Since the time of my inspection, all of the silt fence which I had recommended to be reset has been reset. In addition, regrading of several of the lots to accommodate lawn construction has been completed in a format set forth in the Order of Conditions and on the approved plans for the subdivision. All of the erosion control was in place, and no erosion from the site was observed. The site appears to be in compliance with the Order of Conditions and the approved plans for the project. He requested that DDP review and advise as to your request to remove the large island from the Middle School parking lot to ease snow plowing operations using DPW's large equipment. During the design phase, the middle school site was subject to intensive review by the town's Technical Review Committee, Planing Board and Conservation Commission. Of critical concern to the Planning Board and the project's abutters was the screening of the parking lot and the replacement of trees removed by the project. The island in question is being planted with fifteen foot tall maple trees to meet these requirements. A berm along the south side of the island directs water to the storm drainage system, which has been designed and installed to limit run off to pre-project levels per town requirements. The system includes storm water storage capacity based upon the completed project's paved area; to pave the island would increase run off In short, it will not be possible to pave the island without significant redesign, expense, and the review and approval of the Town Conservation and Planning Departments. The new road will have a sidewalk To build the new road an area of 2352 square feet of flagged wetland must be filled. On April 28, 1995 there was standing water in parts of this area up to one or two inches deep, especially in a narraw channel about two feet wide at the eastern side of the 2352 square foot area. A relatively dense stand of Soft Rush was growing in this channel. Within and immediately around this area the following plants have been observed; Trees: Aspen, Populus tremuloidps White Pine, Pinus strobes Red Maple, Acer rubrum Canoe Birch, Betula papyrifera Small trees and shrubs: Crabapple, Malus species - Buckthorn, Rhamnus frangula Common Elder, Sambucus canadensis Nannyberry, Viburnum lentago Highbush blueberry, Vacclnium corymbosum Low ground cover plants; Sensitive Fern, Onoclea senslbllis Soft Rush, Juncus effusus Wild Lily of the Valley, Malanthemum canadensis Blue Flag, Iris versicolor Sedge, Carix species Partridgeberry, MItchella repens Replication: 1. If two to one replication of wetland area is required, the following is proposed: Create a new area of 4704 square feet, 30 feet wide by 157 feet long parallel and adjacent to the new roadway, and contiguous to and uphill from the remaining wetland. Excavate within this area down to the same elevations that existed In the original wetland area (166, 157 and 158) with sides sloping one foot vertical to two feet horizontal. Over-excavate by 6 inches and then fill the last 6 inches with topsoil (and muck) excavated from the area to be filled. Use topsoil excavated from the 2352 square foot wetland to spread over the lower part of the replication area. Use topsoil stripped from adjacent higher fill areas to spread over the slopes. Before stripping any topsoil in the wetland area to be filled, transplant all of the plants therein, including trees, shrubs and ground covers. Plant the shrubs randomly 4 to 5 feet apart and the ground cover plants 1 to 3 feet apart in the new area so that they are more or less in the same relationship with respect to elevation as they were in their original habitat, For instance, the Juncus and Iris should be planted in the lowest wettest part of the new area. The Sambucus, Comus and Viburnum should also be planted In the tow wet part, but also in slightly higher ground. Discard the alien Rhamnus and do not replant. } 2. All of the tree species mentioned above found in and uphill from the wetland area to be filled, up to 3 inches caliper, should be transplanted If possible . These should be planted throughout the new area, but generally on the slopes at a random spacing of 8 to 10 feet apart. Since this replication is two to one, more trees and shrubs must be added to the transplanting to cover the 4704 square foot area. See the Replication Plant List on the Planting Plan for this additional planting. All new plants as well as the transplants are to be guaranteed for two full years after their planting is conditionally approved by the Architect or his representative. After planting and spreading the native topsoil, the area must be seeded with New England Wetland Plants, Inc Wet Mix which is seed mixture of four sedge varieties, Meadow Grass, Joe- Pye Weed, Soft Rush, Woolgrass, Boneset, and Blue Vervain at the rate of one pound per 2500 square feet . 