The legal notice was properly advertised in the North Andover Citizen on .duly 16 & July-23, 1997 and all parties of interest were du€fir notified. The following members were present- Richard S. Rowers, Chairman, Alison Lescarbeau, Vice hair-man, John Simons, Cleric, Alberto Angles, Associate Member and JGseph V. Mahoney. William J. Scott, Director of Community Development was also present. The petitioner was requesting a special permit to allow for the constructlan of a 7 5,000 Sf masonry & steei student residence, 'l he locatiou of the project is 315 Tumpike Street (Rt,1 14) and is in the Residential - 3 ( ,3) Zoning DistHct, Mr. Simons read t€re legal entice to open the public hearing. The proposed project is for two residence halls to be constructed on the grounds of Merrimack college. John Hollywood, architect, way present and stated the stracturi�s will house 300 students and 2 resident advisors- The proposed plan shows one building facing north and one west, located sor'cewhat over the existing parking area which will result in a loss of 70 parking spaces- The campus presently has 1,561 spaces, which is adequate, but 70 will be eliminated. A new parking policy stating that fiireshmtm cannot have vehicles on campus is b6ng instituted for fall of 1998- The College is seriously thinking of prohibiting sophornoTvs from having ve€ lOes on campus- There. is a shuttle bus program available now- The proposed building and walkways frame out a quad or courtyard- Utility and sewer €fines will be relocated- Wmimack College has been working with the Town of And ovcr in an effort to resolve the broader drainage issues that are caused by water from the College impactiFig Andover properties. The applicant was told by the Board they will need to provide a letter from ari appropriate Andover official indicating this- The applicant has supplied CONSERVATION &U-9534 HEALTH 6"-954fi cy(4Uq4TNC} 688-9535 { drainage information to Cofer& Colantonio for review, The College receives its water supply from the Town of Andover. A gtmtleman from the College stated that dufing the fall a general agreement should be reached with Andover regard irig the drainage, and construction should begin in the spring of''98, The Board is looking for assurance that the College is working with the Town of Andover on the drainage and once again the applicant was told to provide a letter stating such and also stating that the Town of Andover is is Favor of the Town of North Andover proceeding with the Site Platt Review process- The applicant has an application before ZBA for a variance regarding the height ofthe buildings- Mr. Simons asked if the roof is pitched and was told "yes" and it will be made of asphalt shingles- A site wally is scheduled for Wednesday, August 13, 1997 at 6.-00 BM- Everyone will meet on the Ash Residence area of the College. Discussion continued until the fI 9f97 meeting. The North Andover Planning Board held a regular meeting on August 19, 1997- The following members were present; Richard Rowen, Chairman, John Simons, Clerk, Alberta Andes, Associate Member, Richard Nardd[a and Joseph V, Mahoney - William I Scott, Director of Corr munity Development was also present, r- Rowen stated that he has seen and walked tN-, sits and has no major issues. The Zo6rig Board-of Appeals has granted them a variance- Mr. Coppola stated that they are going to prohibit freshman parking on the campus. Mr- Coppola stated that by doing this it eliminate about 400 cars. The Director of Pub Iic Works of Andover submitted a letter to the Board stating that the College has been working with therm on solving any drainage problems. r- Nardella stated that he had visited the site and saw no issues, r- Mahoney asked if the Fire Department had any issues. Mr- Scott stated that they have no major issues. On a motion by Mr. Maloney, seconded by Mr. Simons, the Board voted unanimously+ to close the Public Hearing. On a motion by r- Mahoney, seconded by Mr- Simons, the board voted unanimoudy to accept the draft decision as amended. This application was filed with the Planning Hoard on July 7, 197. 1 The Planning Board imakes the following findings: as required by the forth Andov4.r o2ung Bylaws Section 8.3 and 10.3 FINDINGS OF FACT; L The.�pecifiq site is an appropriate location for the project as it is located in the l esfdentfal-3 district along a major roadway, surrounded by the Merrhmek College m-npus and other residents; 2. The use as developed wjl~l not adversely affect the neighborhood'as the proposed use is an accoitunodation for students that will reduce vehicular trips to the site; 3._ There. will be no nuisance or serious hazard to vehicles or pedestrians; 4. The landscaping approved as a part of this plan mucks the requirements of Section 8.4 of the North Andover Zoning Bylaw; 5. The site drainage system is designed in accordance with the Town Bylaw requirements, farther a letter is on fk from the Andover DPW Director indicating the College, is Cooperating with the Towi'i ofAndover in the development of an overall drainage plan; 6. The applicant has met the requirt rments of the Towle for Site Piaui review as stat€d in Section 8.3 oftlie Zoning Bylaw; 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use, Finally, the Planr&g Board finds that this.project generally c:ompi s with the Town of N orth Andiawr Zonuig Bylaw requirements as listed in Section 8 35 but requires conditions in order to be fully in compliance. -The Planning Board hen-,by grants an approval to the applicant provided the following conditions are met- i SPECIAL CONDITIONS- 1. Prior to the end orsemeat of the plans by the Planning Board, the applicant must comply with the following conditions: a) The following infiormation must be provided to the consultant and to the Planning Department for review and approval and the appropriate clianges 1 made to the lams; i) Written confirmation of the restriction on proWbitio-n ofon-site vehicles for first year students. All lighfing shall have undergromid wiring and shaN be so amariged that all direct rays ftom such lighting falls entirely within the site and shall be shielded or rec sed sa as not to shine upon abutting properties or streets.
