RE: MA State Plumbing Variance Application-Millpond Condominium Association

Dear Brian,
We would like to request a plumbing variance for improvements to the clubhouse at the
above referenced condominium complex.
Per the bath/shower requirements outlined within Section 10.10 Table 1 -Pool/Fitness
Center, this variance request centers around the requirement to provide (2) shower stalls
at a private condominium clubhouse that is directly adjacent to an outdoor swimming
pool, a swimming pool that is only available to condominium residents and their guests,
not to the general public.The proposal is to provide (1) gender neutral handicap
accessible shower stall to meet the intent of the bath /shower requirement. The
Homeowner's Association would like to develop improvements to the interior of this
clubhouse and develop more useful meeting and storage space and feels that the
current men's and women's restrooms with showers located on the lower level have
rarely been used since the development was constructed in 1974.This fact has been
attributed to the reality that all condo owners live within walking distance to the
swimming pool and prefer to shower at their own private living quarters instead of using
the showers at the clubhouse. The existing restrooms with showers do not presently meet
accessibility requirements and remodeling them both to meet accessibility requirements
would be very expensive. It should be noted that the improvement plans would provide
an accessible restroom on both levels of the clubhouse,solving the accessible toilet
requirements. It should also be noted that the pool is only open Memorial Day- Labor
Day; it is relatively small and only a few people (less than ten) are ever there at one time
and only one lifeguard working on any given day with no other employees active in the
adjacent clubhouse.There is a cold-water rinse hose available at the pool deck, but as
the adjacent clubhouse has historically only been used for meeting and storage, they
strongly feel that providing (1) gender neutral handicapped shower pragmatically
addresses the intention of having a bath/shower available for residents who may use the
outdoor pool during the few months that it is active. We ask you to please support this
plumbing variance application.
