The North Andover Planning Board held a p4b l is hearing on Tne3day
evonin g, October I, 1996 aL 7 : 30 p .m. in the Senior Canter behind
the Town Building, upon the application of Merrimack College, 315
Turnpike Street, No. Andover, MA 01845 requesting a .special
Permit under Section 8 . 3 Site Plan_ review of the North Anddova
Zoning Bylaw. The legal notice was properly advarLised in the
Forth Andover Citizen on September 11 and September 18, 1996 and
all parties of interest were duly notified . The following
members were present : Joseph V. Mahoney, Chairnan, Richard
Rowed, Mice Chairman, Alison hescarbeau, Clerk, Alberto Angle;,
Associate Member, Jahn Simons and Richard NaT,del_la .
The petitioner was requesting a' special permit to allow for the
construction of a 2250 sq ft one story masonry and steel
structure to be used an a garage and to relocate an exisitng 320
sq ft one story wood frame building to be used as an office
building in the Residential - 3 Q-3) Zoning District .
The premises affected is the property on the south side of the-
campus abutting the Alcott Village Condominium Complex .
Ms . Lesaarbeau read the legal notice to open the public haaring .
Richard Kaminski was present represer:ting Merrimack College along
with Bob Coppola and David Green . The proposed location is in
the R - 3 zoning district and is a large lot, but Merrimack z
not looking to subdivide . Mr. Kaminski stated that Merrimack
College will use the classroom building it moved from the Osco
site as offices for the maintenance department . A new garage and
storage area will be constructed. The area to house these two

buildings is heavily wooded and located near the AlcQtt Village
complex . There have been ongoing negotiations with the owners of
Alcott Village regarding their coDcer:�s . Mr. Kaminski stated
that the College had a matster plan - done and it shows the location
of where these buildings should be . The entrance will be a new
area created off to tiYe right . Alcott Village has agreed to
allow the College to' tie into them for their utilities . Mr.
Karc�i-�iski stated that Mike Howard will be out to view the
wetlands . The whole area is somewhat law and as such Mr .
Kaminski has initiated five borings on site to dete27mi-ne the
water table . The water table is high, therefore, a basement
under these buildings would be out of the question. The drainage
report has been submitted to Coler & Colantonio . There was a T C
meeting Yield and the fire department warts the two buildings
sprinklered. Mr . Kaminski stated that only minor repairs will be
done on the vehicles such as greye and oil changes . There will
be an MVC oil trap installed, the area will be kept as clean as
possible and 19 vehicle:; will be stoned. Mr. Nardel.la stated
that he has had complaints from people who drive down Route 125
and view the "Jji�in " that is stored near there . Mr . Coppola
stated that they have tried to install a fence, but Can Com won' t
let them, although they are all trying to work out a coTapromise .
Ms . Lescarbeau asked about hauling away trash and was told that
Merrimack hauls its own. Mr. Rowen asked what if there is ar: ail
spill rear the detention pond, and her. Kaminski replied that
maybe they could close some of that area off. He will look at
the possibility of doing that . ifs . Lescarbeau asked the height
of the building and was told 241 . Mr. Kaminski stated that thei7e
will be two wall packs i-nstalled on the back of the building and
they will not be offensive , Mr. KaTQinski also stated that a
chain link fence with green inserts will be installed, and MK-.
Simons asked why the fence couldn' t be wood. some discussion
took place regarding a wooden fence and hex'. Kaminski replied that
a wooden fence would be installed. Mr. Na:rdella pointed out that
the cleared area on the plan looks very large just to house 19
vehicles . other Board m42rbers agreed, and it was pointed out b
Mr. Coppola that Merrimack also has 2 buses to douse. Mr .
Nardella also asked if there was any other intended use for the-
area, and Mr . Coppola replied "no" . Mr. Simons stated that
anything you could do to Minimize the cutting of trees would be
good.
William Scott, Unit -15 of Alcott Tillage, was present and stated
that he i5 88 years old. He stated that he and his wife are
im3t )acted more than anyone - they cuzrently have a beautiful view
into the woods and that' s why they bought the unit . They don' t
lake to see the natural trees removed and they don' t want to see
a paved parking lot .

