Dear Mr. Nicetta;
The North Andover Housing Authority, in discussion with
the Project Architect for our Second Street project has been
informed that you have some concerns with it . Basically the
property line between the Vincent Lander' s School Street property
and the rear of the building adjacent to Messina' s shopping
plaza, and lack of walkways at the rear entrances to the building.
The Authority has contracted with Al McGregor Fence Co. ,
Inc . to install a chain link fence starting at Terry Lander' s
stockade fence , straight across for 104 ' , then cutting across
to abut to the building to prevent access to the Northeast corner. .
On the other side of the building it will swing along the curve
on the upper bank for 114 ' beginning at the Authority' s existing
chain link fence then again abutting the building preventing
access to the Northeast corner. This work will be completed
immediately after January 1 , 1989 .
The issue of the walks however, will not be able to be
addressed until spring when the ground is again thawed and the
asphalt plants reopen. The Authority will , however, snowblow,
sand , and salt walkways ( as if they were paved) and shovel the
door stoops to assure that the way is open for anyone attempting
to use the rear entrances . Please be assured that it is stressed
to the tenants to use the front entrance in all but emergency
circumstances.

Dear Mr. Nicetta:
As per our conversation I am writing you in order to clarify the
North Andover Housing Authorities position concerning the property
line between the Second Street Project and San-Lou Reality.
It is clear to us that Mr. Massina is obligated to build a retaining
wall in order to reestablish the grade of our property before he cut
the bank for his new road.As of this time the formal land swap has
not been completed which means that San-Lou' s access road is on the
North Andover Housing Authorities property.
I have also enclosed a letter which was sent to Mr. Massina from the
North Andover Authorities attorney concerning this matter.

Flames be advised that .i represent the North Andover
Housing Authority in connection with the project being
constructed adjacent to your property. As you know from prior
communications with the Authority, we are extremely concerned
over the condition of the embankment separating the new building
from your parking area. It is my understanding that you haVe
repeatedly aesured the Authority that you would be constructing a
concrete retaining wall to prevent continuation of the erosion
that has occurred due to the change in grades resulting from the
work on your site . As a matter of fact, when work on your site
was being performed , the Authority received a letter from Charles
construction confirming that a retaining well would be
constructed to eliminate any erosion. The Authority's building
is approaching occupancy, and we are concerned over the .condition

future to service the Dairy Queen.

Dear Mr. Minicucci:
It has recently been brought to the Planning Board' s
attention that there are plans to include a drive through window
to the Dairy Queen in the Messina ' s Shopping Plaza. Please be
aware that the drive through window has never been approved
by the Planning Board. In addition, any changes to asite plan
review special permit must go before the Planning Board for
additional review and approval. We request, therefore, that
you submit plans to the Planning Board at your earliest convenience;
and that no further work be done with the expectation of a drive
through window until approval is granted, unless otherwise
approved by the Director of the . Division of Planning and Community
Development.
If you have any further questions, please do not hesitate
to contact the Planning Office .

Since my letter to you of 18 Tune 1984, many of the fire
departments concerns have been addressed through the
development committee and other meetings with Mr. Messina.
The comments that I have below have already been brought
to Mr. Messina' s attention.
1 . The addition will require a full sprinkler system
in accordance with M.G.B. Chapter 148 Section 26G
2. Extension of fire detection system from the existing
system will be required.
3. Extension of the Fire Lane along the front of the new
stores will be required.

Driveway entry permits , would be required on the
driveway on First St. and written permission and
possibly Street Opening Permit would be required for
any digging within our Town Streets .

Re: Messina's Proposed Additions
Date: July 2,1984
The Community Development Office has reviewed the plan indicating the
proposed additions on the Messina property. We do have a few concerns which
are outlined below.
1. The curb cuts and traffic flow patterns for both passenger and
service vehicles are not marked on the plan. We would like
to see them clearly indicated so that we can determine if they
reflect the traffic patterns detailed in the approved Downtown
Revitalization Plan. We are particularly concerned with the
seven diagonal parking spaces shown on the School Street
side of the parking area. A major aspect of the Downtown
Plan is to minimize traffic flow in and out of the Messina
lot across from the Fire Station in the School Street
vicinity. That particular access point to the lot is intended to
be for service vehicle use only.
2. We would be interested to know the proposed style of the building
additions and of the corresponding sighs in order to determine
if the design complements the character of the other Downtown
structures.
3. (The plan shows a 32' set-back from the rear of the property.

Dear Sir:
Unclosed please find comments from the. Fire Chief regarding the proposed addition
to Messina's Market on Main Street in North Andover, Massachusetts. Site plans have been
distributed to other town departments and boards for review and comments pertaining to
their concerns. The Site Plan Review is new to the Planning Board since it was passed at
the. last annual town meeting, therefore you may not be aware of it's requirements.
The Planning Board has placed this item on their Monday, July 2nd meeting for review
and discussion purposes. It is suggested that you or a representative from your firm attend
and make a brief presentation to the boards. If you have any questions, you may contact me
at 685-4775.
