Soule and 2"d by Joe Edward Smith,the Board voted to GRANT a dimensional Variance from Footnote I of the Zoning Bylaw for relief of 7' from the 100'structure setback of Route 114(Turnpike Street),and relief of 19.5'from the 50'parking setback of Route 114 according to Site Plans Issued for:Request for Variance,Date Issued:July 10,2003, Latest Issue: July 10,2003 Proposed CVS/Pharmacy,Route 114,North Andover,MA,Owner:Peters Street Realty Trust,LLC,c/o Eagle Tribune Publishing Co., 100 Turnpike Street,North Andover,MA 01845,Index Nos. Furthermore,if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be re-established only after notice,and a new hearing.