Mr. ard4�lla asked if this project' complies with R-3 zoning and
Mr. Coppola stated that a college Complies with R-3 zoning, and
under Mass General Law colleges are exE mpt from any zo-ning
regulations with tile exception of 2 or 3 town; and Nc)rth A7-idover

A site walk was arranged for 6 , 00 pm Tuesday, October 8, 1996 .
The Nofth Andover Planning Board held a regular meeting on
October 1.5, 1996 . The foilowing members were present : Joseph V.
Mahoney, dhairman, Alison Lescarbeau, Clerk, Albefto Angles,
Associate Member and John Simons .
Richard Kaminski was present for the continued discussion of this
project . A site walk was Yield and the building was staked out
relative to the Alcott Cortdos . Mr . aminski stated that he will
be able to reduce the tree cutting by running the utility limes
along the building and connecting to Alcott Village in an aL-ea
where a natural clearing exist.:; . Additional trees will b�
Planted to create more density to shield Alcott Tillage . A
wooden fence generic in nature will be installed. The Alcott
Village side of the fence will be attached with pine to make it
j-no�e attractive . fir . Kaminski stated that the college has
retaiiied an acoustical engincQr and thus will install noise
sensors on site in order to calculatL- the noise level . This,
however, will take some time . Mr . Mahoney asked about the style
and structure of the building and Mr . Kaminski replied he will
stay with masonry veneered with clapboard. The present building
has a flat roof, and maybe that could be gabled. The Board
agreed that_ the fence should be in;}tilled as soon as possible .
On a motion by Mr. Angles, seconded by Ms . Lescarhea�i, the Board
voted unanimously to close the public: heal .in.g.
Ibis . Colwell had a draft decision prepared for the Board' s review.
On a motion by Ms . Lescarbeau, seconded by Mr . Angle:;, the Board
voted unanimously to approve the draft decision as amended
tonight .

The Phuming Board rnakes the following findings as required by the Zoning Bylaw Section 83 arid
103-
FINDINGS OF FACT:
I The specific site is an appropriate location for the maintenance building it is located on the
campus f"Merrimack College and is,part of their onerd Master Plan for the college,
2. The use, as developed, will not adversely affect the n6glaborhood as sufficient, buirer zanes,
have been created to shield the use frorn, adjacent properties,
3'. There wwih be no nuisance or sefio us,hazard to vehicles or pedestrians,-
4. 'rhe landscapftig, plan approved as a part of this plan meets the requirements f Section SA of
the Zoning Bylaw with review by the Planning Board;

Finally, the Planning Board finds that this project generally complies with the Town of North Allover
Zoning Bylaw requirements as listed in Section. 835 but requires conditions in order to befliffy in

Planning Staff Any changes to the approved lighti.i plan as may be reasonably
required by the Plan Staffshall be made at the owner's expense-
c) Alt buildings shall have commercial arc spiinklers installed in accordance with the
North Andover Fire Department,
5, Prior to the fin at release of security:
a) The site shall be reviewed by the Plaruiing Staff Any screening as may be reasonably
required by the Planning Star' and/or Tree Warden will be added at the applicant's
expense.
b) A final as-buill plan showing the location of all are- site utilities, stwdwes, curb cuts,
parking spaces and drainage facilities must be subrr�tted to and reviewed by the
Division of Public Works.
6, Any plants, trees or shrubs that have been incorporated into the Landscape Plata approved in
this decision that die within one year from the elate of planting shall be replace by the owner.

employees and a]I successors and assigns in interest or control_
14, Any action by a Fawn Board, Coirnmissiory or Department which requires changes its the plan
or design of the budding as presented to the Planrjhg Board, may be subject to modification by
the Plarming Board,
15. Any revisions shal I be submitted to the Town Planner for review_ if these revisiom are deemed
substantial, the applicant must subn it revised plans to the Planning Board for approval.
16, This Special Pent t approval shall be deemed to have, lapsed after-
(two years frojn the date permit granted) unless substantial use or construction has
commenced. Substantial use or con tructioj7 will be detenninad by a majority vote of the
Planning Board.
