The legal notice was properly advertised in the North Andover Citizen on July 1 and July 8, 1998 and all parties of interest were duly notified. The fallowing members were present; A€iron tescarbeau, Vice C1)aiT-man, John Simons, Cleric, Alberto Angles, Associate Member and Richard Nardella. Kathleen Bradley Colwell, Town Planner, was also present. The petitioner was requesting a special permit to allow for the wmtruQ610n. of a 2 8,0 0 SF amv,mbly hall. The Iocation of the project.is 315 Turnpike Street Rt. t 14) and is in the Residential - 3 R-3 Zoning District, Doug Hanna & John Hollywood of Sasaki and David Breen of Merrimack College were present to represent 315 Turnpike Street. Mr- Hartnet stated that this is for the Cultural arts Center which will contain 600 scats and is 28,000 SF- r- Harhiet stated that this site is to create an academic core. r. Hartnet stated that all utilities will be connected to the utility corridor and they aT-e looking to tie into Andover's sewer- 1&_ Simons had questions in regw-ds to the paricing. The Douglas J. Hailnett, agent for Merrimack" C;oHege, 315 Turnpike Street,NorthAndover, MA 0184 , requested this Spe ial Permi! on June 222, 199& The Planning Board makes the following findings as required by the Nur(h Aixfover Zoning Bylaws Section 8.3 and 10.3: FINDINGS OF FACT; l. The specific site is an appropriate location for the project as it is 10caled corn the campus of the existing Merrimack C;ollcgo. The use as dcvcloped will.not adversely affect the 1ROghborhood as the project is located in the center of the exiting Merrimack College campus. 3. There will be no nuisance or serious hazard to vehicles or pedestikuls, 4. The landwaping approved as a part of thi s plan meets the requirements of Section 8,4 as amended by the Planning Board, of the Forth Andover Zoning Bylaw. . The site drahmge system is dcsig- M in a eoTdance with the Town Bylaw requirements. 6. The bond is also in place to insure that the site is coriAme wd in accordance with the approved plan. As this project involves the expansion of'an existing non-profit orgatzization in North Andover at this location the Planning Board will allow an alternate form of security to be posted. The form of security niust be acceptable to the Planning Department. ) Prior to the start of construction- a) A construction schedule shall be submitted to the Plama ng Staff for the purpose of tracking the construction acid inloririing the public of auticlpated activities on the site. b) During construction, the site must be kept clean and swept regularly. 3) Prior to FORM U verification (Building permit Issuance,), a) The Planning ]Board must endorse the final site plan mylars aTkd three (3) copies of the signed plans must be delivered to the Ylamiing Depunment. b) One certilled copy of the recorded decision must be seibtnittcd to the Planning department. c) lrr accordmice with N.A,D] 1:1 W policy, this project may require 2:1 mitigation of the existing infiltration/inflow from the receiving sewer system. Any screening as may be reasonably ir,quired by the Planning Staff wifl be added at the applicant's expense. b) A firml as-built plan showing final topography, the location or all on- site utilities, structures, cord cuts, parking spaces and drainage facilities must be submitted to and reviewed by the Planning Staff and the Division of Public Woi:ks, ) Any stockpiling of materials (flirt., wood, comtTaction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times to minimize any dust problems that may occur with adjacent properties. Any stock piles to rernain for longer than one week muss lx: fenced off and covered. 7) In an effort to reduce noise levels, the applicant shall keep in optimum work4ig order, through regular maintenance, any and all equipment that shall emanate sounds fimm the structures of site, 8) The hours for constiwtioiz shall bw, limited to between 7.00 a.m. and 7:00 pan.
