HomeMy WebLinkAbout19 Ferncroft Circle DOA Negative Determination - Permits - 19 FERNCROFT CIRCLE 2/23/2022 0 CONSERVATION DEPARTMENT Community Development Division NEGATIVE #3 DETERMINATION OF APPLICABILITY SPECIAL CONDITIONS 19 Ferncroft Circle, North Andover At the February 23,2022 public hearing, the North Andover Conservation.Commission (NACC) voted to issue a Negative #3 Determination of Applicability for work at 1.9 Ferncroft Circle that includes comiecting a—1.5" washing machine discharge pipe that is broken (or never cona-tected) .into the existing sewer line. Access will be to the left side of the house, excavation will occur approximately 7-8 feet off the northwest corner of the house. A—6-71ong x —5-6'wide trench will be excavated at a depth of approximately 3-4 feet. A small track excavator will be used for excavation,and spoils will be off loaded to a dump truck to be removed from the site. Work will be occurring approximately 51-feet from the BVW at its closest point,but NO closer than 50 feet from the wetland at any point. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer zones on site and any work that involves ground disturbance or changing the current conditions in these areas will require permitting with the NACC. This includes,but are not limited to,house additions, pools,patios,decks,sheds,fences, garden beds,landscaping and bridge installation,tree or vegetation cutth-ig/pruning. These activities shall be held to the current standards under the Bylaw and WPA. The following Special Conditions shall be complied with: L A pre-construction meeting with the Conservation Department shall be scheduled to review means & methods of work, and observe installation of erosion controls (12"mulch socks-staked &overlapped) between areas of disturbance& the BVW,no closer than 50 feet from the wetland. 2. Appeals The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land upon which the proposed work is to be done, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate Department of Environmental Protection Regional Office(see bjtp ,.HwAW l-nass.92y/servicqA- rqq§��dqp-rgglonakoffices-by @I LqL _ �coijiniLjnfty) to issue a Superseding Determination of Applicability. The request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for Departmental Action Fee Transmittal Form) as provided in 310 CIVIR 10.03(7)within ten business days from the date of issuance of this Determination. A copy of the request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant if he/she is not the appellant. The request shall state clearly and concisely the objections to the Determination which is being appealed.
