DATE NOTICED IN MONITOR : November 9, 2005 Pursuant to the Massachusetts Environmental Policy Act (& L. c. 30, ss. 61-62H) and Section 11.06 of the MEPA regulations (301 CMR 11.00), 1 hereby determine that this project does not require the preparation of an Environmental Impact Report. As described in the Environmental Notification Form (ENF), the project involves the demolition of 10 existing single family houses, and the construction of a new 1-story Walgreen's Pharmacy (14,820 sf), and a separate retail building (11,385 sf) on a 4.42- acre parcel of property located at the intersection of Salem Turnpike and Waverly Road in North Andover. The project includes the construction of a total of 158 surface parking spaces, and supporting stormwater management infrastructure. Site access will be provided directly from Waverly Road and Route 114 (Salem Turnpike). The southwestern portion of the project site abuts wetland resource areas that are tributary to the Shawsheen River and the Merrimack River. The project's estimated potable water supply needs, and wastewater flows (1,365 gpd) respectively, will be served by the Town of North Andover. p��F'intazJ+i7 P,er„yc}i:I S3rsck 2i79I,Pcnl C:rorruriet k'1=to EOEA#13670 ENF Certificate December 9, 2005 The project is subject to environmental review pursuant to 301 CMR 11.03 (6)(b)(14) of the MEPA regulations because the project involves the construction of 150 or more new parking spaces (158 spaces total) and will generate 1,000 or more new vehicle trips (2,066 total daily trips) on roadways providing access to a single location. The project will require a 401 Water Quality Certification from DEP and an Order of Conditions from the North Andover Conservation Commission (and hence Superseding Order(s) from DEP if any local Orders were appealed). The project will also require an access permit from the Executive Office of Transportation (EOT). The project must comply with the National Pollution Discharge Elimination System (NPDES) General Permit for stormwater discharges from a construction site of over one acre from the U.S. Environmental Protection Agency. The proponent should also consult with DEP regarding the recycling of demolition debris (such as asphalt, brick, and concrete), and the proper management of asbestos, which may be encountered during the proponent's demolition activities. The proponent is not seeking state funding or financial assistance for the proposed project. MEPA jurisdiction therefore is limited to those aspects of the project within the subject matter of any required or potentially required state permits that have the potential to produce significant damage to the environment (traffic, wetlands, and water quality). WetlandslDrainage: The proponent's stormwater management plan incorporates the use of BMPs such as deep sump catch basins, parking lot sweeping, a Vortechnic unit, and two stormwater detention basins to achieve, to the maximum extent possible,'80 percent removal of the project site's annual total suspended solids (TSS) load. As described in the ENF, the proponent proposes to construct one stormwater detention basin, located in the southwestern portion of the project site, for eventual discharge to BVW abutting the project site's southwestern boundary. According to the proponent, stormwater flow from the northern portion of the project site will treated through a Vortechnics unit that the proponent proposes to install and connect to an existing MHD catch basin located at the Route 1141Waverly Road intersection. The proponent should consult with MHD's District 4 Office to ensure that adequate capacity exists in the existin6 drainage infrastructure located within Route 114 and Waverly Road to accept the stormwater flows from the proposed project. According to the information contained in the ENF, the project will create approximately 2.1 acres of new impervious surface area. I ask that the proponent consult with the Department of Conservation and Recreation (DCR) to consider incorporating low impact development (LID) design measures into the project design to improve the management of stormwater runoff from the proposed project site. 2 EOEA#13670 ENF Certificate December 9, 2005 I strongly encourage the proponent to consider incorporating the use of such LID measures as permeable surface parking materials and landscaped bioretention areas to significantly reduce the total amount of impervious ar--a and stormwater runoff from the proposed project. Traffic: Using the Institute of Traffic Engineers T. r Generation land use code 881 for Pharmacy/Drugstore with Drive-Through Window, and empirical data from 4 other Walgreen's stores with drive-through windows, and 820 for Shopping Center with Drive- Through Window, the project is estimated to generate a total of approximately 2,066 vehicle trips on the average weekday. As described in the ENF, the proponent has committed to a number of traffic mitigation measures including; the elimination of an existing curb cut associated with the florist building, geometric improvements to a second existing curb cut to meet EOT standards and to serve as the proposed project's primary site access drive, and improvements to the existing curb cut serving the Red Barn Coffee shop. In their comments, the EOT has requested that the proponent consider revising the locatioin of the proposed Route 114 site drive further south. The proponent should work closely with the EOT and the Town of North Andover to satisfactorily address the issues of site access and traffic flow raised by the EOT. Based on a review of the information provided by the proponent and after consultation with the relevant public agencies, I find that the potential impacts of the proposed project do not warrant the preparation of an EIR. Issues related to drainage and stormwater management, and project layout can be addressed during the permitting and environmental review process. 111 A' December 9, 2005 Date StepWn R. The project is locates€on a 4,01,-acre,parcel along Route 114,east of the Route 114f1-495 interchange. The propose project entails the wristruction of a 14,520 squar(� foot Walgreen's Pharmacy, an 11,385 square foot retail store,and 159 parking spaces. Access to the site will be via a sin le site driveway located east of the Route 114/Waverly Road intersection and two drive:nays located along Waverly Road. Based on the infonnation provided in the ENF, the roIcot is expected to generate 2,066 vehicle trips on an average sveek-day. A MassHighwnly permit is required because the roadway abuts Route 114. The ENF included a traffic impact and access study that evaluated the existing and Riture traffic conditio s along Route 114 with and without the proposed project.
