provided. The corner of the
existing sunroom is approximately 85-feet from the BVW. The Administrator provides history on past
permits for the property. All proposed work will be done by hand, no machinery is required. The stockpile
area and dumpster will be located in the driveway.
• Mr.Napoli expresses concerns with the soil conditions with the added weight of the addition.
• Michael Trautwein,the homeowner states the Building Inspector visited the site when they excavated under
the foundation and deemed the material acceptable.
• Mr. Capachietti states he is okay with the Applicant moving the infiltration trenches further away from the
house if there is a full foundation.
• The Administrator recommends issuing a Negative Determination#3 with conditions requiring pre and post
construction inspections and all materials to be taken off site.

• The Administrator states the project is for the restoration of the retaining wall and in-kind replacement of the
patio. She describes the construction means and methods, all work will be performed by hand. The proposed
work will be located approximately 20-feet from the IVW at its closest point. The wetland was delineated by
Norse Environmental,reviewed by the Field Inspector and found to be accurate. A sketch plan depicting the
layout was provided. After consulting with the Chairman,he felt an RDA would be appropriate as long as all
work was performed by hand, only in-kind replacement with no expansion.

• Mr. Manzi does not believe an RDA is the appropriate application for the project. Due to the proximity to the
resource area and the need for a surveyed plan he believes an NOI is required.
• James Boyle,the homeowner,believes the broken patio is a safety risk. No work is proposed on the wetland
side of the retaining wall.
• Mr. Capachietti believes after reviewing the scope of work, an RDA is appropriate, erosion controls are
necessary.
• Mr. Mabon agrees that erosion controls are necessary and questions what if the proposed wall is not
structurally sound.
• Mr. Boyle states if the wall is not structurally sound and equipment is required,he will seek further guidance
from the NACC. After listening to the discussion, he intends to repair the wall and replace the patio in the
same footprint.
• Mr. McDonough questions if a waiver is required.
• Mr. Manzi states a waiver is not required for an in-kind replacement or repair.
• The Commission discusses the project and how to proceed.
• The Administrator recommends issuing a Negative Determination#3 with conditions requiring pre and post

• The Administrator states the project is for the construction of an addition which will be recessed into the rear
of the house to be supported by a single sonotube. The addition will be no closer to the wetland than the
existing corner of the garage. She reviews the construction means and methods, excavated soil to be removed
via wheelbarrow. The wetland consists of an IVW located off the property within the Royal Crest
Development. The wetland is governed by an ORAD issued to Royal Crest in 2019. The Buffer Zone
setbacks depicted have been scaled off from the Royal Crest plans. The sonotube will be 98-feet from the
wetland and the addition will be 90-feet from the wetland at its closest point. The rear yard is flat and
separated from Royal Crest by a stone wall. Erosion controls are proposed along the 50-foot NBZ. She
recommends issuing a Negative Determination#3 with conditions requiring pre and post construction
inspections and no machinery will be permitted within the Buffer Zone.
• Mr. Capachietti states the erosion control must be kept on the subject property.

• The Administrator provides background on the Order issued in November of 2004. The site is stable,wetland
markers are in place and vernal pool setbacks were respected. Deviations include the location of the concrete
pool apron/patio is 58-feet vs. 54-feet, moving it further away from the wetland. Per the hearing minutes, the
cabana on the approved plan was not compliant with ZBA setbacks and needed to be moved,the modification

for a new location was approved administratively. The fence encloses the pool, apron/patio &cabana, as
opposed to the entire portion of the rear yard as originally proposed. She recommends issuing a full

• The Administrator provides background on the Order issued in December of 2019. She reviews modifications
approved by the NACC during the project. The modifications to the basin were completed in late summer
2021, the design engineer made a number of observations of the basin during and after storm events and
reported that it is functioning as designed. The site is stable,rip rap discharge area is in good condition with
no areas of scour or concern. The re-established Swale appears to be functioning as designed. Wetland
markers are in place, and plantings installed and are doing well. She recommends issuing a full Certificate of
Compliance, with on-going conditions as prescribed in the Order.
• Josh Hasenfus, The Trustees of Reservations and James Borrebach, engineer, are present for questions.
• Mr. Capachietti questions if the COC request is for work to the pond only.
• The Administrator reviews the work governed in the OOC.

