Street, North Andover, IA 01845, requested this Special Permit opt June 10. 1999,
The Flaring Board makes the following fmdha s as requircd by the North Andover
Zoning Bylaws Section 8.3;
FINDINGS OF FACT:
€. The specific site is an appropriate location for the project as it is located on the
campus of the existing 1eiTitrtack College,
. The use as developed will Eol adversely a z tct the neighborhood as the project is
located in the center of the existing Merrimack College campus,
3. There will be no nuisance or serious hazard to vehicles or pede�;Irzftw.
4. The landscaping approved as a part of this plant Meets the requirements of Section 8.4
as amerided by the Planning Board, afthe 7 orth Andover Zortit3g Bylaw.
5. The site drainage system iS designed in acce rd.-mc with the 'T'own Bylaw
requirements.
6. The applicant has ma thre requirements of the Town for Sitc plan review as stated in
Section 8.3 of the Zoning Bylaw.
7, Adequate acid appropriate racililics will be provided for the proper operation 0f the
proposed use, The fac ifity will be connectcd to the municipal sewer system in the
Town of Andover_
Finally the Phwning Board finds that. this project generally complies with the Town of
T otth Andover Zoning Bylaw mquiir'em; !nls a<i Iiseed is Section 8.35 but requites

SPECIAL CONDITIONS.
1) Prior to the endursernimt of the plans by the Planning Board, the applicant mast
eontply with the following conditions.
a The. final plan rust be reviewed and approved by the engineeTIT3g consultant, and
the Town Plamer and all fire protection services mwt be approved by Chief
Dolan, and subsequently endorsed by the Planning Hoard. The final plats rciust be
subn-Ated for review within O.nety clays offfing the decision with the Town
Cleric.
b A bond in the amount of twenty thousand ($20,000) dollars must be Posted for
the purpose of insuring that a final as--built pbn sho wiry, the location of all. on-situ
utilities, struc"cs, curb cats, parking spaces, topography, amd drainage l4cilttics is
subrrdaed, The bond is also in place to irisure (hat Lhe site is constructed in
accordance with the approved plan. As this project involves the expansion of an
existing non-profit orgmiizat ion in North Andover at this location the Planning
.Sward will allow an alternate form of security to be po6ted. The Conn of security
must be acceptable to the Planning Department.
Prior to the start of construction-
a) AcianstTuctionschedule shall be subrtdtted to the Plam ng Staff for the purpose of
tracking the construction and inforin6g the public of anticipated activities on the
site.

Department.
d) Prior to verification of the Certifiente of Occupancy:
a) The applicant must subn* a letter from the arcbitect and engincer of the project stating
that the bulb, signs, l=dscaping, lighting and site layoutwbstantiaUy comply with
this decision as endorsed by the Planning Board.
b) The building must have any and all fire protection services installed in accordance
with the North Andover Fire Department.
5) Prior to the final release of security.-

the plan or design of the building, as presented to the Pbnning, Board. nmy be subject
to modifca#ion by the Planning Board.
14)Any revisions shafl be submitted to Lbe Town Planner for review. If these revisions are

approval.
