SUBJECT: Two outstanding issues
Dear Attorney Manzi,
It has been brought to the attention of the Planning Department that the wall located at
CVS Pharmacy corner of Peters St. and Rte 114 is in disrepair again. The Chairman of
the Planning Board would like this matter addressed once and for all. Please be prepared
to attend the April 181" 2006 Planning Board meeting at 7:00 pm at Town Hall to address
this issue.
The other matter is the recording of the decision and signing of the mylar and the posting
of a bond with the Planning Department for Walgreen's Pharmacy. Please bring a mylar
so the Planning Board can sign it the night of April 181". You will then need to get an
attested to copy of the decision from the Town Clerk's office have it recorded along with
the signed mylar at the Registry of Deeds. Bring 3 paper copies of the recorded plan and
a cash register receipt of the recorded decision to the Planning Department then you will
be required to file a bond with us.

SUBJECT: Walgreen's Pharmacy
Dear Attorney Manzi,
Please be advised that until all of the proper recording information has been done for the
Walgreen's Pharmacy project no building permits may be obtained from the Building
Department. Apparently, a contractor for this project came into the Building Department
today and requested to pull permits to start building the Walgreen's project.
Per my previous memo to you dated April 3, 2006 advising what the process is relative to
obtaining the proper recording information please be advised that we will place you on
the Planning Board agenda for April 18`s for the Board to sign the mylar, once all of the
recording information has been submitted to the Planning Department your client will
then be able to begin to work with the Building Department.

RE: Modifications to the Walgreen's Pharmacy and Retail Building
Dear Attorney Manzi:
At the regularly scheduled North Andover Planning Board meeting held on January 17, 2006 the
Board voted unanimously to waive Site Plan Review to allow the removal of the drive-through
facility from the retail building, modify the drainage plan to incorporate the changes
recommended by the Town Engineer and decision issued by the Conservation Commission, and
certain grading and landscape improvements. In addition the modifications previously stated, the
Planning Board further requested the following:
1) Eliminating the parking space and protruding curb located at the right-in right-out access
off of Rte, 114/Turnpike Street.
2) Erecting a black steel fence surrounding the detention basin. Location and details of said
fence will be added to the final Site Plan.
The waiver is limited to the improvements proposed under this modification and shown on the
Site Plan dated January 10, 2006. Any additional activities beyond the scope of this waiver will
require Site Plan Review.

Retail pet store
• Waverley Road&Turnpike Street(Map 27, Parcels 16-21; 23-26)is in
the Planned Commercial Development(PCD)zoning district.

• Section 15,Paragraph 15.2.1(a)(v)of the Zoning Bylaw states: "v. Re
tail
uses, provided there is no outdoor storage or sate of materials or
products..." is allowed with a Special Permit from the Planning Board and
the site has been granted its Special Permit for retail use.
• Table 1 — Summary of Use Regulations shows Retail Establishment as an
allowed use with a Special Permit in the PCD, including retail related in
store activities, For instance, the new Walgreen's might choose to offer
flu shots. Pet vaccinations would be a similar retail related in-store offer.
• However, Table i shows Veterinary Hospital&Kennel(overnight
accommodation for animals) as not an allowed use in the PCD.

Dear Chairman Nardella:
I have reviewed the proposed uses being requested in the Special Permit from the
Petitioner, Rice North Andover LLC, for a retail pet store at the corner of Waverly Road and
Turnpike Street in North Andover in a planned commercial district and have determined that the
following retail sales uses are allowed in said district under Special Permit: retail sales of pet
food, pet supplies, live tropical fish; live animals(examples hamsters, and guinea pigs), birds
and reptiles (examples turtles and iguanas), pet grooming, pet training services, and appurtenant
veterinary services.

Dear Members of the Board;
In reviewing the proposed modifications to the architecture of the retail building that will be utilized for a
Petro,the following modifications are proposed:
1. A man-door(36 x 84)was relocated from the southwest elevation to the south elevation,
2. Northwest Elevation:The main entry doors were relocated from below the comer"tower"to
the fourth bay from the left(the first bay being the corner"tower.")
3. East Elevation.- What was formerly clear anodized storefront glazing near the entrance was
replaced with windows to thatch the other windows in the wall with a masonry base.
4. Northwest and East Elevations: Signage formerly shown on two sides of corner"tower"has
been located to above colonnade roof on main building face.