• The Administrator states the Amended Enforcement Order issued at the Dee 8, 2021, meeting conditioned
that daily fines be assessed if a NOI was not submitted by Dec 28,2021. An NOI has not been received and
fines are being assessed daily. The Field Inspector conducted a site visit today and reports that the large

stockpile of soil at the rear of the site is currently being trucked off site and frac tanks containing sediment
(empty of water) are on-site. Site personnel informed the Field Inspector that the Applicant intends to clean
the frac tanks on-site,no cleaning details have been provided. The wetland consultant preparing the NOI
confirms they will meet the deadline for the Jan 26, 2022, meeting. The Applicant was not responsive
regarding attendance for tonight's meeting.
• Mr. Manzi questions if the dewatering monitor was able to connect with the Applicant.
• The Administrator states the dewatering monitor, and the Applicant were able to connect,pumping is not
required at this time. The basin is not draining/live, it is collecting and stabilized.
• Mr. Manzi questions if additional silt is flowing back into the basin and if it will require additional cleaning.
• The Administrator states because the side of the slopes is stabilized the basin is not receiving the previous
load. They are currently working to remove the larger stockpile of soil from the site.No work has been done
on-site to move the project forward.
• Mr. Manzi expresses concerns with sheet flow due to the frozen ground conditions.
• The Commission discusses the Enforcement Order and agrees to issue an Amended Enforcement Order
for all work to cease and desist,no activity whatsoever is permitted. The site must be prepared for winter
conditions within 48-hours, fines will be assessed for each day the site is not stabilized beyond Jan 15,2022.
The removal of the soil stockpile from the site shall immediately cease. The remaining soil stockpile shall be
re-graded and stabilized. Frac tanks are to remain on-site and are not to be cleaned of sediment while on-site.
Conducting any other work or activity on site shall result in fines of$100 per day.

• The Administrator states the Field Inspector observed a violation during a site visit for a tree removal request
related to installation of solar panels on the roof. The violation consists of a crushed stone walkway,mulch
beds with non-native vegetation and wooden steps within the 50-foot NDZ to certified vernal pool. Historic
aerials and as-built plans for the property were reviewed showing that the area was previously well vegetated
in its natural condition. Department records indicate the current homeowner is the original property owner
from when the subdivision was built. A signed affidavit is on file acknowledging that she received a copy of
the OOC governing the subdivision &understood it. The Administrator recommends the homeowner engage
a wetland consultant to prepare a plan restoring the area to its original condition to be reviewed by the
Commission at its March 9, 2022,meeting. The restoration must be completed no later than May 11,2022.
Two-year monitoring by a wetland consultant is required to ensure 75% overall survivorship of plantings,
monitoring reports due no later than December 1 st of each year.No other work will be considered until the
EO has been satisfied and lifted.
• The Commission discusses the violation of the 50-foot NDZ.

• The Administrator states that staff were made aware of backyard clearing in early December. A site visit was
conducted, and staff observed tree clearing on a slope in the backyard. The homeowner intends to level the
backyard to create more flat usable space. Soil samples indicate that the wetland advanced up gradient,
placing some of the clearing between 75 and 100-feet from the Resource Area. There is a drainage swale
running through the backyard which discharges to the backyard of the abutting property(#40)and into the
wetland. Due to changes in topography and possible changes to the drainage patterns it was determined this
project should be reviewed under an NOI application. After consultation with the Chairman, a cease and
desist letter was issued and a NOI required since this project has potential to change drainage patterns to the
neighbor and the wetland. The homeowners have complied with the directive and engaged the Morin-
Cameron Group to delineate the wetland and prepare the NOI to be submitted mid-March.
• Mr. Manzi questions if erosion control are required.
• The Administrator does not believe erosion controls are required; no stumping has occurred.
• Paul&Duschia Bodet,the homeowners are present.
• The Commission discusses the violation and agrees a progress update will be required at the second meeting
in February.

Performance Bond Calculation Updates
• Mr. Manzi requests additional research be conducted on how various jurisdictions calculate performance
bonds and apply values.
• Mr. Capachietti offers to provide some professional input for discussion.
• Mr. Mabon suggests the Administrator reach out to the previous Administrator for input on the calculations.
Staff Site Visit Fees
• Mr.Napoli would like the fee schedule included in the Order of Conditions moving forward.
• Mr. Capachietti believes it is important not to discourage Homeowners/Applicants from reaching out to staff
with questions/concerns.

• The Commission considers the possibility of additional fees if the NOI requires a SWIPP. Additional research
will be conducted.
• The Administrator states another town recently updated their fees; they canvassed the surrounding
communities to assist in the calculations. She offers to share this information with the Commissioners.

• The Administrator reviews the drafted Order of Conditions.
• The Commission discusses the bond which will be set in the amount of$1,500.00. Williams and Sparages has
been approved as the erosion control monitor. Additional language is added to Condition#66 regarding the
lifting of the EO,which requires recording of the OOC and posting of the bond.
• A motion to adopt the Order of Conditions as drafted and amended is made by Mr. Manzi, seconded by Mr.
Capachietti.
• Vote 5-0, Unanimous.