2. It one to one replication of wetland area (Option A) Is required, the following is proposed: Follow the above instructions for two to one replication except that the replication area will be only 2352 square feet, 15 feet wide and 157 feet wide. Since the area to be covered is the same as the wetland to be filled, the additional plants on the Replication Plant List will not be required unless the transplants die and have to be replaced. Plants and transplants are to be guaranteed for two full years. The Department is not concerned with the islands on each end of the parking lot however the design for the middle island is a problem. My suggestion for the area would'be. to pave it and mark out the island area with paving paint, a similar design can be seen at the Sargent School, If you require further information regarding the subject, please call. Erosion control was satisfactory and work appeared to be following the approved plans and Order of Conditions. The wetland replication area also appeared to be constructed accordingly, however, I offer the following comments: • As required under the local Wetland ByLaw and Regulations, an "As-Built" of the wetland replication area is required within 30 days upon completion of said area; • It is important that the exposed soil within the replication area be seeded with a wetland mixture immediately. A well vegetated herbaceous layer will keep unwanted, less desirable vegetation out and facilitate growth of wetland plants; • In addition, the applicanes biologist shall provide a report to this Department detailing the replication process including but not limited too hydrology, soils and plantings. As I previously stated to the applicant, it is vital that the hydrology be provided in order to "drive" this area. It is understood that the area will be seeded immediately and that the remaining issues will be resolved within 30 days (DEADLINE May 31, 1996). Furthermore, please provide a status report to this Department regarding the project as a whole. DiNisco Design 87 Summer Street Boston, MA 02110 RE: Wetland Replication Planting Plan for the North Andover Middle School (NACC 4) Dear Mr. Rice: Per our discussion on September 21, 1995 and upon receipt of correspondence dated October 17, 1995 1 offer the following comments with regards to proposed wetland replication: 1. Plan modifications as shown on Sheet 1.2.3 entitled "Planting Plan - Wetland and Habitat Replication Plan" dated 9/15/95 result in reduced impacts. With this in mind, I approve this minor modification and appearance before the NACC is not warranted; 2. 1.1 : I wetland replication as required in the above referenced Order of Conditions (NACC 4) remains satisfied (1,120 sq. ft. to 1,232 sq. ft); 3. Planting shall take place in April 1996 when the frost layer has dissipated and conditions are satisfactory for the removal of existing wetland vegetation; 4. A qualified wetland biologist has not been identified. Please forward the credentials and/or qualifications of personnel with demonstrated experience in wetland science. As required under the local ByLaw, this person shall be onsite to supervise excavation, relocation of existing wetland vegetation, and planting; 5. As required under the North Andover Wetland ByLaw, the replication area as proposed shall be contiguous with the existing freshwater wetland. Elevations as proposed (156 - 158) may need to be modified in the field. This is dependent on groundwater elevations at the time of planting and shall be verified through morphological observations in the soil strata. The wetland biologist shall be responsible for determining groundwater elevation and adapting the replication plan accordingly; 6. Detailed information with regards to stockpiling and care of transplanted wetland vegetation is required; 10. Where will the Rhamnus spp. be discarded (3.09(b))?; 11. Written reports are required from the selected wetland biologist twice a year. These reports shall include an evaluation of the wetland replication with special attention given to plant mortality and overall vigor of the resource area; 12. The purpose of this letter is to outline my understanding of our discussion. J 1. Revised Site Drawings (Site Survey 1.1.1, Proposed Construction/Grading plan 1.2.1, Layout Plan 1.2.2, Planting Plan 1.2.3, Site Details 1.2.4, Site Utility Plan SU.2, Site Electrical Plan 11.0.1) were submitted to both Planning and Conservation. In reviewing the drawings, it was noted that the following revisions were made in response to the respective Orders of Conditions issued. 