Street As per your request, the following is an up date on the status of the construction of the retaining wall at Messina' s Shopping Centre. To date, we have met with the contractor to discuss any changes which may have occurred since the drawing. We have added additional work to the job with regards to water seepage and drainage. Additional, cast figures have been calculated and accepted. A new contract is being written and signed this week. According to the contractor, it will take approximately one week after the signing of the contract for material to arrive on site . This will fall in line with the contractors time schedule to start the job. 2 have since contacted the Housing Authority for information regarding any underground tanks or Lines that may be near the property line . They are working with us and I expect to receive the information this week. Notices of construction will be sent out to 'Tenants. 'Therefore , work should commence within approximately two weeks. Chris, we are working as quickly as possible to coordinate all facets of this construction in not only a timely manner, but also with as little inconvenience to surrounding abutter and tenants . The loan officer in charge of this particular loan had been away for the past two weeks and did not have a Chance to review the application. He has since returned and indicated to me on Wednesday the 26th he now was in the final stages of reviewing the loan . The time frame stated to me by the bank was approximately two weeks before any decision would be made . I have informed the Bank repeatedly of the November 30, 1990 time frame set by this board. They are well aware of the situation and are working as expeditiously as a commercial bank can. -1 will be keeping you informed as need be on any process made . The board has voiced concerns over the last few months with regard to construction of the proposed retaining wall at the above referenced location. More specifically, the slope has remained exposed and must be stabilized during this construction season. The board has granted an extension for completion of the wall to November 301 1990. It is the Planning Boards understanding that the wall shall be built to the specifications as approved in the Site Plan Review Modification issued November 20, 1989 . You have stated that you should receive a final decision with regard to financing of the wall within the next few weeks. I have scheduled you to appear before the board on September 27 , 1990, at that time I would hope you will present your plans for final resolution of this matter. If you should receive financing prior to that meeting I would encourage you to commence with construction immediately and not wait until after you have met with the board to proceed. New Structural plans had to be drawn in order to accommodate the new wall approved. Sample of the soil could not be accurately taken until the soil thawed out. I received the first draft of the plans on April 23, 1990. We plan to finish reviewing the plans by May 1, 1990 and hope to forward a full set of the wall plans to your office by May 9, 1990 . Since we did not anticipate this additional work, I am requesting an extension on the commencement of work from May 1, 1990 to June 1 , 1990. We believe we can hold to the completion date of July 1 , 1990. The wall is anticipated to take 1 2 weeks to complete, depending on the weather conditions . The extension will give us time to bid the job out and coordinate all parties involved. If there should be any questions, please do not hesitate to call me . That error should not be ascribed to Mr. Messina or to any representative of Sanlau Realty, as Mr. Messina has not re- viewed the plans. It was a result of my calling at your office and reviewing the file, wherein only the top sheet of the plans were in same. If there was any misrepresentation, it was on my part after having reviewed your plans and after having made notes. There were no dimensions on the plan which was given me to review. I trust that you will correct this error in the record of the meeting, as it appears to be of significance to you and your board. Gentlemen: In response to your inquiry, I can advise that the rip--rap retaining wall at the above referenced project was designed by Haley & Aldrich, Inc. (Geotechnical Engineers) specifically For this project. A copy of their drawing is enclosed. I understand that there has been expressed a concern with the fact that some of the 3/4" crushed stone, used to fill wall-Face voids, washed out during each of two extremely heavy rain storms this Spring . However . . . 1 . The 3/4" stone is not a part of the structural design of the wall . It was apparently provided gratuitously by the contractor as a finishing visual touch. 2. 1 have seen no disruption of the larger stonework which is a part of the Haley & Aldrich structural design. ; 3. The large volumes of rain-water which poured over the wall appeared to be the result of incomplete roadway work on the uphill side. In one area a section of curb had been removed and not replaced by a contractor, and in the other area, the curbing had not been installed at the owners request. Completed curbing in accordance with design requirements should alleviate this problem. In summary, I have seen nothing at the site which indicates to me that the rip rap wall, as designed by Haley & Aldrich, Inc., is not entirely adequate to its task. This proposed renovation and new construction, in combination with. the Town's efforts to revitalize the downtown clearly demonstrates the public/private partnership that will enhance the economic climate in North Andover's central business district. In a town characteristic of a growing population and expanding need for retail space, Mr. Messina is filling that void and coordinating his proposals with the adopted Downtown Revitalization Plan.