1.1 Addition Location -As was stated in the public hearings, DDP has relocated the addition to preserve more of the existing tree line west of the building. The floor elevation of the addition was also lowered, making the grading between the new site work and the existing areas much less steep. I 1.2 Replication Area-The relocated addition has reduced the amount of wetlands disturbed. At the 1.1. to 1 ratio established by the Conservation Commission, the replication area now totals 1232 square feet. The replication planting schedule has been revised per the Order of Conditions. 1.3 Parking - In accordance with the Planning Board requirements 16 spaces were eliminated to reduce intrusion of the parking lot into the existing tree line. It was noted that the parking was reconfigured slightly at the Parker Road driveway to avoid conflict with the existing athletic field structures and fencing. 1.4 Project Schedule-We reviewed the overall, phased construction schedule. it was noted that work would begin in January 1996 with interior demolition, with foundation work at the addition to begin as early as possible the Spring of 1996. DDP will invite Planning and Conservation (as well as all town agencies) to the preconstruction conference and their respective requirements discussed at the start of that meeting. j i Kenneth DiNisco Richard N. Comments -The following comments were made by Conservation and Planning: 2.1 Revisions -The revisions to the site drawings are consistent with the respective Orders of Conditions issued and a formal resubmittal is not required. 2.2 Cash Bond - DDP will clearly stipulate that the General Contractor post a$2000 cash bond to insure that the site is constructed in accordance with the approved plan and that required as-built drawings are submitted. 2.3 Tree Clearing - DDP will clearly specify that the proposed line of tree clearing be laid out by the contractor for the Planning Departments review and approval using yellow caution tape. This and any other important pre-disturbance measures, such as installation of siltation barriers, will be emphasized at the preconstruction meeting. 2.4 Replication Area- Noting that work will begin before the optimal planting season, the Conservation Department will be flexible as to when the relocation planing is done. It is clear that the intent is that this planing be done as soon as it is likely the plants would survive. A copy of the wetland replication specification is attached for comment. 2.5 Future Parking- DDP will note for record on the site layout drawing the location of the 16 cars that were deleted (and could be latter added, if need be) per the Planning Board. I informed you that it is impossible to meet the requirement that no vents fans, etc. be visible from adjacent roads, given the fact that the existing school sits lower than Chickering Road and that much of the roof is visible from that vantage point. It is our understanding from our conversation that this is a standard condition of the Board that would not be applicable in the case of the Middle School. Should the above not be per your understanding of our conversation, or should you have any other comments or questions regarding the project, please do not hesitate to contact me. The mitigation report divides the site into two areas, Area ]. and Area 2 and attempts to limit peak outflow of Area 2 to 2 cfs for 2 , 10, and 100 year storms . By controlling the peak-outflow to 2 cfs for Area 2, the report shows that adding peak outflow for Areas 1 and 2 will not exceed peak outflow for existing conditions . This is summarized in table 2 . 1 on page 4 of the report. 2 . Limiting Area 2 to 2 cfs is achieved by using a hydrovex valve downstream from 280 ' of 84" pipe, which will also provide a storage volume of 82, 000 gallons . The design also incorporates a 15" bypass at the top of the 84" pipe, as a safeguard for failure of the hydrovex valve. 3 . In the extreme case, i . e. during the 100 year storm, when the bypass is flowing full, the outflow from the bypass will be approximately 2 .5 cfs . This flowrate, combined with the flowrate of 2 cfs from the hydrovex valve yields 4 . 5 cfs . The report indicates a flowrate of only 2 cfs will be produced, shown on table 3 . 2 on page 6 . 4 . The combined flowrate of 4 . 5 cfs when added to the flowrate of 54 cfs from Area 1 , produces 58 . 5 cfs, slightly exceeding the existing flowrate of 58 cfs . However, the difference is small enough to be considered negligible . 5 . The 10 year storm, which was the critical case for limiting Area 2 to 2 cfs, will not produce enough volume in the 84" in pipe for the bypass to start flowing. Therefore, the hydrovex valve will limit the flow to 2cfs, and zero net increase will be achieved. In conclusion, the proposed drainage modifications appear to be adequate in producing zero net increase for peak flowrates for the entire site for the 2, 10, and 100 year storms . On these plans we have highlighted revisions to the proposed design from that previously submitted to the TRC and Planning Board. These changes have been made in response to comments and concerns raised by the Conservation Commission and the neighbors and are summarized as follows; Building and Road Location - The new addition has been shifted and the new road located more closely to the a ition. This change minimizes disturbance of the adjacent wetlands, and also preserves more of the existing woods. Site Drainage - The Conservation Commision's positive determination requires that the proposed i ign maintain a flow of storm water into the wetlands. The drainage calculations have been revised to determine the existing flow into the wetlands. The proposed drainage system has been revised to discharge a portion of the paving and roof area into the wetland through anew seepage trench. With this change, post development storm water conditions are unchanged at the connections to the Main Street storm drain line as well as into and through the wetland area. Tree Line - The proposed plans as submitted previously to the Planning Board showed the wooer ing cut back approximately 80 feet at the new addition (110 feet of woods cut for construction, with approximately 30 feet of new trees added). The plans as revised for the Conservation Commission submission show a new tree line approximately 43 feet from the existing tree line. The new tree line includes new trees and the 4704 square foot (2.1)wetland replication area. Drainage - Under Option A, the post development flow into the wetlands would be less than the predevelopment flow. This would be accomplished by not directing any contribution from the pavement or roof into the wetlands (in other words, the storm drainage would be entirely piped to Main Street, per the previous submission to the Planning Board). In our opinion, this option would not only meet the Conservation Commission's performance standards (that the wetland area stay adequately wet), but would also alleviate some of neighbor's concerns about flooding as it currently exists. 2. Replication Area - In order to create the contiguous wetland replication area, existing woods must first be cleared (refer to wetland narrative). Under Option A, the replication area would equal the disturbed wetland area (2352 square feet versus 4704 square feet at 2:1). By so doing, the original total wetland area is preserved, and disturbance of the existing woods is reduced. Dear Mr. DiNisco: Per our discussion and upon inspection of the mapped wetland resource area on March 21, 1995 as shown on the town wetland maps (I.E.P. 1970), it is the opinion of this Department that the area in question does not meet the definition of a wetland resource area as defined under 310 CMR 10.00. 1 base this on the following reasons: 1. Although wetland vegetation is present it does riot border on any creek, river, stream, pond or lake as defined under 310 CMR 10.02(l); 2. Based on the site's gradually sloping topography and lack of a defined basin/depression, I am not of the opinion that this area meets the statutory requirements for Isolated Land Subject to Flooding (ILSF) as defined under 310 CMR 10.57 (2b). I do not believe this area is subject to Federal jurisdiction as an isolated wetland as defined by the Army Corp. of Engineers. However, as stated in the North Andover Wetlands Protection ByLaw regulations, the definition of a Freshwater Wetland is as follows: "...an isolated or previously disturbed area that meets at least mw of the following three crileiia: (a) the vegetational community consists of at least 50% ivellaildplant species (listed as OBL, TA C W, PAC by USPV); (b) hjUiic soils are present; (c) hydrology or field indicators of hydrology are present. " Based on the seasonally high water table and on-site runoff, hydric soils are Iikely to be present (condition (a) above). An initial inspection of the areas vegetative make-up indicates the presence of typical wetland vegetation such as red maple, highbush blueberry and viburnum spp. interspersed among upland species. A detailed inventory of the sites vegetation is warranted and will need to be performed by a competent wetland scientist or environmental engineer. An actual wetland delineation may need to be performed at this time. At the very least, a report describing the site's vegetative strata should be submitted to this Department for review. Upon receipt of this report I would make myself available for a secondary, more detailed inspection of the site where time would be made available to review the delineation.
